Apparently, the Plaintiff received approval from the Conservation Commission under the Wetlands Protection Act and Zoning Bylaw. He lost before the Planning Board by one vote 3 to I with an abstention and, therefore, no super majority. We were planning to notice depositions, but don't want to do so if the Planning Board is inclined to reconsider given the ConCom vote. Please let me know if we should go forward. Colwell: At your request, Coler&Colantonio, Inc.has reviewed the plan for the above referenced project. It is our understanding that we are to review the plans for compliance with the Zoning By-Laws requirements for projects in the Watershed Protection District. Since the site plan has been thoroughly reviewed by staff prior to our review we have focused on stormwater management aspects of the design. The following documents were reviewed; • A plan entitled"Plan of Land located in North Andover,Mass.prepared for Henry Kuckarzyk"prepared by Christiansen& Sergi last revised 5/5/98. • Response letter dated May 5, 1998, prepared by Christiansen&Sergi • Review letter from the Town of North Andover Office of Community Development and Services dated April 27, 1998 The parcel is located on Bridle Path. The proposed dwelling is located over 400 feet from Lake Cochichewick but within the non-disturbance zone for wetland resource areas. It is proposed to build a new home, including the installation of a sewer line, water service,cable utilities and storm water management facilities. We offer the following comments: 1. It appears that this lot is on an existing subdivision. We are unclear on the status of the lot relative to any grandfathered zoning, The plans should include the lot area and a north arrow. 101 Accord Park Drive 781 982-5400 Norwell, MA 02061-1685 Fax: 781-982-5490 2. We recommend that tests be performed at the location of the proposed infiltration systems. This test should be performed by a soil evaluator and witnessed by an agent Of the town, No test pit data has been included in the information provided. Soil tests should also confirm soil permeability. The response letter indicates that the drywells are sized to accommodate the volume of nmoff generated by a 100-year storm, however, soils should be pervious such that the system will drain between storms and not hold water for an extended period of time. We also recommend that infiltration systems be placed a minimum of two feet above the seasonal high water table, consistent with DEP and ASCE guidance. 3. We have not received any calculations regarding the capacity of the"water quality swale." 'typically the design of a water quality swale would attempt to infiltrate small rainfall events and reduce flow velocities to settle sediments. The grading of the swale would be designed to prevent erosion or overtopping during larger events. This information should be addressed in the calculations. This design reportedly is not intended to retain water. We recommend that if retention of water is not proposed that the railroad ties be replaced with a stone filter berm and filter fabric, It is unclear if suitable soil exists for infiltration. Note that infiltration is the preferred method of stormwater management in the district, 4, The plan should be clarified relative to the driveway grading, Only a partial contour at elevation 166 is indicated, The unlabeled stone hatch pattern along both sides of the driveway and between the building and wetlands appears to be proposed retaining walls.
