Proposal:
Fred McCarthy is before the Planning Board seeking approval of a Watershed Special Permit to raze the
existing single-family residence and construct a new 2,035 s.f. single-family residence,remove portion of
impervious driveway,and associated grading work and drainage/stormwater management improvements
within the Non-Disturbance Buffer Zone of the Watershed Protection District. The project site is located
at 357 Dale Street, Assessors Map 64,Parcel 24and lies in the R-1 Zoning District. The parcel consists of
approximately 122,045 s.f.with more than 175 feet of linear feet of frontage on Dale Street. The parcel
was created on/about 1948 and is subject to the Watershed Protection District provisions for a lot created
beore October 24, 1994.
Background:
➢ This is the second public hearing for the application. Mr. McCarthy was last before the Planning
Board on November 20, 2007,but was continued to the December 4, 2007 meeting in order to
address Staff and Planning Board comments and allow additional time to review the revised plans.
The Planning Board also directed Planning Staff to draft a decision in preparation for the December 4,
2007 meeting.
➢ The Planning Board agreed to waive the outside consultant review and allow the Town Engineer to
review the stormwater and drainage calculations.
My review is based on the following plans:

SECTION 3 ZONING DISTRICTS AND BOUNDARIES
The parcels of land are located within the Watershed Protection District of Lake Cochichewick and is
located in the Residential 1 Zoning District. Parcels 1 and 2 are currently undeveloped lots.
SECTION 4.136 WATERSHED PROTECTION DISTRICT
Section 2—Boundaries and Zones:
The proposed activities are located primarily within the 100 ft.Non-Disturbance Zone associated with
bordering vegetated wetlands in the Watershed Protection District. All Watershed Protection Buffer
Zones are correctly labeled on the plan
Section 3—Uses and Building Requirements:
The construction of a single-family home within the 100' Non-Disturbance Buffer Zone associated with
bordering vegetated wetlands in the Watershed Protection District would be allowed by a Special Permit
from the Planning Board.
Section 4: —Special Permit Requirements:
➢ 4.136(4)(c)(ii).Map on a scale of one(1)inch equals forty(40)feet prepared by Registered
Professional Engineer or Surveyor showing:
(2)The edge of all wetland resource areas, as confirmed by the Conservation Commission(if edge of
wetland resource area is within four hundred(400)feet of any proposed activity),
(4)The non-disturbance zone,
(6) The edge of vegetation clearing(edge of work).
Addressed.
➢ 4.136(4)(c)(iii). Written certification by a Registered Professional Engineer, or other scientist
educated in and possessing extensive experience in the science of hydrology and hydrogeology,
stating that there will not be any significant degradation of the quality or quantity of water in or
entering Lake Cochichewick.
Addressed.
➢ 4.136(4)(c)(iv).Proof that there is no reasonable alternative location outside the Conservation,Non-
Disturbance and/or Non-Discharge Buffer Zones,whichever is applicable,for any discharge,
structure, or activity, associated with the proposed use to occur.
Addressed. The location of the proposed home has been located to minimize the amount of
environmental impact and will maintain the rural aesthetic character. Further, the razing of the
existing single-family home and removal of a section of the driveway will offset the impact of the
proposed single-family.

➢ 4.136(4)(c)(v).Evidence of approval by the Mass. Dept. of Environmental Protection(DEP) of any
industrial waste water treatment or disposal system or any waste water treatment of system fifteen
thousand (15,000) gallons per day capacity.
Addressed The project will not result in any industrial waster water treatment or disposal system or
any wastewater treatment system of fifteen thousand gallons per day capacity.
➢ 4.136(4)(c)(vi).Evidence that all on-site operations including,but not limited to, construction, waste
water disposal, fertilizer applications and septic systems will not create concentrations of Nitrogen in
groundwater, greater than the Federal limit at the down gradient property boundary.
Addressed The applicant provided written documentation stating that the proposed activities will not
create concentrations of nitrogen,phosphorous and other relevant chemicals on and off-site the
property. The home will be tied to the municipal sewer systems, eliminating the need for additional
septic fields and possible nitrogen loading in the Watershed Protection District.
➢ 4.136 (4)(c)(vii). Projections of down gradient concentrations of nitrogen,phosphorus and other
relevant chemicals at property boundaries and other locations deemed pertinent by the SPGA.
Addressed. The applicantprovided written documentation stating that the proposed activities will not
create concentrations of nitrogen,phosphorous and other relevant chemicals on and off-site the
property. The home will be tied to the municipal sewer systems, eliminating the need for additional
septic fields and possible nitrogen loading in the Watershed Protection District.
➢ 4.136 (4)(g). The Bylaw requires that any runoff from impervious areas within the Non-Disturbance
and Non-Discharge Zones to the extent possible shall be recharged on site and diverted toward areas
covered with vegetation for surface infiltration.
Addressed. The project has been designed specifically to fninitnize the impact to the buffer zone
associated with the Watershed Protection District.
SECTION 7 DIMENSIONAL REQUIREMENTS
Section 7.1-Lot Area: The lots are within the R-1 district with a total area of approximately 122,045 s.f.
with more than 175 linear feet of frontage on Bradford Street.
Section 7.3- Setbacks: Proposed structure meets the required yard setbacks of the Residential 1 District
as shown on the Layout Plan.
Section 7.4—Building Heights: The proposed single-family home will be less than the maximum height
limit of 35 feet.
GENERAL COMMENTS:
➢ Gene Willis,Town Engineer,reviewed the storm water management and drainage information and
found no issues. Please refer to the November 5, 2007 letter from Gene Willis,P.E.,Director of
Engineering.
➢ Planning Staff has reviewed the applications and finds that the applicant has satisfied the general
requirements for Zoning Bylaw, Sections 4.136 and 10.3. Staff, however, recommends
removing the portion of the driveway on the western side of the property. In addition,the
applicant should clarify if the pool will be removed as part of the razing of the existing
house.
Addressed. The revised November 20, 2007 plans include notes stating the following.

1. The existing pool maybe razed and buried in place at the discretion of the owner.
2. Removal and disposal of existing asphalt may be undertaken by property owner. Disposal of
asphalt will be done on site in the foundation hole of the existing dwelling which is to be
razed. Disposal of asphalt on site is allowed by DEP Regulation 310 CMR 1605(3)(e).
Planning Staff would prefer that both the pool and asphalt surface be removed/relocated during the
construction of the new home. However,performing such activities may prove to be cost prohibitive
for the applicant at this juncture. The project as proposed meets the intent of the Bylaw by reducing
cumulative impact on the watershed protection district and decreasing to total area of impervious
surface. Planning Staff finds that the language/notes on the plan would be satisfactory.
➢ Although the application states that the erosion control line will be installed between the
project and the wetland area to prevent silting during construction,the applicant should show
the location of the erosion control line on the plans.
Addressed The revised November 20, 2007 plans correctly show the location of the erosion
control line for all phases of construction and removal.
RECOMMENDATION:
If the Planning Board finds that the application is complete and that all information has been provided to
support the Watershed Special Permit request,Planning Staff recommends closing the public hearing and
review the attached draft decision for the Watershed Special Permit.
