Town Warrant
REPORT OF THE ADVISORY COMMITTEE
TOWN MEETING MARCH 1967
FELLOW CITIZENS OF NORTH ANDOVER:
On The pages That follow in This report are The recommendations of your
Advisory Committee. In This connection, a great deal of time and effort bas been
expended in The interest of making The best possible decisions directed Toward a
sound economic climate. While you may not agree with all of These decisions,
should be recognized That The underlying motives can only be identified with The
overall welfare of The Town~ its citizens and yourself.
AT The start of our meeTings~ it was obvious That unless careful restraints
were exercised The 1967 Tax rate would reach extreme proportions. As a matter of
fact, at one point in Time The Committee was faced with a situation whereby The sum
of $350,000 in expenses beyond anticipated revenue would be placed upon the Town
should all requests for funds be approved. Moreover~ The usual so-called available
funds Turned out To be $60,000 instead of The expected $184,000 Thus reducing This
source of income by roughly $124,000. In short, we were faced with The need To pro-
vide one-half million dollars of additional revenue.
We are sure you will agree that To proceed without judicious restraint would
be econimically unfair To our people and most certainly would not be in keeping with
our responsibility as an Advisory Committee. Toward this end, The recommendations
reflect our collective opinion as To what we believe is the best course To follow
within sound economic limits while continuing and even imp~roving The services and
benefits maintained over past years.
A good purpose may be served in explaining The rationale behind our approval
of certain of the major cost items appearing within This report particularly in The
areas of education, welfare and health.
A school budget providing for an increase of money in excess of $200~000 was
submitted by The School Committee. The Advisory Committee hearily concurs with The
prudent expenditure of money Toward The end of enhancing our school system so That
The children of The Town in The formative years of life can be exposed To The best
possible educational Techniques, facilities and Teachers. While we have no author-
ity as a body To recommend acceptance or rejection of such school expenditures, we
feel That we would be remiss if we did not comment favorably upon This need for
addi?ional revenue.
As you may know, There is a serious situation within our Town with respect To
its water supply. While, at The present Time, it is not deemed To be critical, if
prompt action is not Taken it could result in a potential health hazard and an
annoying inconvenience To The Town and people of North Andover. We have satisfied
ourselves That There is an urgent need for additional water and The drilling of new
wells as a source of supply is a practical answer.
Upon our recommendation of last year, an Ad Hoc Committee was named ~o sTudy~
on a composite basis, The need for a new police sTaTion~ new fire station and a new
Town garage To house and maintain Town equipment. The report of That Committee
places a priority on ~he police station and concurs on The need for a fire s~aTion
and a Town garage, in This order. We are Taking The first step in answering such
needs by recommending The erection of a new police station with The hope That ec-
onomic circumstances in future years will allow The Town To satisfy These other
needs.
As you may know, an unhealthy air pollution condition has occurred due to
spontaneous combustion causing fires in the town dump. Investigation has revealed
that the most practical'way to remedy this situation is to provide the highway
surveyor with much needed equipment to effectively operate it as a land filled
facility. We believe that it is imperative to take action this year to eliminate
or minimize the adverse effects being produced.
We feel that we would be failing in our duties if we did not recognize in some
objective way the performance and dedication of the people who work in the various
town departments in order to provide services and conveniences to our citizens.
Therefore, realizing that the cost of living has been increasing each year, we are
in agreement that a substantial part of the Personnel Board's recommendation for
increasing salaries and wages should be put into effect beginning April 1, 1967.
In conclusion, we would like to make the observation that a town is good be-
cause of the inherent value and quality of its citizens and the wisdom and fore-
sight of its administrators. In making our judgments, we have tried to keep these
points in mind as criteria.
If the Committee's recommendations are followed it would appear, and this is
an estimate, that the tax rate would increase by approximately $8. We realize that
this is a significant hike in the tax rate, but we believe it is necessary in the
best interests of North Andover.

To either of the Constables of the Town of North Andover:
GREETINGS:
In The name of The Commonwealth of Massachusetts, you are hereby directed to
notify and warn the inhabitants of the Town of North Andover qualified To vote in
elections and town affairs~ To meet in The BradstreeT School Auditorium in Precinct
One, the ST. Michael's School Auditorium in Precinct Two, The Thomson School Audi-
Torium in Precinct Three and The Kittredge School Auditorium in Precinct Four, all
in said North Andover on Monday~ The Sixth Day of March 1967, at 7 o'clock A.M.~ and
there to act on The following Article:
ARTICLE 1. To elect a Moderator, and Town Treasurer for one year, Collector of
Taxes, Highway Surveyor, Tree Warden~ One SelecTman~ one member of The Board of Pub-
lic Welfare, one member of The Board of Assessors~ one member of The Board of Health
one member of the Board of Public Works, and two members of The School Committee all
for three years, one member of The Planning Board for five years.
All to be voted upon one ballot, The polls shall be open at 7:00 A.M., and
shall be closed at 7:00 P.M.
After final action on The preceding Article 1, said meeting shall stand ad-
journed by virtue of Section 4, Article 1 of the Town By-Laws to Saturday, March 18~
1967 at one-thirty F.M., in The Veterans' Auditorium of the North Andover ~_igh
School, Then and There to act on the following articles:
ARTICLE 2. To elect all other officers not required by law to be elected by
ballot.

