HISTORY AND BACKGROUND On January 19, 2010, the Applicant, Robert Ercolini, filed an Application for Watershed Special Permit with the Planning Board pursuant to Section 4.137 of the Town of North Andover Zoning Bylaws. On March 2, 2010, the Planning Board unanimously voted to grant the Applicant a Watershed Special Permit for the Premises Affected, and proceeded to issue a Special Permit Decision approving the Project. The applicant has submitted a revised plan, through his engineering company, Merrimack Engineering Services of Andover, MA, dated March 26, 2010. The new plan was reviewed by the Planning Board at their meeting on November 9, 2010, at which time, the board voted that the changes made were did not warrant a modification to the original Special Permit. The applicant has subsequently made additional changes to the plan, now dated May 9, 2011. The changes made to the plan are as follows: The following modifications/additions were made within the 100ft. Non-Disturbance Zone: • A new landscaping wall area consisting of 64 sq. ft. • New stairs and stepping stone walk with area of 302 sq. ft. • New bluestone patio on a gravel base with granite steps with area of 275 sq. ft. The stairs, stepping stone walk and landscaping walls will increase the impervious area by 366 sq. ft., all of which will be infiltrated using the proposed infiltration cisterns. 195 Bridal Path—Robert Erolini Map 104C,Parcel 14 Watershed Special Permit(Insubstantial Change Decision) July 19,2011 FINDINGS OF FACT The new stormwater infiltration structure will mitigate the increase in impervious surface, thus insuring that there will be no further degradation of water quality within the Watershed Protection Zone. CONDITIONS The Town Planner's finding of no substantial change is conditioned on the following: 1. The applicant must show all changes on the final as-built plan, which must be provided to the Planning Department before the bond is released, according to Condition#4, as stated in the Special Permit Decision. 2. That this Decision is recorded with the Registry of Deeds and evidence of recording is to be provided to the Planning Department. Accordingly, Robert Ercolini may proceed with the proposed renovation project in accordance with the Site Plans referenced in the Special Permit Decision, as modified by the plan and adjustments referenced above.
