The following members were present: George PErna,Chairman,John Simons,Joseph Mahoney, and RIchard Rowen. The legal notice was published in the North Andover Citizen on November 24 and December 2, 1992•and all parties of interest were properly notified. The petitioners are requesting a Special Permit for the construction of a road within the Watershed Protection District and construction of six(6)single family dwellings. The premises affected is located on Great Pond Road in a Residential-1 (R-1) Zoning District and the Lake Coehichewick Watershed Protection District. Mr. Draper read the legal notice to open the public hearing. Ms. Bradlee lave the Board an overview of the Technical Review Committee's discussion and concerns. The TRC has thoroughly reviewed the plan. The drainage has been pulled out of the buffer zone. A summary of the Watershed. Protection District was given by Mr. Perna. EPA suggests the following: 1. No structures be built within 400 feet of the buffer zone. 2. Reduction of building lots from 12 to 6, including the existing house. III' t.)r o It Puhlic 1ci]Lr h A Great ��Oncl ., tc i;��•f, r i11C T: I P Li Great Pond Estates Special Permit Construction of a Roadway in the Watershed District The Planning Board herein approves the Special Permit requested by Eight Meadows Realty Trust,. dated November 13, 1992. The Planning Board makes the following findings regarding this Special Permit as required by sections 4 .136 and 10 .3 of the North Andover Zoning Bylaw: A. The specific site is an appropriate location for the uses, structures or conditions associated with a Definitive Subdivision; B. The Definitive Subdivision will not adversely affect the neighborhood; C. There will be no nuisance or serious hazard to vehicles or pedestrians created by this Definitive Subdivision; D. Adequate and appropriate facilities will be provided for the proper operation of the Definitive Subdivision; E. The Definitive Subdivision is in harmony with the general purpose and intent of the Zoning Bylaw The Planning Board also finds, under Section 4 . 136 (7) (c) that the Definitive Subdivision, in combination with other nearby uses, will not result in significant degradation of the quality or quantity of water in or entering Lake Cochichewick. The Planning Board hereby grants this special permit in conjunction with the Conditional Approval of the Definitive Subdivision of land requested by Marilyn and Felecia Elias, dated November 13 , 1992 ; provided the following conditions are met: 1. Due to the roadway' s proximity to Lake Cochichewick and its location in the Watershed Protection District the following waivers from the "Rules and Regulations Governing the Subdivision of Land" were granted: a. Section 7 .A(1) (j ) Intersection of Street Lines b. Section 7.A(4) Dead-End Streets: The maximum dead-end length allowed in Zoning District R-1 is 800 feet. The Board approves the 1, 014 feet proposed as the extra 214 will not have a detrimental effect on the subdivision. This additional length is necessary to provide frontage for the only dwelling that presently exists on this site. The board finds that (1) the roadway could be extended to abutting properties, if necessary in the 1 �s on future, (2) the effect on the wetlands has been minimized at roadway. station 3+90 and wetlands in the cul-de-sac do not exist, (3) topography in the cul-de- sac area is level, (4) none of the proposed roadway grades exceed 6%. C. Section 7 .0 Shoulders: shoulders have been provided and graded between the right of way line and the pavement, except for the wetland crossing area, where walls are constructed to minimize the impact on the wetlands at roadway station 3+90. Site conditions at the wetland crossing area do not allow for shoulders to be graded in accordance with this Section. It should also be noted that the roadway layout has been carefully placed to pass by and not disturb the isolated low lying areas between roadway stations 6+50 to 9+100. d. Statement of Environmental Impact (Section 3 .C(4) ) : Full statement not required; however the following sections have been drafted: Topography of Existing Site Features, Physical Environment, Surface Water and Soils Conditions And SUbsurface Conditions. e. Modification of Form C Covenant 3 to provide for construction period of two years following the installation of the municipal sewer system in Great Pond Road. f. Modification of Section 7 .A(3) by allowing the substitution of Cape Cod berm for granite curbing. 2 . The applicant must comply with all Department of Public Works Rules and Regulations, including the following: a. the Board finds that due to the roadway' s location in the Watershed Protection District and its necessary wetland crossing, the 22 foot roadway pavement width as shown on the plans is appropriate. b. the Board also finds that due to the sensitive nature of the site, and the need for a minimal amount of impervious surface on site that a landscaped and planted island is appropriate for the center of the cul de sac turnaround. The island must be constructed as shown on the plans and must be 30 feet in diameter. The . pavement around the cul de sac island must have a width of 35 feet. 3 . The applicant has committed to work with the Town to create a so-called "sidewalk fund" in lieu of the actual construction of sidewalks. The Planning Board has determined that due to the location of the subdivision in the Watershed 2 QK' 41z Ll Protection District in conjunction with its small size (6 single family homes) , the creation of a sidewalk fund is appropriate. 4 . The applicant is required to install residential fire sprinklers in all of the newly constructed homes, excluding the existing home on Lot 4. 5. The special permit shall be deemed to have lapsed after a two (2) year period following the installation of the municipal sewer system in Great Pond Road. 6. The provisions of this special permit shall apply to and be binding upon the applicant, it' s employees and all successors and assigns in interest or control. 7 .