It is recommended that the Town refer to the Selectmen the appointment
of Town Officers not required by law or By-Law to be otherwise chosen.
ARTICLE 3. To see if the Town will vote To accept The report of receipts and
expenditures as presented by The Selectmen.

ARTICLE 4. To see what action the Town will Take as to its unexpended
appropriations.

ARTICLE 7. To see if the Town will vote to authorize the Town Treasurer, with
the approval of the Selectmen, to borrow money from time to time in anticipation of
the revenue of the financial years beginning January 1, 1967 and January 1, 1968, in
accordance with provisions of General Laws, Chapter 44, Section 4, and to renew any
note or notes as may be given for a period of less than one year, in accordance with
the provisions of General Laws, Chapter 44, Section 17.

It is recommended that the Town vote to ADOPT the article.
ARTICLE 8. To consider the reports of all Special Committees.

It is recommended that the reports of all Special Committees
be heard.
ARTICLE 9. To see if the Town will vote to authorize the Board of Health to
appoint one of its members to the position of Board of Health Physician and to fix
his compensation as such, as provided by Section 4A of Chapter 41 of the General
Laws.
Petition of the Board of Health.
It is recommended that the Town vote to ADOPT the article and to fix
the annual compensation of the Board of Health Physician at $1,100.00,
effective April 1, 1967.
ARTICLE 10. To see if the Town will vote to raise and appropriate the sum of
$1,500, to be used for a Town Fourth of July'Celebration, any and all profits made
at said celebration to be returned to the Town~ said appropriation to be expended
by a committee of nine members to be appointed by the Selectmen.

It is recommended that the Town vote to ADOPT the article.
ARTICLE 11. To see if the Town will vote to raise and appropriate the sum of
$800, to be expended under the direction of the Selectmen~ to match a like sum to be
raised by the North Andover Board of Trade~ for the purpose of providing decorative
lighting during ~he Christmas Season.

It is recommended that the Town vote to ADOPT the article.

ARTICLE 25. To see if the Town will vote to amend Article I of its General
By-Laws by adding the following new section:
Section 9: An article in the warrant for any town meeting proposing

proper purpose shall be taken to propose that the suggested appropri-
ation may be met not only by taxation, but also by a transfer from
available revenue funds in the town treasury, or by a proper municipal
borrowing, or by any combination of these sources of funds, all as the
town may vote.

ARTICLE 26. To see if the Town will vote to accept the provisions of G.L.
c.90, 18A~ as amended, General Laws~ Chapter 90~ Section 1SA, inserted by St. 1962,

the approval of the State Department of Public Works, regulating the use by pedes-
trians of ways within the Town.

ARTICLE 32. To see if the Town will vote to raise and appropriate the sum of
$700, to be expended under the direction of the Highway Surveyor for the purpose of
making and placing Street Signs.

ARTICLE 33. To see if the Town will vote to raise and appropriate or transfer
from available funds, the sum of $4,400, for the purchase of two new 1967, 12 volt
system cars with necessary safety ~equipment. Two 1965 cars to be turned in~ in
trade, and all equipment to be changed over, such as police radios, sirens and other
similar accessories.

ARTICLE 34. To see if the Town will vote to raise and appropriate the sum of
$35,000, to be expended under the direction of the Selectmen for the purpose of the

townyard~ approximately 70 by 125 feet, at an approximate cost of $35,000~ to house
town vehicles.

ARTICLE 35. To see if the Town will vote to raise and appropriate the sum of
$100,000, to be expended under the direction of the Selectmen for the purpose of
construction of a police station on the site of the old Johnson High School.

It is recommended that the Town vote to appropriate the sum of
$100,000 to be expended under the direction of the Selectmen for
the purpose of the construction of a police station on the site
of the old Johnson High School, and that to meet this appropriation
the sum of $3,000.00 is to be raised from the tax levy of the
current year, and the Treasurer, with the approval of the Select-
men, is authorized to issue $97,000 bonds or notes of the Town under
Chapter 44 of the General Laws, payable within 20 years from their
dates; and, further, that the Selectmen are authorized, in the name
and behalf of the Town, to enter into all such contracts and arrange-
ments as they may see fit in connection with such construction.
ARTICLE 36. To see if the Town will vote to authorize and direct the Selectmen
until otherwise directed by Town Meeting action, to maintain and supervise the form-
er Town Infirmary buildings on Dale Street as a facility for the space needs of any
department of the Town Government requesting and requiring the same, provided that
the needs are demonstrated and the space is suitable; and further to authorize the
Selectmen to make such contracts and arrangements relative to the care and main-
tenance of the said property as they may see fit; and to raise and appropriate the
sum of $1,200 for the purposes of this article.

