Daniel Long, Town Clerk Town Office Building North Andover , MA 01845 RE : Penelope Potter Saxe - Special Permit 400 Great Pond Road, North Andover, MA Watershed District Dear Mr . Long: The North Andover Planning Board held a public 'hearing on Monday evening, October 22, 1984 in the Town Office Meeting Room upon the application of Penelope Potter Saxe. The hearing was duty advertised in the North Andover Citizen on October 4 and 11, 1984 and all abutters were notified by mail . The following members were present and voting: Michael P. Roberts , Vice Chairman; John J. James , Jr . , Clerk; John J. Burke; and Erich W. Nitzsche . The petitioner seeks a Special Permit under Section 4. 133(4 ) of the zoning bylaw which requires a Special Permit to allow construction within 250 .feet of Lake Cochichewick . The premises is known as 400 Great Pond Road, bordered on the. North by Lake Cochichewick and on the' South by Great Pond Road . The Lot is both in the Residential - 2 (R-2 ) and Watershed District . At thT hearing the applicant testified through. her representative Attorney William Tyler that a new driveway needs to be constructed to gain access to the existing house on the edge of the Lake . A portion of the construction will be within the 250 foot buffer to Lake Cochichewick . The purpose of changing the .location of the present driveway is to settle the Potter Estate . The old driveway will not connect with the proposed drive . Upon a motion made by John J. Burke, and seconded by John A. James, Jr . , the Board unanimously VOTED: TO GRANT THE SPECIAL PERMIT SUBJECT TO THE FOLLOWING: page 2 1 . Only the proposed work as shown on the plan entitled ' Proposed Driveway Grading Plan for Potter Estate' dated October 1, 1984 ( including Material Specifications ) is allowed under this permit . Any minor changes meeting the intent of said plan and determined to have lesser impact on the Lake ' s Watershed must be approved by the Planning Board prior to implementation in the field . 2. Construction will coincide with the required mitigating measures , but shall not be limited to: a. Prevent the removal of soils from the property; b. Provide temporary siltation control in the form of a silt fence and/or staked hay bales; C. Provide permanent siltation control in the form of loam and seed or bark mulch; d . Prevent the use of fertilizer on the grassed areas; e. Construct the driveway with slopes such that road salts will not be necessary; f . Forbid the storage of oil , gasoline or other fuels on the property during the construction period; g. Provide rubbish removal and sanitary facilities for the contractor and the crew during construction; f . Dispose of off-site, all removed pavement materials . 3 . Construction shall be completed no later than December 1, 1984. In granting this Special Permit , the Planning Board finds , pursuant to Section 10. 31 Conditions for Approval of Special Permits of the Zoning Bylaw, that the following conditions aye met: 1. 400 Great Pond Road is the appropriate for the construction of an access driveway the the existing single family dwelling; 2. The residential use permitted in that zoning district will not adversely affect the surrounding residential neighborhood or Watershed, since said plans and conditions minimize any impact the Lake, and is a continuation of its allowed surrounding a: residential uses; caa�y .n.0 Ln z rx U1 w W zc Any appeal shall be filed W TE within (20) days after the oc.cocr- C= = date of filing of this Notice in the Office of the Town Clerk. page 3 3. In compliance with conditional approval , there will be no nuisance or serious detrimental hazard to vehicles or pedestrians; 4. Adequate and appropriate facilities already exist on the site to service the proper and efficient operation of the proposed residential use; 5. Based on site visits , the public hearing process , and review and input lay appropriate town boards and departments , the driveway use is considered to be in harmony with the general purpose and intent of the North Andover Zoning Bylaw .
