SacwuS North Andover, Massachusetts 01845 J 5 NOTICE OF DECISION (INSUBSTANTIAL CHANGE) Date of Decision: November 16, 2010 Application of: Robert Ercolini 195 Bridal Path,North Andover, MA 01845 Premises Affected: 195 Bridal, North Andover, MA 01845, within the Residential 1 (R-1) Zoning District,Assessors Map 1040,Parcel 14. HISTORY AND BACKGROUND On January 19,2010, the Applicant,Robert Ercolini, filed an Application for Watershed Special Permit with the Planning Board pursuant to Section 4.137 of the Town of North Andover Zoning Bylaws. On March 2, 2010,the Planning Board unanimously voted to grant the Applicant a Watershed Special Permit for the Premises Affected, and proceeded to issue a Special Permit Decision approving the Project. The applicant has submitted a revised plan,through his engineering company,Merrimack Engineering Services of Andover,MA, dated March 26, 2010. The new plan was reviewed by the Planning Board at their meeting on November 9, 2010, at which time,the board voted that the,changes made were did not warrant a modification to the original Special Permit. The changes made to the plan are as follows: The following modifications were made within the l 00ft. Non-Disturbance Zone: • A new wall, comprising 242 sq ft. This wall is to be located in the same area of the property where a `skateboard' ramp had existed. • New stairs and a bluestone walk, comprising 258 sq. ft. The bluestone walk and patio will be set on crushed stone with sand filling the joints. • Two (2) infiltration cisterns for infiltration of the new patio area. In addition to the above changes, there will be two (2) additional infiltration cisterns located outside of the 100 ft.Non-Disturbance buffer area. The above changes will result in a total of 10,380 sq ft. of impervious surface, as opposed to 9,602 sq. ft. shown on the prior plan. 195 Bridal Path—Robert Erolini Map 104C,Parcel 14 Watershed Special Permit(Insubstantial Change Decision) November 16,2010 FINDINGS OF FACT The new stormwater infiltration structure will mitigate the increase in impervious surface, thus insuring that there will be no further degradation of water quality within the Watershed Protection Zone. CONDITIONS The Town Planner's finding of no substantial change is conditioned on the following: 1. The applicant must show all changes on the final as-built plan, which must be provided to the Planning Department before the bond is released, according to Condition#4, as stated in the Special Permit Decision. 2. That this Decision is recorded with the Registry of Deeds and evidence of recording is to be provided to the Planning Department. Accordingly, Robert Ercolini may proceed with the proposed renovation project in accordance with the Site Plans referenced in the Special Permit Decision, as modified by the plan and adjustments referenced above.
