HomeMy WebLinkAbout1989-03-02The North Andover planning Board held a regular meeting on March 2, 1989 on Thursday evening, March 2, 1989, in the Town Hall, Selectmen's Meeting Room. The meeting was called to order at 8:15 p.m. by George Perna, Vice Chairman. Also present were Erich Nitzsche and Michael Leary. John Simons, Clerk, arrived at 8:17 p.m. Paul Hedstrom arrived at 10:00 p.m. Approval Not Required Form A Plans ll4/Salem Turnpike - A.D.S. Management - Nursing Home MOTION: By Erich Nitzsche to approve the Form A Plan. SECOND: Michael Leary VOTE: Unanimous of those present. Candlestick Road MOTION: By John Simons to approve the plans SECOND: Erich Nitzsche VOTE: Unanimous of those present Public Hearings Liberty Hill II - 8 Lot Subdivision John Simons read the legal notice to open the public hearing. Present were Les Godin, Merrimack Engineering and Joseph Lee, applicant. Mr Lee gave the Board a brief summary of what is being proposed. Most of the subdivision is located in Middleton. The lots are two acres. Proposed are septic systems and wells. He is asking for a 50 foot right of way to Middleton. Lot 1 is not a buildable lot by North Andover Zoning Bylaws standards. Not 75% CBA. The septic system may be in North Andover. The Conservation Commission has asked for one change. Erich Nitzsche questioned if Sharpners Pond Road was up to standards and i~ all traffic was going into North Andover. Bill Hmurciak, D.P.W. stated that his department was opposed to the subdivision coming out on Sharpners Pond Road. The major concern was maintenance. Joseph Lee stated the the Middleton D.P.W. said they would maintain the road into North Andover. Erich Nitzsche asked applicant to contact Mass. Electric Cor the purpose of obtaining an easement over their property. John Simons wanted something in writing from the Board of Health. George Perna stated that a traffic study should be done for the area. John Simons questioned who would provide fire and police protection. Mr. Lee said that Middleton would provide protection. Erich Nitzsche requested comments from the North Andover Fire Chief, Bill Dolan. MOTION: By Erich Nitzsche to continue the public hearing until March 16, 1989. Michael Leary stated that he would like to see a larger locus, to look at possible alternatives. SECOND: Michael Leary VOTE: Unanimous Bald Meadow - Definitive Subdivision John Simons read the legal notice to open the public hearing. A letter was received and read from the Fire Chief, Bill Dolan. Paul Bergman, Christiansen & Sergi, presented the Board with the plans. Also present were Claudia and Dennis Dupois, owners of the property and Paul Donahue, surveyor. Paul Bergman spoke on why they named the road Grapevine Road, saying it was for safety reasons. Mr. Bergman showed the Board where the subdivision is located, citing Appleton Street on the unpaved section, quite a way from the paved area. Erich Nitzsche Erich Nitzsche asked if they had rights from Coventry to access the parcel. Mr Bergman said that he would get a written statement. Charles Perrault, attorney for the applicants was also in attendance. Erich Nitzsche asked for a covenant on Lots 2 and 3. He expressed concerns about lot 2 being divided into pork chop lots or Form A Lots, with plans that show drainage calculations for 1 house. Bill Hmurciak, D.P.W., stated that his only concern was the name of the street. Charles Shaffer, 162 Pine Ridge Road and Steve Proctor, 385 Appleton Street both spoke on the pumping station. the following issues were recapped by the Board: Front property tine Wetland Delineation Covenant on Lot 3 Supplementary covenant on Lot 2 Temporary cul-de-sac Rights to access utilities MOTION: By John Simons to continue the public hearing to the first meeting in April. SECOND: Erich Nitzsche VOTE: Unanimous of those present. Riparian Realty Trust - Site Plan Review John Simons read a letter from Dennis Cronin asking for an extension on the public hearing, erich Nitzsche stated that if an extension on the public hearing was granted, the Board would be asking for an extension on the decision. MOTION: By John Simons to continue the public hearing to April 2, 1989. SECOND: Michael Leary VOTE: Unanimous of those present. Boston Brook - PRD John Simons read a letter from the Board of Health. The Board would like Mike Gra~ to attend the next meeting to explain his letter. Ralph Joyce said he wanted the allowable density, 25 lots buildable. The Board of Health says 21 lots are buildable (perc tests were done, 21 lot acceptable). John Simons stated that there were three issues: full calculation - recalculate usable open space clarification from the Board of Health on calculations Planning Board would review and make their own conclusion MOTION: By Erich Nitzsche to accept an extension until May 31, 1989. SECOND: Michael Leary VOTE: Unanimous of those present. paul Hedstrom arrived at 10:OO p.m. George Perna turned the meeting over to the chairman. Discussion River Pointe Attorney Robert Autieri spoke briefly on the comprehensive permit for River Pointe. Comprehensive permits from the State override local zoning. The proposed is located on Ashland Street. Route 114/125 Rezoninq Study Christian Huntress spoke to the Board on the density, citing 6 units per acre. Frank Serio also spoke on the density. He cited that it was 12 units per acre and that going to 6 units per acre was too severe of a cut. A brief discussion took place between the residents and the Board. A compromise to be drafted. Townhouses and condo's were also discussed. Erich Nitzsche left the meeting at ll:O5p.m, because he was sick. Harold Parker Flowaqe Drainaqe Easements The Board tabled the signing until March 16, 1989. The Planning Board did not go into Executive Session. MOTION: By John Simons to adjourn the meeting.
