CONVEYANCE OF DRAINAGE, UTILITY
AND ACCESS EASEMENTS
North Andover Land Corporation, of 33 Walker Road, North Andover, Essex County,
Massachusetts 01845, for good and sufficient consideration of less than $100.00, hereby grants,
transfers and delivers unto the Town of North Andover, a municipal corporation in Essex County,
the following:
A. The perpetual rights and easements to construct,inspect,repair,remove,replace, operate and
forever maintain(1) a sanitary sewer or sewers with any manholes,pipes, conduits and other
appurtenances, (2)pipes, conduits and their appurtenances for the conveyance of water, and
(3) a covered surface and ground water drain or drains with any manholes, pipes, conduits
and their appurtenances, and to do all other acts incidental to the foregoing, including the
right to pass along and over the land for the aforesaid purposes, in,through, and under the
whole of Thistle Road, Nutmeg Lane and Periwinkle Way, as shown on a plan, recorded
herewith, entitled "Abbott Village Estates North Andover, Massachusetts", by Hayes
Engineering, Inc., dated October October 23, 1987 as revised through August 11, 1995
(the "Plan"); reference to said Plan is made and said Plan is incorporated herein by
reference for a complete and detailed description of said roads. t3�
B. The perpetual rights and easements to use for drainage, utilities, maintenance thereof and
access thereto as aforesaid in,through and under the following parcels of land as shown on
said aforementioned Plan in said Town of North Andover and bounded and described as
follows:
"20' Wide Sewer Easement", shown on a portion of Lot 4 and portions of land of Michael
J. &Karen M. Quinn,David J. and Helaine M.Penney and Abbott Street Trust on Plan Sheet
1 of 4 on said Plan;

"Access,Utility&Drain Easement", shown on portions of Lots 41, 42 and 43 on Plan Sheet
3 of 4 on said Plan;
"Access &Utility Easement", shown on portions of Lots 28 and 29 on Plan Sheet 4 of 4 on
said Plan;
"30' Wide Drain Easement",shown on a portion of Lot 31 on Plan Sheet 4 of 4 on said Plan;
and
"30' Wide Drain Easement", shown on portions of Lots 36 and 37 on Plan Sheet 4 of 4 on
said Plan.
The grantor warrants that the aforesaid easements are free and clear of all liens or
encumbrances, that he (it) has good title to transfer the same, and that he will defend the same
against claims of all persons:
For grantor's title see deed from Benjamin C. Osgood, Jr., dated April 28, 1995, recorded
in Essex County North District Registry of Deeds, Book 4248, Page 164.
This is not a homestead property.
And Aurele Cormier, Alvin J. Maillet and Paul St. Hilaire, as tenants-in-common, the
present holders of a mortgage on the above-described land,which mortgage is dated April 28, 1995
and recorded in said Deeds, Book 4248, Page 161, for consideration paid,hereby release unto the
Town forever from the operation of said mortgages,the rights and easements herein above granted
and assents thereto.
