The land in North Andover,Essex County,Massachusetts, being shown as Lot 3 on a plan of land
entitled"Special Permit and Definitive Subdivision Plan Carter Fields S-ubdivision,Prepared for
Tara Leigh Development, LLC, Ion HF Design Consultants,Inc.,Date: August 9, 2002" and all,
recorded with the Essex North District Registry of Deeds as Plan No. 14471. Said Lot 3 contains
34,882 square feet of land,more or less, according to said Plan, to which reference is beroby
made for a more particular description of said Lot. C4
The premises are conveyed subject to and with the benefit of the followi.nz:

As required by the PRD Special Pen-nit issued by the Town of North Andover Planning Board,
dated December 17, 2002,the Buyer of Lot 3 within the Carter Fields Subdivision acknowledges
that the Open Space Parcels shovm on said Plans, which have been or will be conveyed to an
appropriate conservation organization or the Town of North Andover through its Conservation
Commission as determined by the Planning Board, for conservation, agricultural mid/or
recreational purposes, shall provide the Town with the right,but shall not impose any obligation
on the Town, to maintain the Open Space parcels in any particular state or condition,
notwithstanding the Town's acceptance of such Gpelr Space parcels.
Conveyed herewith is the right to use streets and ways as shown on said.Plan in common with
others entitled thereto,the Grantor reserving the fee in all streets and ways as shown on said Plan.
For title purposes,note that portions of the subdivision of which the premises herein conveyed are
a part, are affected by Ch. 413 of the Acts of 2002 entitled"'An Act Changing the Boundary Line
Between Boxford and North Andover„
Meaning and intending to convey a portion of the premises conveyed to the Grantor by deed of
Anne M. Renshaw and Judith C.Niob kern,Trustees,dated April 10, 2003 and recorded with the
Essex North District Registry of Deeds at Book 7688,Page 246; also recorded with the Essex
South District Registry of Deeds at Book 20563, Page 513,
This is not a conveyance of all or substantially all of the Massachusetts assets of the Grantor
Corporation and is made in the ordinary course of business.

hereto affixed and these presents to be signed, acknowledged and delivered in its name and behalf
