Neve , P.E. 447 Old Boston Road Topsfield, MA 01983 RE : Review Comments - Abbott Village Estates Dear Tom: Thank you for your presentation to the Planning Board on November 23 , 1987 , regarding the above cited project. The Board suggested that I meet with the applicant before the project is heard on December 17th in order to resolve issues brought out during the initial public hearing . Based upon the comments received by the Planning Board, I have the following comments : Definitive Subdivision Plan 1 . Coordination with DPW regarding the design and location of the water and sewer lines . 2. Determine the status of the Watershed District on Lots 47-49 . If these lots are within the District the Board of Appeals will need to grant variances prior to construction occuring on the above lots . 3 . Redesign Periwinkle Way to provide for a 22 ' pavement section. 4 . Resolve issues regarding looping the water system. 5. Look into the possibility of the applicant improving sections of Abbott and Salem Street adjacent to this subdivision. 6 . Issues presented by NACC regarding resource areas report being done by a special consultant - action by NACC. 7 . Discuss the procedure used to allow the Town to extend Thistle Road to Woodberry Lane should the current litigation ova this contention be resolved to allow it to c____ 8 . Discuss the possibility of providing sidewalks in the subdivision. 9 . Need additional rational by the applicant for allowing a 1800 ' long cul-de-sac . This is a very long dead end roadway and the Board is very concerned over granting a waiver for a cul-de-sac this long in Town. These are: 1 . What is the extent of the work proposed in the buffer zone to the bordering vegetated wetland resource areas (in approximate square feet) ? How many of the lots have houses, driveways, or grading work within 25 feet of these areas ? How many have such work within 50 feet ? What would be the impact on the house lots of a 25 foot no-cut zone ? What would be the impact of a 50 foot no-construction zone ? 2. Could the detention moved to outside of the bordering vegetated ands due to changes resource areas to prevent any damage to these in flooding frequency and sedimentation during construction ? 3. Are the discharge-elevation relations (curves) for each of the proposed wetland crossings the same for existing conditions as well as for developed conditions ? Can these curves be provided ? 4. Are the wetland replacement areas in optimal locations with regards to minimum disruption of buffer zone or uplands areas ? Are these in open or wooded areas? 5. Will any of the wetlan� d crossings re backwater effects studiede nsthehhydrolog c off-site properties How and hydraulic analyses ? 1 6. Could the wetland replacement plan be expanded in detail to recommend the number of plantings and the optimal season for revegetating these wetlands ? 7. Can a construction sequence or schedule be provided, including a schedule for likely house construction and proposed wetland replacement ? 8. Can the erosion control plan be improved for areas of steep slopes (as required by the NACC for other projects with such problem areas, e.g., Coventry Estates I, Heritage Estates ?) 9. What precautions have been taken in the design of the sewer line which crosses the wetland areas to prevent any leakage and/or other impacts .to these resource areas ? Enclosed you will find a copy of the BSC report. We would appreciate your comments or responses on each of the issues raised in this report. There may also be some additional questions which could result from our review of the Notice of Intent after we receive the additional copies we requested, and our review of the BSC report which we have just received. Since this project, will be on sewerage, my biggest concern is the wetlands, and that road and driveway crossings will not impede the areas drainage causing floods . My letter to you of October 2 was regarding that proposal. If this present modification is approved the following recommendations and requirements are applicable: 1. All fire hydrants are to be at the 500 ' interval. 2 . Lot numbers are to be posted during construction. 3 . Permanent house numbers are to be posted prior to occupancy 4. All underground fuel storage must be in compliance with No. Andover fire department requirements and no permits will be issued for lots found unsuitable by the No. Andover Conservation Commission. 5. Prior to taking occupancy the subdivisions streets shall provided an adequate access by having had at least the binder coat applied. 6. Proper street signs shall be installed at all intersections within the subdivision and with the intersection of Abbott St. 7 . As a matter of public safety I stroray recommend that a residential sprinkler system be installed in each dwelling in compliance with NFPA 13D and No. Andover Fire Department requirements. 