Dear Mr. Rowen,
The following addresses the siting of the house can the property
and the quality and quantity of water entering Lake Cochichewick.
First T will address the siting of the house on the lot. The lot
was created prior to October 24, 1994 and therefore is subject to a 100
font Non Disturbance Zone and a 325 foot Non-Discharge Zone. Although
the lot is 5.67 acres, the configuration of the wetlands in two fingers
create: a situation where there is no land, on the lot outside the Non--
Discharge Zone of 325 feet. We feel we have sited the house to present
the minimum impact on the lot and not force it right up to the existing
neighbors. The house is completely outside the 100 foot buffer zone
except for a portion of the roof runoff underground leaching facility
in the 100 font buffer zone.. The limit of work and maneuver area has
been established by locating the hay bale/silt fence 60 feet from the
BVW. In addition a past and rail fence will be installed on the house
side of this barrier prior to its removal. This fence will act as the
limit of mowing line.
Since the entire project is 'within the Non-Discharge Zone we have
proposed x. 1000 square foot leach bed for the roof drains and a total
of approximately 520 feet of 12"x121' (1560 sq. ft. ) leaching trench
along both sides of the driveway. The final grade of the paved driveway
will pitch slightly tca each side and will shed the surface runoff to
these trenches . The leaching bed provides a factor- of safety of 2 for
the 100 year storm and the leach trench provides a factor of safety of
3. The net result of these will be a reduction in the quantity of
runoff from the site since all roof and driveway runoff will :infiltrate
into the parent, soil and therefore also not change the quality of the
runoff . A covenant will be placed in the deed concerning the types of
fertilizers which can be used on the site.

The hay bales and silt fence are shown on the plans. Because of
the shallowness of the groundwater (less than 3 feet) some fill will be
required over the root drain leach field. All disturbed area will be
loamed and seeded as soon as possible. Any soil requiring stockpiling
will be stockpiled to the south of the house and driveway.

Modifications to Stormwater Management System
Dear Mr. Barrett,
I am in receipt of your letter dated April 16, 2002. In this letter and the attached plans
you have indicated a new layout of in-ground infiltration locations. Incorporated within
the original Decision of Approval is contained a clause indicating that modifications to
the Special Permit may be reviewed by the Planner. If the Planner finds modifications to
be substantial, the applicant must return to the Planning Board.
Based upon the discussion at the original hearing, the letter and plan that you have
provided and my discussions with representatives of the Conservation Commission, I find
that no substantial change is presented. I make this'finding in accordance with the
following:
• The existing Permit layout is not possible due to the final pitch of the site—water
cannot flow uphill to the single leach bed area without some form of pump, which
will only increase the risk of failure.
• The Applicant proposes three distinct locations to accommodate different portions
of the runoff thus minimizing the impact of any failure.
• Changing from one large area to three areas reduces the point impact of any
runoff thus in essence increasing the natural functionality of the site and
minimizing chance of system failure from an intense localized use presented by
the original single leach area.
• One of the proposed locations lies outside of the buffer thus reducing the actual
impact to the buffer area and the protected resource.
• The two remaining systems, although in the buffer, represent a substantial
decrease in actual impact to the protected buffer.

• Although not directly related to the provisions of the permit — the driveway
surface area has also been reduced, therefore reducing the overall impervious
surface found on the site.
As a result of the above, I find that not only are the proposed changes not substantial, but
that they in fact enhance the intent of the bylaw and the planning board's approval and
concerns related thereto.

The existing record plan has called for a single leach bed

system. Therefore we have redesigned the system into 3
separate systems. Each has been designed to accommodate

There are environmental benefits to these changes. As you
will see on the plan, some of the system is now located

Dear Mr. Brown,
I have reviewed your application for a watershed special permit and find the following items
missing as required by Section 4.136 (4) of the Zoning Bylaw:
1) Special Permit Application: Application does not refer to the appropriate section of the
bylaw. You should be requesting a special permit under section 4.136 (3)(b) and(c) for
work within the non-disturbance zone related to the creation of a yard and drainage for the
construction of a single family home. The application should reference the fact that this lot
was created prior to October 24, 1994.
2) Plan:
a) A Registered Professional Engineer, not a Professional Land Surveyor, must prepare the
plan.
b) The Non-Disturbance and Non-Discharge Zones must be shown on the plan and labeled
as such. The current plan shows the 75' and 150' buffer zones which do not apply to this
lot and are therefore confusing. The plan must also show the proposed limit of vegetation
clearing (limit of work).
c) The plan must contain existing and proposed topography at 2' intervals. This is
necessary in order for the Board to determine the extent of the proposed disturbance and
to analyze the drainage patterns on the site.

Attached is the documentation of a conversation between Coler&Colantonio and Mannie Rabbitt.
As related to comment#1 from Coler&Colantonio's latest review,dated October 20, 1998, for the
above mentioned project,it can be noted that the plan indicates the finished floor elevation as 172.5. It
could be assumed that this would indicate a cellar floor elevation of 164.5, 0.75 feet above the ground
water elevation(163.75 according to percolation tests submitted),However the detail sheet attached
indicates a finished floor elevation of 169.0 and cellar floor elevation of 161.5,2.25 feet below the
ground water elevation,In a phone conversation with Mannie Rabbitt on October 20, 1998 at
approximately 5:30PM, it was stated by Mr.Rabbitt that the detail sheet submitted was incorrect and the
revised copy will be presented at the Planning Board Meeting on October 20, 1998.'Phis detail has not
been presented to Coler&Colantonio.
The fore mentioned comment remains barring the presentation and confirmation of the revised detail

between plans and test pit lags should be indicated on the plans. It is unclear that the

trenches incorrectly assume a direct conversion between percolation rates and
