Dear Mr. Alden:
The Conservation Department is in receipt of the Integrated Pest Management Plan for the
North Andover Country Club,prepared by John J. Bresnahan. The Conservation Department,
Board of Health and Water Treatment Department has conducted a preliminary review
plan and at this time and offers the following comments: of the

address pot t'al impacts to e wetland resource areas on the site, but also to address
the extreme sensi theland ' -
n proximity to the Town's water supply. Two direct
tributaries to the lake flow through the property and the use and application of
pesticides and fertilizers would have a significant impact on the water supply.
The objective of the plan appears to.focus on the management and maintenance of
healthy turf grass with little emphasis on the management and/or reduction of
chemicals that pose a threat to the ground and surface water supply. It is not clear as to
the site specific strategies that will be undertaken to prevent contamination t the
wetland resource areas and water supply. Kindly address this issue.
• The Order of Conditions issued for several projects on the golf course prohibits the use
of fertilizers and pesticides within 100 feet of wetland resource areas. This is a
restriction that is placed on every applicant that is issued an Order of Conditions.

Non-Discharge Zone and Non-Disturbance Zone include the use and storage of
pesticides and fertilizers. Currently,the golf course continues to operate in violation of
the local watershed and wetland protection bylaw regulations. The applicant is seeking
a waiver to allow the use and application of chemicals necessary for turf management
r fhie application guidelines identified in the Integrated Pest Management Plan.
The applicant is requesting to apply chemicals throughout the golf course turf greater
than 25 feet from wetland resource areas
• A water quality sampling and monitoring program should be established for the
tributaries and the shore of the lake to determine if turf management practices are
contributing pollutants to the lake. A baseline should be established before the plan is
enacted. Locations of the monitoring activities should be shown on a plan and results
should be submitted to the Conservation Department, Health Department and Water
Treatment Plant. It is recommended that sampling should be performed on at least a
quarterly basis.
• Results of the proposed irrigation water testing should be submitted to the above
mentioned Town Departments. It is important that the testing for phosphates,nitrates,
nitrites and ammonia be conducted on all water that may reach the groundwater or the
Lake.
• The Water Treatment Plant has raised concerns about the use of sodium. High sodium
levels within such close proximity to the water intake pipe can increase sodium levels in
the town's drinking water,which can cause multiple health problems.
• Concerns over the mincing of chemicals and cleaning of containers were raised. The
location of these activities should be shown on a plan and distances to wetlands or
tributaries should be identified. What is the procedure for a spill?An emergency spill
plan should be implemented to handle the containment, drainage or wash down of
materials.
• The storage and mixing facility of the chemicals should be identified on the plan. It
should be sited as far away as is possible from the Lake and its tributaries. As stated
above, an emergency plan should be implemented for the accidental spill of the
chemicals.
• Page 22 of the plan states that mapping of the golf course for pest activity will be
initiated in the 2000 season. It this a typo or an outdated plan?
• Unfortunately,the topography of the golf course slopes down to the Lake so that
normal flow of surface water is towards and into the community water supply. Because
the Lake is the only source of community water for the town, "minimising" or
•,reducing" chemical contamination does not achieve the goals of water supply
protection and prevention of contamination. Please present a proposal for the collection
and treatment or recycling of chemically contaminated runoff/drainage that prevents
runoff from entering the Lake.

