The Planning Board held a special meeting on.Thursday evening,
May 23, 1985 at 8:00 p.m. in the Town Office Meeting Room. The
following members were present and voting:
Michael P. Roberts, Chairman; John A. James, .Jr., Clerk; and
John J. Burke.
Town Planner Karen Nelson was also present.
COVENTRY PRELIMINARY PLAN - DECISION
MOTION: by Mr. Burke to conditionally approve the Coventry Prelimi-
nary Plan dated May 1985, by Beta International, Inc. subject to the
nine conditions. In addition, the tenth condition shall state
that the applicant shall forward the required documentation regarding
the status of said parcel under M.G.L., Chapter 6lA as Classified
Agricultural Land prior to filing a definitive plan.
SECOND: by Mr. James.
VOTE: Unanimous.
NOTE: The decision is hereby made a part of the minutes.

Dear Mr. Long:
The North Andover Planning Board held a public hearing on
Monday evening, -January 21, 1985, in the Town Office Meeting Room
upon the application of Joseph Desilets. The hearing was advertised
in the North Andover Citizen on December 13 and 20, 1984. The
following members were present and voting:Paul A. Hedstrom,
Chairman! Michael P. Roberts, Vice Chairman; John A. James,
Jr.,Clerk~ John J. Burke; Erich W. Nitzsche.
The petitic~er seeks a Special Permit under Section 4.133(d) of
the North Andove. Zoning Bylaw which requires a Special Permit to
allow constructi ~n to occur within 100 feet of a tributary in the
Lake Cochichewic: Watershed. The premises is known as Lot 1, on the
East side of Es ~ex Street. The lot is both situated in the
Residential 2 ant, Watershed Zoning Districts. Said lot possesses
44,014 square fe,~t of land area and 150 feet of frontac? on Essex
Street.
At the hearing, Mr. Joseph Cushing,~the applicants repr-esentative
from Richard F. Kaminski Associates informed the Planni~,~ Board the
following:
- tn order to meet the proper setback requirements for both the
dwelling and' septic system, the lot shape hampered theic placement
further away from the existing brook. However, they have been
located at the furthest possible point.
- There is an existing woodLan~ path where the proposed
driveway is to' be located.
- The subsurface disposal syste;~ satisfies Title V and the
local Board of Health regulations.
- The syst(m will be pumped, and will not be by gravity. -
- The driveway will remain at the present grade. A 12 inch
corrugated meta. pipe will be placed at the driveway crossing.
- Riprap will ~e placed on the upstream and downstream side of
the 12 inch pipe
Two abutters, Mr. Leary and Mr. Scully, indicated to the Board that
the referred 'woodpath' neve~ existed and that it had been
constructed in the recent past without the proper permits.
The Planning Board acknowledged the abutters remarks and will make a
visit to the site to look at the present conditions.
The following members were present and voting at the March 13, 1985
meeting when the Board rendered the decision:Michael P. Roberts,
Vice Chairman; John a. James, Jr., Clerk; John J. Burke, Erich W.
Nitzsche.
Upon a motion mad~ by Mr. Nitzsche and seconded by Mr. Burke, the
board voted unani'~ously to deny the petition and PLAN DATED NOVEMBER
15, 1984 BY RICHA%D F. KAMINSKI & ASSOCIATES, INC. FOR LOT 1 ESSEX
STREET for the fo'.lowing reasons:.
1. The applican~ has not demonstrated that the construction of the
dwelling, drivewa, z and septic system, in addition to the associated
alteration of the land around the wetland tributary w~ll have no
· environmental impact on the tributary and watershed;
2. The applicant has not demonstrated to the board that thece is
no other alternative to gain access to the site. The applicant and
engineer have not pursued any other options:
3. No drainage calculations were submitted to the board indicating
that the driveway would not create a damming effect on upstream
flooding.
In' denying this Special Permit, the Planning board finds,
pursuant to Sectfon 10.31 Conditions for Ap_pr~l 0~__Special Permits
of the .Zonin~ By~aw, the follow{ng:
A. Lot 1 Essex St_eet has not been determined as the most
appropriate locat-on for the construction of a driveway, since it
crosses a watershed tributary;
B. The residentlal use in the Waters%~ed District as sho~,n on the
submitted plan dc,es not ensure that the development will not
adversely affect the neighborhood. The applicant has failed to
prove otherwise;
C. Based on site visits, .the public hearing process and testimbny
from town boards and departments, the location of the use and access
to the site is not in harmony with the general purpose and intent ,of
the North Andover Zoning Eylaw, specifically, Section 4.133:
'Watershed DistriCt surrounding Lake
Cochic~ewick, our source of wate~ supply,
is intended to preserve and maintain the
filtration ~nd purification function of the

I. A Notice of Intent shall be filed with the North Andover C~naervation Commission'
as required under their local Bylaw and Chapter 131 - Wetland Protection Act.
2. All test pits and percolation tests shall be located on the definitive plan and all
results including spring water tables shall be submitted to the Board.
3. The intersection of Patton Lane and the proposed road shall be redesigned to
elindnate the island and meet at a move 90° angle.
Two catch basins shall be installed at the intersection of Patton Lane and the
proposed road.
5. A new twin q2 inch R.C.P. culvert shall be installed at the brook crossing · The
road shall, be elevated to adequately cover said culvert.
6. The roadgrade and subgrade shall be constructed q feet ~bove the existing
water table.
7. Subject to the roadway elevation a catch basin shall be ink, tailed in front of Lot3.
