Dear Mr. Perna,
We ask your consideration in resolving the following dilemma: a difficult
hardship resulting from a delay in the gravity sewee extension beginning
at the new pumping station on Great Pond Road and continuing eastward
toward the country club.
`Phis delay has created permit difficulties and in turn financial
difficulties. It has taken seven years of delays and postponements to
get to this point. Therefore , we ask you to consider the following
proposal.:
1) Approve the modifications as shown in the Application.
2) Allow the signing of the Form U by Planning and by the Health Dept.
3) Allow the use of the existing septic system for a 12 month period
beginning from the issue date on the Building/Remodeling Permit.
4) Allow the installation of the approved pumping station and allow
the 1 3611 forced main to dead-end at the 476 Gr-at Pond Road
property line.
5) Retain a $5,000 surity to insure a cunnection to the proposed
or the existing gravity sewer.
6) In the event the proposed gravity sewer is delayed further,
for more than the stated 12 month period , we will extend the
111211 forced main along the shoulder and into the existing sewer
in Great Pond Road. Permission to do this has been granted
by the Sewer Dept. (see accompaning letter)
7) Release the surity in total upon the connection of the forced
main to the town sewer.

Re: Great Pond Rd. - Nieberger
Dear Mr. Perna:
The owner of the property at Lot #5 & 6 Great Pond Rd. shown
on a site plan drawn by Merrimack Engineering and dated July 30,
1991 has requested that revisions be made to the sewer design shown
on the plan. The new design will extend the proposed 2" PVC force
main to the existing sewer manhole located on Great Pond Rd. at the
Water Treatment Plant driveway.
The proposed revision is acceptable subject to our review and
approval of the design changes . If you have any questions, please

Earlier today I visited this site in order to meet with Dave
Zaloga and inspect the "septic system" that is purported to exist
on the property. When I arrived only builders were present on
the lot. I found two small excavated holes in the back yard of
the cottage over the cover of a tank in which there was water,
possibly of ground water origin, and the end of the tank where a
length of Orangeburg pipe protruded. The end of the pipe was not
in evidence. I measured from the edge of the second hole over
the pipe to the edge of a wet area near the brook in the back of
the property. It measured 451 . Without further excavation,
there is no way to tell whether there is a leaching area or not.
If there is, it is much too close to the brook and, I believe, is
actually in the wetlands. I do not feel that it would be in the
best interests of the Lake or the Town of North Andover if the
Board of Health were to approve this system for use. If an
entirely new septic disposal system cannot be installed to the
front of the property, then I feel the owners should be required
to tie-in to the municipal sewer system before this house is
occupied.