Re: Integrated Pest Management(IPM)Plan for North Andover Country Club
Dear Ms. Parrino:
I am writing in response to your letter dated November 15, 2002, which provided
comments on the IPM Plan for North Andover Country Club (the"Club"). The Club submitted
the IPM Plan to the Commission under cover of letter dated October 3, 2002. The Commission
requested preparation of the IPM Plan in May 2002, in order to administratively approve
amendments to Condition No. 63, Order of Conditions No. 242-995 [Irrigation Project at the
Club], and Condition No. 69, Order of Conditions No. 242-1122 [Pool Project at the Club].
The Club's response to your November 15 letter takes two forms. First,the IPM Plan is
proposed to be supplemented with the following appendices (copies enclosed herewith): (i)
Environmental Monitoring Program—Water Quality Monitoring Program at North Andover
Golf Course; and (ii) Oil and/or Hazardous Materials Spill Response Action Plan—North
Andover Country Club. Second, additional explanatory and technical responses are provided
below. On the assumption that these further submissions and responses prove satisfactory, the
Club again asks the Commission to administratively approve the IPM Plan, as well as the above-
noted amendments to its Orders of Conditions (as further described in the October 3 letter).
Further Explanation of Water Quality Monitoring Pro ram. The enclosed Water
Quality Monitoring Program [App. 1] calls for the collection of site-specific data
from various monitoring stations along the two Lake Cochichewick tributaries
which flow through the Club's property. In Phase I [April 2003], baseline data on
nitrogen, total phosphorus pH, and specific conductivity will be collected prior to
the application of any pesticides or fertilizers during this growing season. In
Phase II [September 2003], all monitoring locations will be re-sampled, and a
"pesticide screen analysis" conducted for products used during the prior 90 days.
In Phase III [2004 and beyond], bi-arnual sampling will take place for pH,
specific conductivity, total ortho-phosphorus, nitrate, nitrite and total kjeldhal
nitrogen, along with pesticide screening. All collected data—which will be

provided to the Commission, Health Department, and Water Treatment Plant—
will be used by the Club to ensure optimal protection of groundwater and surface
water resources. The Water Quality Monitoring Plan also identifies the location of
the pesticide storage and mixing areas at the Club, and stipulates that pesticides
will be stored in a self-contained, spill proof locker.
Oil and/or Hazardous Materials Spill Response Action Plan. To further
ensure appropriate response in the unlikely event of an uncontrolled release of
pesticides, the IPM Plan is amended to include an Oil and/or Hazardous Materials
Spill Response Action Plan [App. 2].
The IPM Plan Promotes Further Protection of Lake Cochichewick. The
development of healthy turfgrass within a sound IPM Plan provides an effective
and site-appropriate means for protecting groundwater and surface water
resources. Well tested Best Management Practices (g.g, verticutting, aeration)
cultivate turfgrass plants able to withstand environmental and pest pressures with
minimal fertilizer/pesticide applications.
No Feasible"Bio-Control" Alternatives to Chemical Pesticides at Present.
Presently, there are no commercially viable and safe bio-control products
effective to combat the wide range of pest pressure on turfgrass. Nevertheless,
the IPM Plan calls for the continual evaluation of new technologies and bio-
rational products, which if feasible would then be integrated into the IPM Plan to
reduce chemical application wherever practicable. In the meantime, the
responsible use of pesticides and fertilizers under the IPM Plan, together with
implementation of the proposed Water Quality Monitoring Program, provides a
high degree of confidence that water resources will remain well protected.
Vegetated Buffer Strips/Literature Review. In preparing the IPM Plan and
this letter,the following papers—which describe the sorbent capacity of vegetated
buffer strips and use of Best Management Practices as effective means for
protecting water resources on golf courses—have been referenced: (i)Baird,
James H., Evaluation of Management Practices to Protect Surface Water from
Pesticides and Fertilizer Applied to Bermudagrass Fairways; (ii)Barton, Louise,
and Colmer, Tim, Maximizing Turf Quality, Minimizing Nutrient Leaching; (iii)
Branham, B. E., Gardner, D. S., How Does Turf Influence Pesticide Dissipation;
(iv) Colmer, Tim, Minimizing Nutrient Leaching: Save Resources and Protect the
Environment; (v)Liskey, Eric, Water Polluter or Water Filter?; and (v)Lyman,
Gregory T., Alternative Strategies for Tuufgrass Management Near Water.

