Dear Members of the Board:
On behalf of the applicant, Peter X. O'Neill, Seekarnp Environmental Consulting, Inc.
(SEC),hereby requests a Special Permit for work within the Watershed Protection
District. The proposed project involves conversion of a three-season, enclosed porch to
all-season living space on concrete-filled sonotubes. The applicant appeared before the
North Andover Conservation Commission(NACC) during fall of 2002, at which time an
Order of Conditions was issued approving the proposed work.
According to Section 4.136 of the Town of North Andover Zoning Bylaw, additions to
single-family houses that were in existence prior to the establishment of the Watershed
Protection District Regulations (October 24, 1994) may be allowed within the Non-
Disturbance Zone (0'-100' from wetlands) by special permit, provided the gross floor
area does not increase by more than 25%. The proposed project will result in an
additional 25 s.f of living space, which represents a 0.008 % increase in gross floor area,
well below the 25% allowed in the zoning regulations. The project,therefore, qualifies
for a special permit.
Additional requirements for issuance of a special permit include a demonstration by the
applicant that the proposed development will not result in a degradation of the quality or
quantity of water in Lake Cochichewick. As previously indicated, the project entails
conversion of an existing enclosed porch to all-season living space. The existing
structure measures 14'x10', and is supported by three pilings, which are currently in need
of repair. The existing columns will be replaced with three concrete-filled sonotubes.
The proposed project will increase the length of the structure by approximately 2.5 feet,
which represents an additional 25 s.f of living space. Impacts to the Watershed
Protection District are limited to temporary disturbance of soil substrate during
installation of the support pilings, as well as a slight increase (25 s.f) in the impervious
area on the lot.
In order to prevent impacts to water quality and quantity, the applicant proposes to
implement several impact avoidance/mitigation measures. These measures are detailed
on the plans prepared by Plaistow Consultants, entitled"Flan of Land in North Andover,
MA", dated September 9, 2002, and revised through November 4, 2002, and also in the
Restoration and Mitigation Plan prepared by Seekamp Environmental Consulting, Inc.
Copies of both documents accompany this request for special permit. The impact
avoidance and mitigation measures include installation, maintenance, and weekly
monitoring of temporary erosion control measures during construction, which will serve
to ensure that the proposed work will not detrimentally affect the water quality of the
adjacent wetland or Lake Cochichewick. Mitigation for additional impervious surface
(25 s.£) includes the installation of roof drains and infiltration trenches, which have been
designed to assimilate runoff from the rear fagade of both the existing single-family
house and the proposed addition. Additional mitigation in the form of restorative
plantings have been designed at the request of the Conservation Commission, in order to
improve the ability of the site to attenuate pollutants, and to provide a natural buffer to
the adjacent wetland. These measures, collectively, will serve to maintain and improve
both the quality and quantity of water that recharges Lake Cochichewick.
