NELSON 0 Town Of 120 Main Street, 01845 Director NORTH ANDOVER (508) 682-6483 BUILDING CONSERVATION ,63A HUSES DIVISION OF HEALTH PLANNING PLANNING & COMMUNITY DEVELOPMENT November 15, 1993 Mr. Daniel Long, Town Clerk Town Building 120 Main Street North Andover, MA 01845 Re: Special Permit Watershed Protection District - 400 Great Pond Road Dear Mr. Long: The North Andover Planning Board held a public hearing on November 2 , 1993 , in the Senior Center behind the Town Building, upon the application of Walter Saxe, Trustee, 27 Sargent Street, Newton, MA. , requesting a Special Permit under Section 4 . 136, Paragraph 5 (a) (6) (Watershed Protection District) of the North Andover Zoning Bylaw. The legal notice was properly advertised in the North Andover Citizen on October 13 and October 20 , 1993 and all parties of interest were duly notified. The following members were present: Richard Nardella, Chairman, John Simons, Vice Chairman, Joseph Mahoney, Clerk and Richard Rowen. The petitioner was requesting a Special Permit to permit the installation of a sewage pump station, gravity sewer and force main in order to connect to the municipal sewer and to permit the construction of three parking spaces in order to facilitate emergency vehicle access to the existing house within 250 ft. of Lake Cochichewick in the Watershed Protection District. The premise is located at 400 Great Pond Road. Mr. Mahoney read the legal notice to open the public hearing. Ms. Colwell told the Board that there were no staff issues . The Town should support efforts to connect to Town sewer. Mr. Bernard Pacquin, from Dana Perkins, gave the following information to the Board: waste water pump station will be installed force main installed gravity line installed - in the same trench dual pumps, 24 hour storage Essex County Greenbelt owns property that fronts on Great Pond Road may build barn or greenhouse in the future on the site and tie it into the gravity line Page 2 : 400 Great Pond Road Mr. Walter Saxe property is an asset to the family, want to keep it up to date will need to tie-in in the future anyway with new septic system regulations Mr. Pacquin 3 car parking lot/emergency access to be constructed 35 to 40 feet away from edge of lake Ms. Colwell discussed gravel vs. paving and oil trap. Mr. Pacquin - need a vertical separation for oil trap that is not easily attainable on-site. Mr. Nardella asked why not slope away from the lake. Mr. Pacquin told him, need to slope with current driveway. Mr. Mahoney asked what happens with current tank. Mr. Pacquin told him, pumped of solids, filled. On a motion by Mr. Rowen, seconded by Mr. Mahoney, the Board voted to close the public hearing and directed staff to draft Special Permit decision to discuss at next meeting. Motion by Mr. Rowen, seconded by Mr. Mahoney, the board voted to amend the previous motion by voting to approve project with decision filed and reviewed by staff. Attached are those conditions. Sincerely, North Andover Planning Board Richard Nardella, Chairman cc: Director of Public Works Building Inspector Conservation Administrator Health Agent Assessors Police Chief Fire Chief Applicant Engineer File 400 Great Pond Road Special Permit - Watershed Protection District The Planning Board makes the following findings regarding the application of Walter Saxe, 27 Sargent Street, Newton, MA 02158 requesting a Special Permit under Section 4 . 136 , Paragraph 5 of the North Andover Zoning Bylaw to permit the installation of a sewage pump station, gravity sewer, and force main in order to connect to the municipal sewer and to permit the construction of three parking spaces in order to facilitate emergency vehicle access to the existing house. This work will be done within two- hundred fifty (250) feet of the annual high water mark of Lake Cochichewick. FINDINGS OF FACT: In accordance with Section 10. 31 of the North Andover Zoning Bylaw: 1. The Planning Board finds that the specific site is an appropriate location for the installation of a sewage pump statio, gravity sewer, and force main as the Town encourages home owners in the Watershed Protection District to tie into the municipal sewer; 2 . The installation of the sewage pump, gravity sewer, and force main as well as the construction of three additional parking spaces will not adversely affect the neighborhood; 3 . There will be no nuisance or serious hazard to vehicles or pedestrians, the addition of three parking spaces will facilitate emergency vehicle access ; 4 . Adequate and appropriate facilities are provided for the proper operation of the proposed use; 5 . The Planning Board also makes a specific finding that the use is in harmony with the general purpose and intent of the North Andover Zoning Bylaw. In accordance with Section 4 . 136 of the North Andover Zoning Bylaw the proposed construction of the addition will not cause any significant degradation of the quality of water in or entering Lake Cochichewick. Upon reaching the above findings, the Planning Board approves this Special Permit based upon the following conditions: SPECIAL CONDITIONS : 1. Prior to Construction: a. This decision must be filed with the North Essex Registry of Deeds and a copy of the recorded document submitted to the Planning Office. Included as part of this decision are the following plans: Plans entitled: Proposed Utility Plan 400 Great Pond Road in North Andover, Massachusetts Scale: 1" = 40 ' Dated: September 21, 1993 Sheets: 1 through 3 Prepared by: Dana F. Perkins, Inc. 1215 Main Street Unit 111 Tewksbury, MA 01876 Prepared for: Walter Saxe, Trustee 27 Sargent Street Newton, MA Any changes made to these plans shall be approved by the Town Planner. Any changes that the planner may deem as substantial shall require approval by the Planning Board. b. Silt fence and haybales must be placed along the limit of work as shown on the plans and reviewed by the Town Planner. 2 . No pesticides, fertilizers or chemicals shall be used in lawn care or maintenance on-site. 3 . A filter strip of natural growth of at least twenty (20) feet in width from the high water mark of Lake Cochichewick must be allowed to grow where maintained lawn currently exists. This strip will act as a filter for any material entering the lake including siltation and materials form lawn care. 4 . The applicant agrees, as a part of this approval, that in no instance shall the proposed disturbance be allowed to further impact the site than as proposed on the plan referenced in Condition 1 of this approval . 5. No open burning shall be done except as is permitted during burning season under the Fire Department regulations. 6 . The provisions of this conditional approval shall apply to and be binding upon the applicant, it ' s employees and all successors and assigns in interest or control . 7 . This permit shall be deemed to have lapsed after a two (2) year period from the date on which the Special Permit was granted unless substantial use or constr���}}ction has commenced. Therefore the permit will expire on /VOV /5 4/9p5. CC.
