N(YrE.--In concluding this report the Auditor's desire to call the attention of the town to the unsafe conditibn of valuable papers and books in the office at the Almshouse, as the old safe, in which they are kept, cannot be locked, which leaves them almost entirely unprotected from fire or burglars. The new safe being at the Town House, is comparatively useless, as the Select- men need their books and papers at the office where they meet. A change of some kind seems desirable and necessary. To the Board of Select.men: GrN~EMr. N :---The committee appointed to settle the irregu- larities of Andrew Smith, late Town Treasurer, so far as the town is financially affected, are prepared to report. That they have carefully examined the transactions of said Smith, and have consulted,eminent legal authorities upon the peculiar phases of the case. The advice of Counsel warrants the committee in making the following decision. ~UDITORS~ REPORT. The claims of Mrs. Sarah F. Abbott, Mrs. Lucy Prescott and Miss Mary Prescott, are pronounced good, becanse, although the notes which these person~ hold, have been entered as paid upon the town books, it is a fact that they never have been paid. The town have, (as is shown by the Treasurer's books), received the money, and the Selectmen originally knew of~ and approved of the hiring of the funds of these individuals, hence the town is still legally held for the payment of these debts. The committee also decide that the claim of Mr. Daniel F. Gardner is good for the amount of $1,600, (Sixteen hundred · dollars,) as this sum was, on Hatch 15th, 1877, hired by the town of Mr. Gardner, and was with the knowledge of the Selectmen so hired, this loan was also properly entered upon the town books, and although at another 'time this sam was, by the books said to be paid, it was a fraudulent entry. The bal- ance of Mr. Gardner's note is not a lawful claim against the town for reasons hereafter given. In the matter of Mr. Henry Kenistoa, the committee con- clude that the amount of $1,700, (seventeen hundred dollars), is v. alid loc the reason that apart of the above sum (1,000,) was hired wi'th the knowledge and consent of the Selectmen, was properly entered upon the towns books, and has never been paid, though Smith falsely represented it as paid upon the town books. The balance ($700) the committee allow, because they are satisfied that this sum was f~lsely endorsed by Smith upon a valid note of Mr. Kcniston. STONE;) To the Selectmen of ~Vorth .dndover : The committee on the defaulcation of Andrew Smith, late town treasurer, make this additional report covering matters not ascertained at the time of their former report or not fully discussed therein. 1st--It appears that only two of Smith's official bonds, as Treasurer, are in existence, viz. those for the years 1878 and 1879, all the others were given up to Smith by the Selectmen from time to time after the expiration of the year i'or which they were seve~lly given~ and without doubt have been de- stroyed. There is no record showing who were sureties on the AUDITORS' REPORT. 41 missing bonds, but it could probably be shown that George L. Davis was one of the sureties on all of them; and that Ebon Sutton, John A. Wiley, Theron Johnson and Hoses T. Stevens, were severally co-sureties with ~r. Davis on some of them. We have been unable to obtain certain information as to the sureties on any particular one of the missing bonds, save that for the year 1869, George L. Davis and Ebon Sutton were the sureties. On the two bonds in existence, ~/Iessrs. Davis and Johnson were sureties for 1878, and ]~[essrs. Davis and Stevens for 1879. All these bonds were, without doubt, in the same form as the annexed copy, and the signers liability is joint and not several, which fact adds materially to the difficulty of the situation. Stevens, of said North Andover, as sureties, are belden and stand firmly bound and obliged unto the said town of North Andover, in the full and just sum of fifteen thousand dollars, to be paid unto the said town, to which payment will and truly to be made, we bind ourselves, our heirs, executors and administrators, firmly by these presents. The condition of this obligation is such, that whereas, said Andrew Smith has been chosen Treasurer and Collector of taxes, for said town of North Aadovcr, for the current year, and has accepted said offices and been duly sworn to the faithful discharge o£ the duties thereof, respectively. Smith has concealed or destroyed all the checks which he drew against his bank account as treasurer, and all papers and vouchers, save those relating to his last year of service. The only written evidence of his financial transactions we have thus far found is contained in ~;he Treasurer's Cash Book, which covers all the years of his service. The books of the Bay State National Bank, where the town's money was depos- ited, do not show in whose favor the cheeks were drawn, or to who,n they were paid, but simply the date and amount of each payment. Smith declares that he is unable to tell what sums he has wrongfully taken, or when he took them, and has no means of fixing the a~nounts or dates, lie borrowed considerable sums of money ko~n iedi¥iduals, and had many dealings with private banking houses on his private account. All payroents made by him on these accounts were in bank bills, and we are unable to ascertain to what extent he used the town's money for that purpose. 