DRAFT MINUTES
Tuesday,August 14,2012 at 7:30 PM
Town Hall 120 Main Street,North Andover, Massachusetts
Members present: Ellen McIntyre,Richard Byers,Paul Koch
Associate Member: Michael Liporto
Also in attendance: Zoning Enforcement Officer: Gerald Brown
Excused absence: Albert Manzi 111,Esq., and Tyler Speck
Chairman, Albeit Manzi has an excused absence. In his absence Vice-Chairman, Ellen McIntyre will be
the Acting Chairman at tonight's meeting.
McIntyre called the meeting to order at 7:45
McIntyre stated that we are waiting for another board member to arrive before we get to the public
hearings. McIntyre stated at the moment we only have a(4) four member board. McIntyre stated that
we will do some of the paperwork and correspondences while we are waiting for the fifth member to
arrive.
Pledge of Allegiance
Acceptance of Minutes for June 19,2012
Byers made the motion to approve the June 19, 2012 Minutes
Koch Second the motion.
Those voting in favor to approve the minutes were McIntyre, Byers, Koch and Liporto.

McIntyre stated that she has three letters for re-appointment to the Board of Appeals, Albeit Manzi 111,
Richard Byers and Michael Liporto. The letters were all dated 20 June 2012 and were all signed from
the Town Manager, Andrew Maylor.
Committee Report Housing Partnership Report
McIntyre stated that she has nothing to report on the Housing Partnership.
Miscellaneous Correspondence
McIntyre discussed briefly the correspondences included in the Board's packets.
Correspondences included the following;
Two letters from CHAPA were submitted to the Board. One letter was dated 28 June 2012, regarding
property at 180 Chickering Road, Unit 303C. The second letter was dated July 9,2012 regarding

property at 1305 Basswood Circle (part of Oakridge and Maplewood Reserve).
Also a letter submitted from Curt Bellavance, dated July 20,2012, "Right of First Refusal". Units listed
on the letter were 180 Chickering Road, Unit 303C and 1305 Basswood Circle.
A letter submitted to our Town Manager, Andrew Maylor from Dennis DiZoglio, Executive Director of
the Merrimack Valley Planning Commission (MVPC), dated July 23, 2012. 1 oth,
A letter from Mass Housing was sent to notify the Town of a possible new 40B (dated August
2012).
The last letter also submitted from Mass Housing regarding Merrimac Condominiums, Final Approval
letter dated August 8"', 2012.
McIntyre stated that we still have two (2) continued public hearings and a new public hearing. We still
only have 4 members. McIntyre stated the voting rules of a four (4)member board and how it would
have to be unanimous to be approved. 1h
Atty. Domenic Scalise walked over to the podium asking if the 5th member will be attending the
meeting. McIntyre answered that the board is expecting him to attend the meeting.
Continued Public Hearing
For the Special Permit on 41 Second Street and Special Permit and Variance on 22 Upland Street,
Scalise stated both his client would prefer to wait till the arrival of the 5t"board member..
New Public Hearing
For the Variance on 1077 Osgood Street,Atty. Thomas Smith stated that his client would also prefer to
wait on the arrival of the 5th board member.
McIntyre called a recess until the 5th member showed up.
McIntyre called the meeting back to order at 8:18.
McIntyre stated that unfortunately our 5t"member did not arrive tonight. McIntyre wanted to remind
everyone that the board is made up of volunteers and that they are all North Andover citizens.
Scalise stated both his clients wanted to continue till the next meeting that was scheduled for September

Byers made a motion to continue to the next meeting scheduled for September 11, 2012
Koch second the motion to continue.
Those voting in favor to continue the hearing for 41 Second Street were McIntyre, Byers, Koch, and
Liporto.
All were in favor to continue this hearing; 4-0.

Byers made a motion to continue to the next meeting scheduled for September 11, 2012
Koch second the motion to continue.
Those voting in favor to continue the hearing for 22 Upland Street were McIntyre, Byers, Koch, and
Liporto.
All were in favor to continue this hearing; 4-0.
Scalise signed the two continuation waive forms one was for 41 Second Street and the other was for 22
Upland Street, Scalise returned the signed forms back over to the Zoning Assistant.
McIntyre apologized to all those who came out to attend these hearings.
New Public Hearin
Variance GB-Zoning District, William Yameen, Angus Realty Corp, 1077 Osgood Street (Map 35,
Parcel 27)
Byers opened the new public hearing for 1077 Osgood Street,Angus realty Corp.
Atty. Smith requested to also continue this hearing until September 11"' as well (no evidence was
presented).
Byers made a motion to continue to the next meeting scheduled for September 11, 2012
Koch second the motion to continue.
Those voting in favor to continue the Hearing for 1077 Osgood Street,Angus Realty Corp were
McIntyre, Byers, Koch, and Liporto.
All were in favor to continue this Hearing; 4-0.
Smith signed the continuation waive form for 1077 Osgood Street and returned it back over to the Zoning
Assistant.
McIntyre apologized again for all who came out to attend tonight's meeting.
Byers made a motion to adjourn

Those voting in favor to adjourn were McIntyre, Byers, Koch, and Liporto.
All were in favor, 4-0.
