Re: Application for a Special Permit for construction within the
Watershed Protection District
Dear Mr. King,
In reviewing your application for a special permit I have
found several items missing. These items must be submitted to
the Planning Office by noon on Tuesday, October 19 in order for
the Board to proceed with the public hearing scheduled for that
night.
As your proposed construction is within 100 feet of a
wetland resource area it falls within the Non-Disturbance Zone of
the Watershed Protection District. Expansion of an existing
structure by less than fifty percent of the gross floor area of
the existing structure is allowed by a Special Permit from the
Planning Board.
As part of your application, a written certification by a
Registered Professional Engineer, or other scientist educated in
and possessing extensive experience in the science of hydrology
and hydrogeology, must be submitted certifying that the proposed
use in conjunction with other uses nearby, will not cause any
significant degradation of the quality or quantity of water in or
entering Lake Cochichewick.
You must also show that there is no reasonable alternative
location outside the Non-Disturbance and Non-Discharge Zones, for
any discharge, structure or activity, associated with the
proposed use to occur. Evidence must also be submitted that all
on-site operations including, but not limited to, construction,
fertilizer applications will not create concentrations of
Nitrogen in groundwater, greater that the federal limit of 10
mg/Liter at the downgradient property boundary.
These requirements are set forth in the Town of North
Andover Zoning Bylaw Section 4. 136 (5) , (6) and (7) . If you have

Re: Watershed Special Permit
Planning Board Meeting 10/19/93
Dear Mr. King,
Thank you for appearing before the Planning Board last week
to discuss your proposal for an addition to your house. The
Planning Board and Staff had several concerns due to the close
proximity of the proposed addition to a Watershed wetland.
The Board directed you to either come back to the Board with
the addition placed outside the 100 ' non-disturbance zone of the
Watershed wetland or apply to the Zoning Board of Appeals for a
variance for construction within the non-disturbance zone.
The Board voted to keep the public hearing open and will
continue discussion of this proposal at its November 2 , 1993
meeting. I would also like to remind you of the restriction on
the use of fertilizers and pesticides that should be in your
deed.

Lexington, MA 02173 DECISION
The Board of Appeals held a public hearing on Tuesday, April 14 ,
1992 upon the application of Lexington Savings Bank requesting a
variance from the requirement of Section 4 . 136 and Table 2B of
the Zoning Bylaw so as to permit relief to construct a building
no closer than 801 to the wetlands and to grade no closer than
251 to the wetlands; to provide drainage from driveway, roof,
gutters and subdrain that will be filtered into the ground rather
than directly into the wetlands. The following members were
present and voting: Frank Serio, Jr. , Chairman, William
Sullivan, Vice-Chairman, Walter Soule, Clerk, and Anna O'Connor.
The hearing was advertised in the North Andover Citizen on April
1 and April 8 , 1992 and all abutters were notified by regular
mail.
Upon a motion by Mr. Sullivan and second by Mrs. O'Connor the
Board voted unanimously to GRANT the variance as requested.
The Board finds that the granting of this variance will not
adversely affect the neighborhood or derogate from the intent and
purpose of the Zoning Bylaw.
