Dear Members of the Planning Board;
This letter is to petition the Planning Board for an extension of the Watershed
Special Permit for 000 Bradford Street.
Our construction plans for the last year were delayed. As a result of the bids
that we received for our previous construction plans, we have undertaken the
process of revising our original design. This has consumed much of the last
year. We presently have our revised construction plans out for bid and expect
to have the project under contract in the near future. We request an extension
of the permit to allow the construction to proceed under the original permit.

Dear Members of the Planning Board;
This letter is to petition the Planning Board for an extension of the Watershed
Special Permit for 000 Bradford Street, granted on October 22, 1998. The
property has been in our ownership since June of 1999. During the last year
we have completed the house design and are in the process of negotiating a
contract to build the residence. We anticipate having construction underway
before the expiration of the permit on October 22, 2000 and request an
extension of the permit to allow the construction to proceed to completion.

Special Permit Extension
At a regularly scheduled meeting of the Planning Board, duly posted, and held on
_August 15, 2000 ,the North Andover Planning Board voted unanimously to
grant the extension of the Special Permit issued to_Robert Brown and then purchased by
Rex and Christiana Melton, for the construction of a single family home located on
Bradford Street dated, October 22, 1998.
This extension is granted pursuant to Massachusetts General Law, Chapter 40A,
Section 9, and will extend the above referenced Special Permit for a period of one(1)
year. This permit is now due to expire on October 22, 2001.
Signed as a sealed instrument this 16 day of August,2000.

Dear Mr. Rowen;

The following addresses the concerns of John Chessia regarding the
two foot separation between the bottom of the driveway leaching
trenches and the water table. According; to the soil flogs the water
table varied between 32 and 35 inches below the surface. The 'drainage;
trench along the driveway follows the contour of the land and is !12
inches by 12 inches. If it is assumed that the water table remains at
this depth through out the site then the separation will be between 2,U
and 23 inches. As we all know the water table usually gets deeper as we
go up hill and therefore we will exceed' the ? 2 foot separation.
We feel therefore that the trenches will provide the cleansing
desired. a

As we have previously discussed, I will allow your client, Allen Trust-
Robert A. Brown, a sewer line easement, subject to review and approval of
the easement plan and agreement, through my property located at 1445
Great Pond Road.
Any easement, agreement or work shall not be executed nor
commenced until full consideration and legal ,fees are paid.
It is my understanding that you will utilize this easement to construct a
sewer line from your existing lot on Bradford Street to an existing manhole
on Great Pond Road.

Dear Mr. Barrett:
I have reviewed your request for a minor modification to the plan for the development of 705
Bradford Street. The modified site plan dated April 10, 2002 reflects the proposed location of a
fence to be installed around the house. I hereby approve the fence location as shown on the
above referenced site plan, as it will not extend beyond the existing limit of work.
In addition to your request for approval of the fence location, you have requested to replace
approximately 180 linear feet of an approved split rail fence with posts spaced 50 feet apart.
The modification is hereby approved with the following conditions:
• The posts must be a minimum of three feet in height;
• The posts must be spaced 40 feet apart and contain protected wetland resource area
signs;
• The posts must be installed at the existing limit of clearing,not the haybale line;
• Clearing beyond the existing tree line must be reviewed and approved by the
Conservation Department;

Dear Bill,
I have received your letter with reference to above property. I am confirming my position that the change you
propose satisfies the intent of the Planning Board decision on this matter with respect to a split rail fence. It is my
opinion that the posts will provide for sufficient notice of the sensitivity of the area and that the relocation of the
fencing will in fact provide a greater separation from the wetland areas as proposed.
It is my understanding that the fence was meant to insure that no disturbance was to occur and that as a landscape
feature,would most likely be overlooked in the future as such. In the future,it is easy to conceive that a landowner
would like to remove the fence without regard to its hidden import. Posts with the proposed markings,however,
would require a conscious effort on the part of a landowner to violate an express statement regarding disturbance.
In light of this,it is reasonable to conclude that your proposal comports with the intention of the Planning Board's
original decision.
I have not been able to determine the nature of any Conservation Commission requirements that may also play out
on this site simply due to my complete lack of time to do so. I am offering this letter to provide you with my
opinion for your own protection in the future with respect to the Planning Board's decision on the site.