VHB has received the following plans and documents for review,
• Site Plan(1 sheets)dated February 12,2003
• Watershed Special Permit Application
• Integrated Pest Management Plan
The submission was reviewed for conformance to appropriate sections of the 1972 Town of
North Andover Zoning Bylaw amended May 2001 and standard engineering practice. The
following comments note non-conformance with specific sections and questions/comments on
the proposed design.
I. WATERSHED SPECIAL PERMIT
The parcel of land falls within the general watershed protection district of Lake
Cochichewick.
1. Section 4.136.4.c.ii.(3-5)The limits of the Conservation Zone,the Non-Disturbance
and the Non-Discharge Zones have not been shown on the plans. The zones are
based on:the distance from Lake Cochichewick or a wetland resource area within the
watershed district as described in Section 4.136.2,Table 2. It is assumed that the lot
was created prior to October 24, 1994 and would be subject to the 325-foot limit.
VHB recommends that the Applicant revise the plans appropriately.
2. Section 4.136.4.c.iii. This section requires written certification that there will be no
significant degradation of the quality or quantity of water entering Lake
Cochichewick by a professional engineer registered in the state of Massachusetts.
No such statement has been included. VHB recommends that the Applicant's
Engineer add this statement to the plans.

3. Section 4.136.4.c.iv. It appears that much of the project area is located within the
Non-Discharge Buffer Zone. This section requires that the Applicant demonstrate
that there is no reasonable alternative location for the improvements outside of the
Non-Disturbance and/or the Non-Discharge Buffer Zones. The Applicant has
proposed a chemical storage shed and an addition to an existing garage within the
Non-Discharge Buffer Zone. A portion of the addition is also within the Non-
Disturbance Buffer Zone. No discussion has been provided as to why the storage
shed or the addition cannot be located outside of the Non-Disturbance and the Non-
Discharge Buffer Zones. VHB recommends that the Applicant provide a statement
as to why there are no other reasonable alternatives.
4. Section 4.136.4.c.vi. This section requires that evidence be provided that all
operations,including but not limited to fertilizer applications,will not create
concentrations of nitrogen in the groundwater greater than the Federal limit. VHB
would also like to note that the use of any lawn care or garden product(fertilizer,
pesticide,and herbicide)that may contribute to the degradation of the public water
supply as well as the use of lawn care or garden products that are not organic within
the Non-Disturbance Buffer Zone,is strictly prohibited. The Applicant has included
an Integrated Pest Management(IPM)Plan which has been reviewed by VHB and
comments have been included in Section 11 of this report.
5. Section 4.136.41. This section requires that any new structure,other than an
accessory structure or expansion less than 25%of the gross floor area,be
constructed outside of the non-disturbance zone. The proposed addition to the -A
existing garage is a 28.5%increase in floor area. A portion of the improvements is
located within the Non-Disturbance Zone. VHB recommends that the Applicant
revise the plans to comply with the requirements of this section.
6. Section 4.136.4.g. This section requires that all runoff from new impervious q)
surfaces be infiltrated to the extent practicable. The Applicant has not indicated t
what treatment if any has been proposed for the runoff from the proposed structures.
VHB recommends that the applicant provide dry wells or other similar treatment for
the roof runoff from the proposed structures.
7. Section 4.136.3.a.iii.21 This section specifically prohibits the storage of chemicals
within the Watershed Protection District. The Applicant has proposed to construct a
chemical storage shed within the Non-Discharge Buffer Zone.

H. Integrated Pest Management Plan
VHB has reviewed the Integrated Pest Management(IPM)Plan and offers the following
comments:
1. The IPM plan is submitted as a basis for allowing the North Andover Country Club
to use chemical pesticides,herbicides and fertilizers on areas of turf within the
Watershed Protection District. The applicable bylaws prohibit the use of these
chemicals within 325-feet of a regulated wetland resource. The Applicant has
proposed to use these chemicals and monitor the water quality of the receiving
waters.

2. The reduced scale existing conditions plan included in the IPM Plan appears to have
been folded when copies were made and is not legible. VHB was unable to review
this plan.
3. The IPM plan would be more effective and the intent of the plan would be more
clearly shown,if the Applicant provided an overall site plan at a suitable scale

5. The Applicant has made no commitment to use slow release fertilizers,limit
management applications,or apply only town approved pest control products. B

6. The Applicant states that samples will be taken at various points along the two Lake
Cochichewick tributaries which flow through the Country Club property. In order to
insure further protection of water quality VHB suggests that the Applicant also
conduct testing in Lake Cochichewick.
7. The Applicant has stated that tests will be conducted to determine background levels
of nitrogen,phosphorus and specific conductivity prior to the application of
pesticides or fertilizers this growing season. In order to further protect the water
quality VHB suggest that the Applicant consider providing testing for VOC's,
Pesticides,pH and Alkalinity.
8. The IPM provides information on the effectiveness of buffer space between resource
areas and treated areas but the Applicant has not provided any information regarding
the use of buffer spaces on site.