8. Any dwelling over 500 ' from the subdivisions streets shall be required to have an additional fire hydrant installed and that dwelling must be residentially sprinklered. 9 . No open burning is permitted except as allowed during the open burning season in compliance with No. Andover Fire Dept. regulations. 10 . Hayes Engineering, Inc. 603 Salem Street Wakefield, MA. 01880 Re: Development - Abbott Street Dear Mr. Ogren: Subsequent to our meeting on September 8, 1987 and your letter dated September 14, 1987, I met with the Town Manager to discuss the issue of sewerage for the proposed development off of Abbott Street between Marbleridge Road and Rea Street. In reviewing your request we considered the following: 1. The pumping station which will ultimately service this development is located off of Bradford Street and is expected to be in service by November 1987. 2. Tie-in to this pumping station will be by gravity sewer in Abbott Street. 3. There is 'a proposed Abbott Village Development which is expected to build this gravity sewer to the intersection of Abbott Street and Rea Street within the next 2-3 years. 3. The Town does not wish to maintain any additional pumping station where gravity sewer will ultimately be built. Based on this, it is our intention to allow you to build a temporary private pumping station connecting to the sewer in Marbleridge Road near Woodberry Lane. This station need not be built to Town standards since it will be temporary. Submersible pumps will be allowed and standby power generation will be required. Page 2 Re: Development - Abbott Street The gravity line to Abbott Street and Rea Street must be built and a bond posted to insure tie-in. A private company must be designated to maintain the pumping station and gravity sewers until such time as the connection is completed. A homeowner's association cannot be held responsible for this maintenance. A legal agreement should be prepared so that the responsibilities for the sewer system are clearly understood. Periwinkle Way is approximately 250 ' long. Propose a 50 ' right-of-way with a 22 ' wide pavement section (minor street) . The turnaround would have a 150 ' right-of-way with a 26 ' pavement section and include an island in the middle, according to your specifications . 2 . Nutmeg Lane connect Abbott Street to Salem Street. Propose 50 ' right-of-way with a 22 ' wide pavement section (minor street) . One side of the street would contain a sidewalk. The goal of this design is to provide pedestrians access to Salem Street, reduce site disruption and reduce the roadways desirability as a cut through from Salem Street to Johnson Street and Route 114 , by reducing traffic speed. 3 . Thistle Road is approximately 1800 ' long. Proposed a 50 ' right-of way with a 26 ' wide pavement section (secondary street) . One side of the street would contain a sidewalk. As you know the issue of connecting this roadway with Woodberry Lane is under litigation. Town Departments are on record in support of this connection for emergency access, traffic circulation and to allow utility extensions to provide a looped system. 4 . Suggested street improvements on Abbott Street. Suggest we widen portions of Abbott Street, improve sight distances at Thistle Road, Nutmeg Lane at Abbott Street and Nutmeg Lane at Salem Street. Also suggest straighten out the Abbott and Salem Street intersection to provide a 901 access point. The water main on Nutmeg Lane shall be 8" pipe installed 10' left of the centerline of the road. An 8" x 8" tapping sleeve and valve shall be installed at the existing water main on Abbott Street. A 12" x 8" tapping sleeve and valve shall be installed at the existing water main on Salem St. Eight inch gate valves shall be installed at station 6 + 50, 12 + 80 and 13 + 0. Hydrants shall be installed at station 4 + 20, 7 + 80, 12 + 10, and 15 + 80. 2. The water main on Periwinkle Way shall be 8" pipe installed 10' right of the centerline of the road. An 8" gate valve shall be installed at station 0 + 0. A hydrant shall be installed at station 2 + 80. 3. The water main on Thistle Road shall be 8" pipe installed 10' right of the centerline of the road. An 8" x 8" tapping sleeve and valve shall be installed at the existing water main on Abbott Street. Eight inch gate valves shall be installed at station 9 + 25 and 18 + 40. Hydrants shall be installed at station 0 + 0, 4 + 75, 9 + 0,13 + 70 and 18 + 35. The water main shall be extended from the proposed cul-de-sac of Thistle Rd. to the existing water main at the end of Woodberry Lane. 4. All hydrants shall be Eddy breakflange hydrants to North Andover specifications. 