Dear Mr. Long:
The North Andover Planning Board held a regular meeting on August 4, 1992, in the
Town Building, Selectmen's Meeting Roomupon the application of Flowage Inc.,c/o Channel
Building Co., 242 Neck Road, Haverhill, MA 01830 requesting a Special Permit approval
under Section 4.136 of the North Andover Zoning Bylaw. The legial notice was published in
the Lawrence Eagle"Tribune on July 20 and July 27, 1992. All parties of interest were properly
notified. The following member were present and voting: George Perna, Chairman, John
Simons, Clerk, Joseph Mahoney, John Draper, Richard Nardella and Richard Rowen.
The purpose of the special permit was for the construction of a sewer line within the
Non-Disturbance Zone of the Watershed Protection District. The property affected is located
within the public right-of-way, otherwise known as Great Pond Road,in a Residential-t (R1)
Zoning District.

Christian Huntress stated that the application before the Board was for the construction
of a sewer line from the Colonnade to a pump station near Ray's Pond. The Colonnade septic
system is failing and the connection to the sewer line is essential. Christian Huntress stated that
he has drafted a conditional approval on this application.
John Simons read the legal notice to open the public hearing.
Christian Huntress showed the Board the plans. Approvals from the D.P.W. and the
Conservation Commission have been received.
Steven Foster, Channel Building, Project Manager, spoke to the Board on the
application before them. An escrow account was set up when the Colonnade was sold as
condo's. Mr. Foster explained the way the system would work.
George Perna asked about the existing septic system.
Flowage Inc. has nothing to do with the Colonnade. Flowage Inc. owns the pump
station at Rays Pond. The pump station is connected to the French Farm Subdivision. It was
built larger so that others could connect. The Colonnade has been asked by the Board of
Health to connect into that pump station.
Questions were raised about taking out the old septic system once hooked up to the
sewer. George Perna stated that the old systemwould be used as a back-up. A condition will
be put in the decision on who has control of the back-up system, which will be the D.P.W.
A motion was made by John Draper to close the public hearing. The motion was
seconded by Joseph Mahoney and voted unanimously by those present.
Conservation has issued an Order of Conditions. There is a S100,000 bond in place for
the work.
A motion was made by John Draper to approve the construction of a sewer from the
Colonnade to the pump station at Rays Pond as drafted and amended. The motion was
seconded by Richard Nardella and voted unanimously by those present.

SPECIAL PERMIT FOR CONSTRUCTION OF A
SEWER LINE WITHIN THE WATERSHED PROTECTION DISTRICT.
ZONING BYLAW, SECTION 4.136
FINDINGS OF FACT:
The Planning Board makes the following findings regarding this
Special Permit as required by section 4 . 136 of the Zoning Bylaws:
1. The proposed use and site design for this lot are
appropriate, due to it ' s location in Town.
2 . The applicant has met the requirements of the Town for a
Special Permit as stated in Section 4 . 136 of the Zoning
Bylaw.
3 . Adequate and appropriate facilities will be provided for the
proper operation of the proposed use.
4 . This application for construction within the Watershed
Protection District, Section 4 . 136 of the North Andover
Zoning Bylaw, was specifically granted for construction of a
sewer line within 100 ' of a tributary to Lake Cochichiwick.
The Planning board has determined that construction of this
nature will be in the best interest of the inhabitants of the
Town of North Andover, and will further be in keeping with
the provisions of section 4 . 136 of the Zoning Bylaw.
The Planning Board finds under Section ,4 . 136 of the Zoning Bylaw
that the proposed site plan generally complies with the Town
Bylaw requirements but requires minor conditions in order to be
completely in compliance with Town Bylaws.
Upon reaching the above findings, the Planning Board approves
this Special Permit based upon the following conditions:
SPECIAL CONDITIONS:
1. This decision shall be filed with the North Essex Registry
of Deeds. Included as part of this decision are the
following plans:
2 . The Order of Conditions issued by the North Andover
Conservation Commission, Dated 7/15/92 , Shall be
considered as part of this decision.
3 . The contractor shall contact Dig Safe at least 72 hours
prior to commencing any excavation.
4. Gas, Telephone, Cable and Electric utilities shall be
installed as specified by the respective utility companies.
5. All catch basins shall be protected and maintained with hay
bales to prevent siltation into the drain lines during
construction.
6. No open burning shall be done except as is permitted during
burning season under the Fire Department regulations.
7 . The provisions of this conditional approval shall apply to
and be binding upon the applicant, it' s employees and all
successors and assigns in interest or control .