ARTICLE 37. To see if the Town will vote to authorize and direct the Selectmen
to make such contracts and arrangements as they may see fit to demolish all of the
buildings constituting that part of the former Town Infirmary situated on the north-
erly side of Dale Street, excepting the storage shed standing at the extreme easter-
ly end of the property; to grade and seed the site; and to demolish the two hen-
coops situated on the south side of Dale Street and grade and seed the site if re-
quired. And further to see if the Town will vote to raise and appropriate the sum
of $2,000 for the purposes of this article.

ARTICLE 38. To see if the Town will vote to authorized the Selectmen to sell
and convey~ for such price as they may determine to be reasonable, all or any part

the name and behalf of the Town~ such deed or deeds as may be necessary in connec-
tion with such sale or sales.

Chickering Road to Parker Street and from Farker Street to the Kittredge School
driveway, approximately 200 lineal feet.

ty line of the North Andover Housing Authority on First Street to the intersection
of First Street and Maple Avenue and then along Maple Avenue to property line of the

be transferred from the unexpended balance of Articles 1, 4~ 5 - 1962

hydrant branches and raising manhole frames and covers on streets that are being
reconstructed.

ARTICLE 69. To see if the Town will vote to raise and appropriate the sum of

such extensions not having been petitioned for at this meeting.

ARTICLE ?0. To see if the Town will vote to raise and appropriate the sum of
$300~OOO, to be expended under the direction of the Board of Public works for the
purpose of developing the well field site at the Lawrence Airport with all necessary
equipment and connecting it with the existing 12 inch water main on Holt Road, and
to authorize said Board to acquire all necessary land and easements by gift, by
purchase or by right of eminent domain~ and to determine whether said appropriation
should be raised by taxation~ by a transfer from available funds~ by borrowing~ or
by any combination of the foregoing.
Petition of the Board of Public Works.
IT is recommended that the Town vote~ subject to the provision
hereafter set out, to appropriate SBO0,O00~ to be expended under
the direction of the Board of Public Works, to develop a well field

at or near the Lawrence Airport site, for wells, pumping station
equipment and for laying water mains of not less than six inches
but less than sixteen inches in diameter to connect such well field
with the Holt Road water main, and to acquire~ by any means~ includ-
ing the exercise of the. power of eminent domain, all lands and ease-
ments necessary thereto; and the Treasurer is hereby authorized~ with
the prior approval of the Selectmen, to borrow said sum~ issuing bonds
or notes of the Town therefor, which shall be payable within 15 years
from their dates, all in accordance with the governing provisions of
law; and said Board is hereby authorized to act in behalf of the Town
in obtaining matching or contributory funds, applicable to the costs
of said development, under the provisions of the Housing and Urban
Development Act of 1965, or any other governing statute or regulation,
from the United States or any of its agencies, any such grant to be
applied to the costs of said development~ and the amount of the borrow-
ing above authorized to be reduced correspondingly.
ARTICLE 71. To see if the Town will vote to raise and appropriate the sum of
$19,500, to be expended under the direction of the Board of Public Works for the
purpose of purchasing the following equipment: one dump truck - $4,500, a 1959 GMC
to be traded; one pick-up truck - $2,100, one business sedan - $2,300, a 1961 Ford
sedan to be traded; one Aerifier - $1,000; one small tractor with loader - $5,000,
a 1959 Ford tractor to be traded; one Trailer Model Sewer Roder - $4,600 and deter-
mine whether said appropriation shall be met by taxation~ by transfer from avail-
able funds, by a proper municipal borrowing or by any combination of these sources
of funds.

It is recommended that the Town vote to ADOPT the article and that
the sum of $9,900.00 be raised and appropriated for the purchase of
the following pieces of equipment: one dump truck $4,500.00~ one pick-

ARTICLE 72. To see if the Town will vote to adope the following By-Law:
HISTORIC DISTRICTS BY-LAW
Section 1. There is hereby established the Historic District Contain-
ing the following streets:
Andover Street from Wood Lane to Johnson Street; Osgood Street from
Andover Street to Academy Road; Acedemy Road in its entirety; Johnson
Street, from Andover Street to Milk Street; Salem Street, from Johnson
Street to Milk Street; Milk Streets from Salem Street to Johnson Street)
Stevens Street; from Salem Street to 3ohnson Street and Oak Avenue in
its entirety.
Included within said District shall be all of the lands on either side
of the streets above named to the rear boundary lot line of each parcel
pr for five hundred (500) feet from the line of the street, whichever
may be the lesser distance; provided, however~ that no parcels of land
lying to the west of Osgood Street between Massachusetts Avenue and
Academy Road shall be included in said District.
Also included within said District shall be the following specific
parcels of property:
(a) a parcel of land at the corner of Wood Lane and Andover Street

Section 2. Said District shall be known as the Old Center Historic
District.
Section 3. There is hereby established an Historic District Commission,
consisting of five members to be appointed by the selectmen7 as provided
by law.

ARTICLE 73. To see if the Town will vote to amend Section 4.73 of the Zoning

unit shall be the larger of 3,500 sq. ft. or 1/6 of the minimum lot
area required for a single family dwelling or, if sewage is not ~vail-
able, equal to the minimum lot area required for a single family dwell-
ing.
(j) The maximum average of bedrooms per dwelling unit in an apartment
complex (garden apartments) shall be two.