5. All water mains shall be class 52 ductile iron cement lined water pipe installed with 5 feet of cover below the finish grade. 6. All hydrant branches shall be provided with six inch Mueller or equal gate valves (open left. ) i Page 2 Abbott Village 7. All gate valves shall comply with AWWA specifications L500 52T and will be supplied with a 100 lb. sliding type gate box marked "WATER". 8. All water mains shall pass leakage and pressure tests performed in accordance with section 13 of the AWWA Standard C600 and shall be chlorinated in accordance with AWWA C601"Standard Procedure for Disinfection of Water Mains. " 9. The proposed sewer within the subdivision is not acceptable as designed. The placement of sewers in easements between Nutmeg Lane and Thistle Road, and to the rear of the Abbott Street lots is unnecessary, since the alternative of installing sewers in Abbott St. and the proposed subdivision roads is viable, and, in fact, is partially designed in the original definitive sub- division plan. Therefore, the sewer to service Thistle Road shall run entirely in Thistle Road and Abbott St. The cross-country sewer from Abbott St. toward Nutmeg Lane should run along Lot 33 and Lot 22 to Nutmeg Lane or along Lot 33, Lot 22 and Lot 21 to Periwinkle Way in order to eliminate the 19 foot "cut" in the sewer as it is currently designed. The remaining lots should be serviced from a sewer in Nutmeg Lane. The sewer to service Lot 6, 7, and 8 may be installed as shown, or with individual services, if possible, without adversely impacting the existing wetlands. 10. The sewer on Abbott St. shall be 12" pipe from North Cross Road to the proposed easement and 8" pipe from the easement to Thistle Road installed approximately in the center of the existing roadway at a depth sufficient to provide service to the existing dwellings on the south side of the street. Six inch PVC service connections shall be provided to all existing houses abutting the sewer. 11. The sewer main on all the streets and easements within the subdivision shall be 8" pipe. 12. The sewer main on Thistle Road should be extended from station 17 + 50, to the centerline of the existing Woodberry Lane. 13. A plan and profile shall be provided for all redesigned or extended sewers. 14. A plan and profile shall be provided for the sewer extension from the low point of the existing sewer in North Cross Road to the South Bradford St. pumping station. 15. A plan showing the proposed design of sewer services shall be provided for lots 37, 38, 44 and 54. 16. Precast manholes shall conform to ASTM designation C478 and shall meet the following additional requirements, the wall thickness shall be not less than 5 inches, section shall have tongue and groove joints with an approved bitumastic gasket. Pipe connections shall be of the rubber boot with stainless steel band or approved equal. Manhole frames and covers shall be cast iron lettered "SEWER" and shall be eight inches high. 17. All sewers must pass low pressure air tests with a maximum allowable leakage rate of 0.0015 cubic feet per minute per square foot of internal pipe surface. 18. Adequate public liability and property damage insurance as well as a street opening bond in an amount satisfactory to the Highway Surveyor must be provided for the work on Abbott Street. More specifically, we feel that the two existing culverts which pass under Abbott Street east of Easy St. and a third culvert on Abbott Street approximately 200 feet west of proposed Thistle Road should be upgraded to a size capable of accepting subdivision run-off without causing flooding. Additionally, the run-off from the proposed catch basins at the intersection of Abbott Street and Thistle Road should be piped in a westerly direction along Abbott Street to the existing brook. The proposed drain pipe from the intersection in the opposite direction on Abbott Street should be eliminated. William Hmurciakf Date: March 22, 1988 Re: Abbott Village Modifications - Conditions of Approval We have reviewed the condition of approval for the Abbott Village Subdivision and have the following comments to make regarding the decision. 1. The problems with off site drainage have not been directly addressed in the order of conditions. We are on record as stating that the drainage as proposed is unacceptable especially in the areas which run off onto Abbott St. and to the unknown brook location towards Rea St. Condition #20 asks for computations certifying that existing off site drainage is capable of accepting subdivision run off without causing flooding. ,.Past hydrodynamic events have already proven that serious flooding exits because of the inadequacy of the off site facilities. These drainage improvements which we feel are necessary must be reviewed and approved by the Division of Public Works prior to any approvals from the Planning Board. 