Dear Sirs:
Please be advised that I met with the Conservation
Commission of Wednesday, May 14, 1986, to discuss the concerns
Mr. Nitzsche brought up at our meeting two days earlier. I
personally verified by field observations that Lot 1 has four
181 " RCP as specified in the Conservation Commission's Order of
Conditions and that the piping between Lots 3 & 4 contains one
12" CMP as called for by the Order of Conditions.
The Conservation Commission at the May 14, 1986 meeting
confirmed that the logic was to allow as much flow onto the
property and while the outflow may be inadequate in some given �.
storms versus the calculations that the engineers submitted, it +'
was deliberately planned to restrict the outflow to insure a c
zero runoff and to place the burden of any increase in j
retention on the petitioner. I believe this explains the
concerns raised by your Board and I will appear at your June 2,
1986 meeting if any further clarification is necessary.

The NACC has visited Lots 1,2,3 and 4 - Foster
Street this past week to check the erosion control
(hay bale barriers) .
These barriers are adequate except for those along
the wetland crossings. NACC would like more hay bales
placed along the driveway wetland crossings as soon as
possible.

Lots 3/4 Foster Strut
Dear Atty. Joyce:
As requested, this office has calculated the capacity of the 12"
corrugated metal pipe under the driveway serving Lots 3 & 4,
Foster Street, North Andover. The calculations dated June C,
1986, are enclosed.
They may be summarized as follows:
1. The culvert is capable of containing 5.3 cfs, which is
greater than the 1 year design storm, but less than
the 2 year design storm. This means that any storm
greater than the 1 year design storm will result in
breaching of the driveway.
2. The depth of the water over the driveway during
periods of breaching vary with the intensity of the
storm varying from 2" during the 2 year storm to 5.4"
during the 25 year design storm.
3. The breaching will be confined to the driveway area
and will not encroach upon the dwellings.

Our recommendations are:
1. Bituminous concrete be applied to the finish grade 126
on both sides of the culvert.
2. The bituminous concrete be swaled out in the area of
the culvert so as to be in physical contact with the
rip rapped embankment.

Dear Mr. Nitzsche:

The purpose of this letter is to provide our recommendations
with regards to the culvert under the proposed common drive-
way for these two lots.
The original application to the NACC, which proposed separate
driveways , had two 18 inch culverts which were described as
having the capacity to pass a 25-year event without overtopping N
the driveways . The Order of Conditions issued by the NACC re-
quired the total width of the crossing to be narrowed and the
culverts to be redesigned. The wording of this last requirement
in our Order of Conditions was not very clear, in that it meant
to achieve three objectives : 1. Maintain the restrictive nature
of the old culvert at low flows so as to maintain the wetlands
upstream, 2. Use the storage upstream of the proposed culvert
to insure post-development runoff rates were the same as pre-
development conditions , and 3. pass large storm flows without
overtopping the driveway.
The applicant submitted a revised plan which narrowed the cross-
ing and proposed a single 12 inch culvert to replace the original
stone box culvert and the first proposed 18 inch ones. Such a
small culvert attempts to duplicate the restrictive nature of
the old stone culvert, but results in the proposed driveway being
overtopped at very low frequency storms. It was an oversight on

our part to have accepted such a design.
In' order to resolve this problem, we would suggest that the 12
inch culvert be supplemented by a lar er culvert (possibly two
18 inch or a single 30 or 36 inch one to be set at an elevation

just above the 12 inch one. In this manner the wetlands
upstream would be protected by the restrictive capacity of
the 12 inch culvert, but the larger one at the higher
elevation would allow larger storms to pass without over-
, topping the driveway. This may require the driveway ele-
vation to be raised 2 and 1/2 to 3 feet. Our only request
in this area would be not to increase the Vidth of the drive-
way and the extent of wetlands altered. Such a solution
would probably pass close to a 25-year event without over-
topping, although we have not performed detailed calculations
on this item.

This letter is in response to your letter dated Janaury 5,
1987 requesting a Certificate of Compliance for Lots 3 and 4, Foster
Street, North Andover. This request has been denied for the following
reasons:
(1) Condition #18 of the Orders of Conditions
requires the construction of a compensatory
wetland area to replace wetlands filled for
the driveway crossing. Nothing in our files
indicates that this work has been completed.
(2) Condition #20 requires certification of compliance
by a registered professional engineer.
(3) Condition #25 requires permapont stabilization of
this site. Current site condition (ie. , snow cover)
make; it impossible to verify compliance with this
condition at this time.

I recently forwarded to the Conservation Commission for a
Certificate of Compliance on the Order of Conditions on the
above cited properties . The Conservation Commission in their
letter of March 2, 1987 (Copy enclosed. ) cited three reasons
for denying the Certificate of Complaince, but the actual
motivation behind the Commission' s action was a memo dated
February 23, 1987 by the then Town Planner, Tricia Wren, (Copy j
enclosed. ) . The driveway markers the Fire Chief wanted are in
place and the only other information you may need for your file
is the fact that the covenant has been recorded in the North
Essex Registry of Deeds, Book 2228, Page 105 regarding Lots 1 &
2, and in Book 2198, Page 252 regarding Lots 3 & 4.
