HomeMy WebLinkAbout1988-03-31The North Andover Planning Board held a requiar meeting on Thursday evening, March 31, t988 in the Town Hall, Selectmen's Meeting Room. The meeting was called to order by George Perna, Vice-Chairman, at ?:5? p.m. Also present were John Simons, Clerk and Erich Nitzsche. Absent were Paul Hedstrom, Chairman and John Burke. Public Hearin~ Digital Site Plan Review John Simons read the legal notice to open the public hearing. Perna tabled any discussion due to the lack of a quorum. SECOND: Erich Nitzsche VOTE: Unanimous of those present Discussions Rea Street - Preliminarw__~.s John Simons read a letter from Ralph Joyce. Applicant is asking for an extension from the Board. John Simons stated that there was lmck of information and does not meet minimum ~iling. Erich Nitzsche asked planner to get an official letter of extension. George Perna wanted more information for the next meeting. Woodchuck Hill (PRD) "Common on the Hill" Ben Osgood presented the Board with the plans. The design is by Matarazzo Design Inc. Progosed are 61 units. The main roadway to be S6 feet to 2A feet loop to 2~ foot to 18 foot driveways. Applicant is proposing a gazaboo in a common area. George Perna questioned the count on the dwellings. Mr. Osgood stated that there would be i1 triplexes, 10 duplexes and 9 singles. George Perna was concerned with the number of units. Mr. Osgood stated that he has submitted two subdivision plans. CBA is in excess of 75~. Scott Stocking, Town Planner said he spoke to Stephen Stapinski and that no grade would be more than 8~ on the roadway. John Simons liked the natural state rather than formersubmission of a standard subdivision plan. He questioned the location of the sewer. Mr. Osgood stated that half the cost of the sewer would be paid along with adjacent developers. Erich Nitzsche cited safety issues possibly guard rails and wider shoulder areas. Mr. Osgood stated that he would be filing a final set of plans in about two months. Lindenwood - Deferred to the meeting of April !~ 1988. School Site - Town Farm No one present to discuss. To be placed on the agenda for April 14~ 1988. Decisions Site Plan Review - Town Warrant Article To be placed on the April ?, 1988 meeting. Lonq Pasture - Definitive Subdivision MOTION: By Erich Nitzsche to approve subject to conditions NO SECOND. Erich Nitzsche had concerns that the development will be built as plans indicate. He drafted conditions as well as the Town Planner, Scott Stocking. Erich Nitzsche went over conditions 1, 8 and 3 of his draft. Condition ~4 was the same as Condition ~i3 of the Town Planner's draft decision. Erich Condition ~5 was minor and housekeeping. Condition the house was too close to Forest Street. Condition #? of Erich's draft the driveway is not an issue. Erich's Condition ~8 same as Town Planner's Condition #1. Conditions ~9 and ~i0 are addressing drainage easement. Conditions #11, #1~ and #13 were addressed in the draft decision of the ]own Planner. Paul Polinski and Carl Schone, abutters~ were present and expressed their concerns regarding the design of the drainage facilities. John Simons wanted changes made in the draft decisions. The number 1 concern was the length of the cul-Oe-sac, reducing it to 500', short of the wetlands. Phil Christiansen cited the cul-de-sac length being 500~ with respect to R-~ ~ ~ 3, and q Districts, stating that in an R-4 Zoning District you could nave possibly 15 two family homes and then there would be a safety issue with the 500~ cul-de-sac. John Simons wanted the following the fo!lowing added: 1. Alternative development on Lots q~ 5 & 6 due to deep slopes. 2. Boi]erplate conditions on tree cutting. 3. Bond money for trees 4. Cutting shade trees on public way - citing Chapter 87 Section 3. Island in cul-de-sac. Bill Hmurciak, DPW, against islands, plowing efficiency, and safety issues· Portion of land open for 3 years (1 lot) for a park site, citing Chapter Al. Suggested Lot 11. Waterline easement to Turtle Lane needed signing prior to the Board taking action. Phase development scheOuling. Roadway reduced to 22~ not 26' - minor road. (To be kept at 26') MOTION: By Erich Nitzsche to grant a waiver on the length of the cul-de-sac. SECOND: John Simons for purposes of discussion. John Simons said that he is not infavor of granting the waiver. Erich Nitzsche cited t~at alt members have to vote the same way in order for the motion to pass, either all for or all against, otherwise the applicant can go to the Town Clerk and file the plans. Phil Christiansen stated that all concerns of the Planning Board were addressed. After a lengthy discussion the following items to be added to decision: length of cul-de-sac to 500~ road lay-out needs improvement to lessen the cut in the hill reconfiguring of Lots 4, 5, and 6. Phill Christiansen spoke to the Board saying that they could not vote on the plans before them by changing the length of the cul-de-sac. The drainage calculations would not be the same. Erich Nizsche agreed. Mr. Christ]anser felt that the Rule and Regulations were followed by the plans before them. Scott Stocking, Town Planner, reirriated the conditions John Simons wanted included: cul-de-sac length ~o 500' due to topography standard language for tree cutting and bond money for street trees, Chapter 89, Section 3, shade trees in right----of-way. Lot 11 as a possible park site per Chapter Water easement from Turtle Lane to this subdivision be supplied prior to signing by the Planning Board. Phase develooment plan for the subdivision. All other conditions John Simons wanted added were redundant due to the reduced length of the cul-de-rsac. VOTE: Erich Nitzsche infavor John Simons nay George Perna nay MOTION: By Erich Nitzsche to reconsider the motion to grant the waiver of the length of the cul-de-sac. NO SECOND MOTION: By Erich Nitzsche to ~isapprove the subdivision