Re: Review of The Integrated Pest Management Plan

Dear Mr. Alden:
The Conservation Department is in receipt of the revised Integrated Pest Management Plan for
the North Andover Country Club,prepared by John J. Bresnahan, dated January 28, 2003. The
revisions were submitted in response to my letter dated November 15,2002 which
incorporated comments from several different Town Departments. The submitted revised
information has been reviewed by the Conservation Department(CC), Health Department
(BOH), Planning Department(PB)and the Water Treatment Plant(WTP). In addition, the
Planning Board's consultants have reviewed and made recommendations to the IPM plan and
comments should be addressed separately from this letter. Comments are outlined below:
• Phase 1 of the water quality monitoring program is scheduled for April 2003, Phase II in
September of 2003 and Phase III is scheduled for bi-annual sampling following the first
two phases. When are the biannual tests proposed to be conducted in the ongoing
Phase III and will they be conducted prior to and upon application of pesticides and
fertilizers?
• Testing is proposed along the surface waters of the Lake and two stream systems
commonly referred to as Foamy Brook and Country Club Brook. It is unclear as to the
exact sample locations as they are not shown on a plan. Testing areas are
recommended to be conducted upstream and downstream of Great Pond Road.
Designated areas must be shown on a reference plan and the Country Club will be
required to erect permanent signage in the testing areas to promote consistency during
the sampling periods. Locations of the sampling areas must be reviewed and approved
by the Conservation Department.
• Page 1 of the Water Quality Monitoring Program states that"Should nitrates above
10mg/1 be detected in the surface waters,fertilizer formulation, application timing and
environmental conditions will be reviewed to prohibit such runoff". Upon discussions

with the Water Treatment Plant Lab Director, a 10mg/1 count in a water supply is
extremely dangerous and must be reported to the state. Currently the nitrate count
surrounding the water treatment plant intake is 0.04 mg/1. The average nitrate counts
collected over the years along the two brooks within and adjacent to the country club
property approximate 0.3 mg/l. Sampling conducted in the fall experienced higher
nitrate counts. The language in the monitoring program must be revised to incorporate
0.3 mg/1 of nitrate as a threshold limit of concern.
• Results of water tests shall be submitted to each of the interested town Departments on
a reader friendly spreadsheet which displays the compared results from year to year.
• On Page 1 of the Water Quality Monitoring Program,paragraph 3 states that if
"fertilizer and and/or chemical products are detected above background levels, an
immediate response by the golf course superintendent will be initiated". What type of
response will be initiated?A specific response should be described. A confirmation of
elevated levels of a compound in the Town's drinking water is an inadequate response.
An effective water quality program should present measures to prevent any
contamination of the water. The plan does not seem to suggest or propose measures to
actually prevent contamination.
• The Board of Health would rather there be no pesticide/herbicide use on the land
abutting the Lake. The Board of Health is requesting daily water sampling for ten days
to two weeks after the first season application of the of pesticide/fertilizer. If
contamination is detected,then the practice should be discontinued or modified.
• High concerns have been raised by the different Departments regarding the application
of chemicals in the areas surrounding the club house, on the shores of the Lake. Is
minimization or non-application of pesticides/fertilizers possible in this area?Other
golf courses have proposed an under-layment of plastic or some other material beneath
the turf to catch, collect and recycle any chemical-laden water. Can this possibility be
explored?
• Nitrogen and phosphorus must be kept from entering the ground and or surface water.
What measures are in place to prevent possible contamination?
• Included in the supplemental information was literature review which focused on the
importance of buffer zones along wetlands and watercourses. Country Club Brook, the
commonly referred to Brook which runs through the center of the course, currently
does not have a well vegetated buffer. The Country Club has proposed not to apply
any chemicals within 25 feet of wetland resource areas. A 25'No-Disturbance Zone is
enforced under our local Wetland Protection Bylaw. Due to the importance of buffers
along resource areas, a 25'buffer should be established along the Country Club Brook.
All mowing activities must cease within 25' of wetland resource areas. Small to
medium height shrubs should be planted along the watercourse. A site walk with the
Conservation Administrator should be scheduled to review the brook and potential
locations for buffer zone enhancement.
• For State Police#s include the Mass. State Police in Andover(978)475-3800
or the main # (800)525-5555;
• Under Local contacts include the North Andover Fire Department# (978)
683-3168;the Fire Department will be responsible for contacting HazMat;
• Under the Spill Response Notification Record, include weather conditions.
• Is Jim Titus trained in responding or recognizing what to do in an event of a spill? Is he
a Licensed LSP?
• The North Andover Fire Department should be immediately notified in an event of a
spill as they will contact the federal or state emergency response personnel if needed.
• The Country Club must provide the name and number of a spill contractor who is
available 24 hours a day and who is available to be on site within 60 minutes of a
reported spill.
• Plans of the newly proposed chemical storage building must be reviewed and approved
by the Fire Department.
• The IPM Plan shall be incorporated into the deed of the property and must be carried
out in perpetuity of the life of the course facility.
• The IPM Plan must be revised,if necessary, every five years and revisions must be
reviewed and approved by the applicable Town departments