2. The Planning Board has shortened proposed Thistle Road from the 1800 feet shown to 1200 feet. We believe that any future extension to Woodberry Lane can best be affected by extending the proposed roadway and utilities to the boundaries of the applicants property as originally designed. 3. Periwinckle Way has been approved with a 22 foot wide pavement and a landscaped island in the cul-de-sac. Our standard roadway cross-section calls for a 26 foot wide pavement and a fully paved cul-de-sac. 4. All revisions to the sewer which we have requested must be reviewed and approved by this Department prior to the granting of any sewer extension permits. 5. Condition 419 is unacceptable. Installation of 3 gate valves at connections to existing water mains would require unnecessary interruption of service to existing consumers and is contrary to the policies of this department. (JGI)of Manchester,NH. I have also included some literature describing their firm. You will note that we have hired JGI to supervise the installation of the footings for the Con-Span bridge culvert at Abbott Village. JGI will be responsible for determining soil capability, as well as supervising the actual excavation on a day to day basis. Additionally they will monitor the installation of re-bar, form construction, and the placement of concrete. Concrete cylinders will be taken for axial compressive strength with reports being forwarded directly to your office. You have suggested that the Planning Board would like to have all of the geotech reports reviewed by an independent engineering consultant. We have no objection to this being done, and we will pay a reasonable charge for this type of peer review. If you would let me know a budget amount, we will forward payment. iii.. It would seem that your office is the more appropriate department for us to deal with on these technical issues, as opposed to that of the planning board. There are so many other construction related issues that are on going in this type of project that for us to start dealing with another board or department on construction engineering issues,can only become at best confusing. We are trying to manage this project in a very professional manner. We have employed numerous engineering and other qualified firms to oversee every aspect of the operation. Not a day goes by that there is isn't at least one if not two or three different engineering firms making their periodic job observations. We have tried to keep the Town well informed of all planned and or completed operations by written documentation on a weekly and monthly basis. Hopefully,by this diligent management the Town will in the end have the quality of work they expect. Please let me know how you would like us to proceed regarding the engineering review. NELSON, DIRECTOR MEMORANDUM TO : North Andover Planning Board FROM : North Andover Conservation Commission:/ DATE : November 30, 1989 RE : Dale Street Sewer - Performance Bond This memo is to provide the Planning Board with an update on an issue we have discussed previously. The Conservation Commission issued an Enforcement Order, stopping all work on the Dale Street Sewer line, on 8/30/89. This Enforcement Order was precipitated by a violation of 8 separate conditions of the Commission's Order of Conditions. The Commission was particularly concerned with Mr. Osgood's refusal to post a $5000.00 performance bond and his refusal to contact the Conservation Administrator before beginning work in wetlands. The Planning Board was notified of this issue on 9/6/89 and subsequently withheld $5000.00 of the performance bond under their control. The Conservation Commission greatly appreciates your cooperation in this matter. Mr. Osgood was notified on 9/21/89 that the Commission had voted not to lift the Enforcement Order and requested that the performance bond be posted with the Commission as required. Mr. Osgood was informed that once this bond was posted with the Commission, the same amount would be released by the Planning Board. Mr. Osgood did not respond. Mr. Osgood was again notified on 11/6/89 that no bond had been posted. A status report was requested and this was received on 11/14/89. In this status report Mr. Osgood admits to continuing work on the project after being notified to stop all work. The Conservation commission is now considering further action against Mr. Osgood of Dale Street Associates. The Enforcement Order still stands. Any representatives of the Planning Board, Department of Public Works or the Division of Planning and Community Development should be aware that any work of any kind on this project is a violation of the law and should be reported immediately to the Conservation Administrator.
