NOTICE OF DECISION
Watershed Special Permit-Waiver

HISTORY AND BACKGROUND
On April 1, 2014, the applicant, Brooks School, requested a Waiver of the Watershed Protection
District Special Permit,in accordance with the North Andover Zoning Bylaw section 4.136.8, so
as to allow the creation of a new driveway and pedestrian walkway, a re-configuration of parking
spaces and the expansion of an existing Chapel building within the Non-Discharge Buffer Zone
of the Watershed Protection Zone. A motion was made by D. Kellogg and seconded by L.
Rudnicki to grant the waiver. The vote was 5 —0 in favor of the motion.
FINDINGS OF FACT
The Planning Board has approved a Watershed Special Permit Waiver based on the following
findings:
• The proposed addition to the Chapel building will be approximately 1,000 sq. ft.
• The proposed driveway and walkway re-configuration will result in an increase in
impervious area of approximately 8,350 sq. ft.
• The applicant has provided capacity within,the proposed stormwater structures to handle
run-off from approximately 3X the proposed,increase in impervious surface.
• A portion of the project work will take place within the non-discharge zone. That portion
is approximately 1,080 sq. ft. in area.
• The Conservation Commission has reviewed the project and has issued a negative
determination based on the fact that the project as designed will not directly connect to
existing stormwater management structures and all stormwater will be directed to Low
Impact Development BMPs.
• The project has been reviewed by the Planning Board's stormwater consultant, Lisa
Eggleston, as evidenced by emails dated Tuesday March 11,2014, Tuesday March 18,
2014 and Wednesday March 19,'2014.
CONDITIONS
• Prior to the start of construction the applicant shall ensure that the site contractor has
reviewed the project plans and is aware of the wetland resource areas and the limits of the
proposed work.
• Prior to the start of construction,the contractor will install erosion controls per the Erosion
Control Plan. Once erosion controls are installed, the contractor will contact the Conservation
and Planning Departments to schedule a preconstruction meeting to inspect the installed
erosion controls.
• Excess soils or other material shall not be stockpiled within 100' of the resource areas.
• Upon completion of the approved project and site stabilization(seeded areas are ready to be
mowed), please contact the Conservation and Planning Departments for a final inspection.
Once approved, erosion controls can be removed.