Attached please find VHB's original and follow-up reviews of the NACC
project. Based on the follow-up comments VHB provided to the applicant
last week, the applicant intends to request another continuance and
agree to an extension of the filing deadline from July 6 to July 31,
2003. I spoke with both a Representative of the club (Tom Childs) as
well as their engineer (John Bresnehan) today and am meeting with them
next Tuesday, at which time they hope to have completed the revised plan
and IPM. I expect that they will be ready to appear before you on June
17.
I also spoke with the engineer about applying for green certification
from Audubon International. This organization, which is not affiliated
with the state bird Audubon's, certifies golf course practices in a
number of areas such as water quality, habitat and open space. I
suggested that given the fact that the course is in the Watershed
District and is in close proximity to the Town's drinking water supply,
they might explore the possibility of becoming a Certified Audubon
Cooperative Sanctuary. Mr. Bresnehan has worked with other courses on
ACSP certification and seemed supportive of this idea.

Dear Mr. Childs:
This Department is in receipt of the latest submitted materials associated with the Integrated
Pest Management Plan for the North Andover Country Club. It appears that many of my
requirements outlined in my March 17,2003 letter have not been incorporated into the
complete package. For example,the typo on page 22 still exists,the 0.3 mg/1 nitrate count
threshold should be incorporated into the plan, additional phone numbers have not been
included in the oil and hazardous plan, and the name and number of the spill contractor has
not been submitted. This final plan will not be approved by this Department until all
requirements outlined in my previous letters have been addressed.

Re: Integrated Pest Management Plan
Dear Mr. Childs:
The Conservation Department is in receipt of the final revised Integrated Pest Management
Plan for the North Andover Country Club located at 500 Great Pond. The IPM Plan appears
complete. fertilizer and pesticide application must be conducted in strict adherence to the plan.
This plan must be complied with throughout the life of the golf course facility. The plan
should be re-evaluated every 5 years and updated if new BMP practices or products are
introduced to the market. Revisions to the Plan shall be submitted to the Conservation and
Planning Departments for review and approval.
The water quality monitoring program shall be implemented for a minimum period of 5 years
(up to year 2007). Upon completion of the 5 year program,the Conservation Department,
Planning Department and Water Treatment Plant will review the results and determine if
continual testing is necessary to ensure the protection of the Lake Cochichewick drinking water
supply. All yearly water testing data shall be submitted to the Conservation Department,
Planning Department and Water Treatment Plant for review.
The Conservation Department hereby approves the revised IPM plan submitted on September
22, 2003. Copies of the final plan and the Irrigation System Design Plan should be submitted to
the Planning Department, Fire Department and Water Treatment Plant.
