DECLARATION OF DEED RESTRICTION
THIS DECLARATION OF RESTRICTION(hereinafter the"Declaration") is made this
day of June, 2011, by Stephen J. Galizio, of 1857 Great Pond Road,North Andover,
Massachusetts 01845 (hereinafter the "Declarant").
WITNESSETH
WHEREAS,Declarant is the owner of that certain parcel of land known and numbered as 1857
Great Pond Road,North Andover, Massachusetts by virtue of deed recorded with the Essex north
District Registry of Deeds in Book 11112, Page 121; and
+AS, the Property is located within the Town of North Andover Watershed Protection
F0 Zoning District;

WHEREAS, the Declarant was granted a Watershed Protection District Special Permit by
�o Decision, dated December 21, 2010 and recorded at Book d-610, , Page OA ; and
° WHEREAS, Special Condition Paragraph 3(c) of the Decision requires the Declarant to limit
the use of fertilizers on the Property to those which are either organic or slow-release nitrogen or
phosphorous-free and that this restriction be incorporated as a deed restriction on the Property;
Z NOW,THEREFORE, Declarant hereby voluntarily declares and imposes upon the Property the
• following restriction for the benefit of Declarant, his successors and assigns, and the Town of
North Andover.
A1. The use of fertilizers on the ro ert is limited to those which are either organic, or slow-
release Y
release nitrogen and phosphorous-free.
2. The Declarant hereby incorporates all references to the limitation of the use of pesticides,
afertilizers or chemicals contained in the approved Watershed Protection District Special
O Permit as a deed restriction to the above-referenced deed.
3. The owner and his successors in title shall forever adhere to the conditions set forth in the
Watershed Protection District Special Permit.
4. Said conditions shall run with the land and may not be waived, altered, or changed in any
respect without the specific prior written consent of the North Andover Planning Board.