SECOND: John Simons George Perna questioned if all the reasons for disapproval had to be written. Erich Nitzsche stated that as many as possible. George then asked the Town Planner to change the wording in the approval to read disapproval. The Town Planner stated that he did not have the authority to change the wording in the conditions during a vote and that the Board would have to teii him what wording they wanted. It is the Board decision, not the Town Planner's. Scott Stocking stated that if the Board wants to disapprove the subdivision they must come up with conditions in which to deny it and make them explicit in the meeting in which they vote and not just direct the planner to write some up. John Simons stated that he wou!d stay and write the disapproval. Scott Stocking stated that any conditions for disapproval would have to be stated at a public hearing and read into the record. MOTION: By Erich Nitzsche to table the decision on Long Pasture for the time being and discuss the School Site since the School Building Committee was present. SECOND: John Simons VOTE: Unanimous of those present. Discussion School Site - Town ~arm Mr. William Brusch, chairman of the School Building Committee were present and spoke to the Board. Mr B?usch cited all the Town Board and Departments the committee has been before as well as those they will be going before. The committee was asking for an opinion on the planning prospective only of the site cf Town Farm's two possible parcels. The School Building Committee will be presenting their proposal to the Annual Town Meeting in May. Mr. Kevin Shaheen was also present and spoke to the Board describing the two parcels and stating that town sewer and water were perferred. Required are two means of egress in case of an emergency and one access is not possible. Because of the developments in Town it takes approximately 45 to 55 minutes to bus students to school at the Dresent time. This effect about one third of the Town. Fifteen ~tcres are required for building a school. Parcel A is a cleared parcel. Parcel B is forest. Dale Street is the most likely place for two accesses. George Perna stated that the growth of the Town was directed in the area of Route llq and wanted to know why they selected the Town Farm location. Mr Shaheen stated that there were six possible areas in the Town to accomodiate a school. Some of the owners of these parcels did not want to ~ell. Mr. Brusch stated that Conservation Commission did not favor the Town Farm for the site. Of the two parcels, John Simons felt that Parcel'B was not accessabte and that Parcel A was the better of the two parcels. George Perna and Erich Nitzsche both felt that what ever parcel was chosen, that the balance of the Town Farm would be accessible. Erich Nitzsche preferred Parcel A. George Perna agreed citing that the road would be straight if Parcel A was chosen. Mr. Shaheen stated that there would be 24 class rooms enclosed, not open space, for approximately 550 students, two class rooms bigger than the Franklin School. The concensus of the Board if given the option of choosing a site, the Town Farm would not be the choice, but given the two choices of the parcels, Parcel A would be the better site. MOTION: By John Simons to recess until 12 a.m. SECOND: Erich Nitzsche VOTE: Unanimous of those present. The Planning Board recessed at 11:10 p.m. The Planning Board reconveined at 12:20 a.m. Vice-Chairman, George Perna reconveined the Planning Board Meeting at 12:20 a.m. Decision Lonq Pasture George Perna stated that during the recess he discussed the concerns that he had with the engineer. The extensive water on the property was his major concern and he felt that the Board should address the issue. The hydrologic connection with the ponds was made clearer by the engineer. The applicant stated that there would be a pipe above grade, not disturbing below grade and that he would change that for the entire length of the driveway. Lot ~11 would be retained for three years with no construction on it or cutting other' than that which is necessary~ for the roadway. George Perna asked the Board members to reconside)-'~the disapproval. ~ MOTION: By Erich Nitzsche to grant the waiver on the tengtO'o~th~ cul-de-sac. SECOND: John Simons for purposes of discussion VOTE: Erich Nitzsche voted infavor John Simons voted nay George Perna voted infavor George Perna stated that the conditions that were read earlier with the addition of the following, which Scott Stocking, Town Planner, read into the record which are: Lot 11 sh~ll not be built on for a period of three (3) years upon the application of the binder coat to the roadway. The Board further specifies that after the three (3) year period contained in this condition; should Lot 11 not perform as specified in the drainage calculations and related site improvements as submitted with ti~is application, the owner shall not place a structure on Lot 11. On Condition ~3 add - To ensure no storm run-off flows onto Forest Street from the subdivision and further the ditches will be constructed so as to flow into the drainage easements on both sides. Lot ~8 driveway - a detailed drainage section shall be submitted for the driveway Lot 8 which shall be designed to allow water to flow from Lot 9 into the drainage easements contained in Lots ? and 8, prior to ,-elease of Lot 8. Covenant goes with Lot 8. Prior to the release of Lot 8 the developer will provide sample oeed to the Planning Board to ensure that future home owner of Lot ~ must maintain the driveway in the same way, shape, manner and same construction. MOTION: Erich Nitzsche to approve the Subdivision Long Pasture for the conditions in the draft approval and as amended. SECOND: John Simons VOTE: Unanimous of those present. George Perna voted infavor John Simons voted in the affirmative only to make it a unanimous vote.