3d. The payments entered on the Treasurer's Casi~ Book appears to be correct, with certain exceptions, namely: A. Certain entries purporting to represent payments of cer- tain notes and parts of notes, which payments were never made. B. Certain entries purporting to represent payments for interest on notes. We and instances where the amounts paid by Smith as interest on what he claimed ~o be town notes, were in excess of the amounts entered by hi~n on the Cash book. The reason for discrepancies of this class must be obvious to all familiar with the case. 4th. The committee have called upon the gentlemen known to be sureties on Smith's bonds to pay iuto the town treasury the amount stolen by their principal, without waiting for the town to resort to legal proceedings, but they all decline to pay any sum whatever, until their legal liability therefor has been determined. 5th. The committee have laid a full statement of the facts in the ease before eminent counsel and have been advised as follows: AUDITORS' I~EPORT. 4S It would be necessary for the town to prove'who signed each bond on which suit should be brought, for the bonds being in joint form, the signers on each bond must be sued jointly. one surety can be proceeded against separately, therefore, · Davis, though one of the two sureties on all the bonds cannot be sued separately for one half of the deficit. The custom of returning the bonds to Smith, at the expiration of a year or two from their dates, was wrong. These bonds were valid for twenty years from their date, and were valuable property of the town. They should have been carefully preserved until lapse of time made them worthless. Suit could be brought on the lost bonds, but the making and signing of the bond would have to be strickly proven, as would also a loss or defalcation during the time covered by the bond. Investments and purchases of stock by Sm,ith in any particular year do not prove a breach of the bond for that year. It would have to be shown that the money so used was the town's mouey. Nor do the false entries of payments of, or on notes prove a breach, for no money was actually paid so far as is known, and these entries were simply a part of Smith's system of fraud. Counsel say: In a suit at ]aw to recover of Smith's bondsmen any sum. or sums, it would devolve upon the town to show at what particu- lar time such sums were abstracted by Smith. The basis for a suit must be that particular bond wt~ich protected the treasury at time the peculation took place. No set of sureties will be made to pay for a loss which may possibly have taken place before or after the period for which they bound themselves to indemnify the town. Hence it is necessary to fix the date of the abstraction of each and every sum. It will be understood readily~ that the obligation to fix dates of peculation is a great obstacle in the way of the town's remedy. Difiqcult under nearly all circumstances, it is peculiarly so in this case where checks and othe.r papers have bben destroyed. Smith's custom of drawing cash from the bank in considerable sums to keep by him~ and mingling the same with his own and with borrowed money in utter confimion~ makes it well nigh impossible to trace the town's money after it came into his hands. 44 AUDITORS~ REPORT. Such recommittal was occasioned by'the desire of the School Committee to have certain changes made as to the financial showing of their department, and to make a slight, addition to the Report which was unintentionally omitted by the Audi- tots when the Report was printed. Although the vote of the Town was, in fact, an instruction to the Auditors to reprint the whole Report in its revised form, yet the Auditors were of the opinion that all alleged defects could be cured by adding a Supplement to the Report presented last year, thereby saving the Town more .than one hundred dol- lars expense, and have the Report equally acceptable. The Engineers appointed by the Selectmen report the fire apparatus in good order, and the houses in good repair. It has been the aim of the Engineers to keep everything in good repair, and fit for service at any time. They would recommend that the Hose Carriage be sold, as they have had no use for it /'or several years. There has been one reservoir built the year, (No. 7), at thc corner of Union and Maxblehead streets, at a cost of $522.93, and is filled with a good supply of water. Second fire was on Saturday, Dec. 24, 1881: building owned by Wm. G, Holden, on Middlesex street, used as a broom factory; loss, including tools, $550; insured for $350; cause of fire unknown. Norz.--As a conclusion to this report the At~dltors would make commendatory meutlon of ~bc action of the Selectmen ia h~viag a vault built at thc Town Farm for the safe keeping of ail the valuable papers and books belot~gtng to the Town, and if any one should feel disposed to criticise the items of expense incurred in its constructio% we would respectfully sugges~ that tl?y visit the Town Farm and examine the very valuable acquisition to the Town property, when, we think, they will fully justify the Selectmen for the i.m~rovements made. The Auditors would also make special mention of the new methods adopted by the Town Treasurer in the payment of bills, as being a great advancement to the safety of our Town in financial matters.
