DATE: 2nd Review—November 29,2007 1St Review-October 25, 2007 Proposal: Danielle Dellovo is before the Planning Board seeking a Watershed Protection District Special Permit under Section 4.136.3.b.ii(1)of the Zoning Bylaw to construct a 1,298 sq. ft. attached garage and house addition, in ground pool and deck totaling 1,575 sq. ft., driveway improvements totaling 2,466 sq. ft. driveway, installation of stormwater management system,and related grading and landscape work.within the 325 ft.Non-Discharge Buffer Zone. The 131,902 sf. ft. lot currently contains a single-family residence and attached garage. SECTION 4.136 WATERSHED PROTECTION DISTRICT Section 2—Boundaries and Zones: The proposed activities are located primarily within the 100 ft Non-Disturbance Zone and 325 ft.Non- Discharge Zone associated with bordering vegetated wetlands in the Watershed Protection District. The Non-Disturbance Zone is correctly labeled on the plan Section 3—Uses and Building Requirements: The construction of the access drive and driveway from Great Pond Road within the 100' Non- Disturbance Buffer Zone associated with bordering vegetated wetlands in the Watershed Protection District would be allowed by a Special Permit from the Planning Board. Section 4:—Special Permit Requirements: ➢ 4.136 (4)(c)(ii). Map on a scale of one(1) inch equals forty(40)feet prepared by Registered Professional Engineer or Surveyor showing: (2)The edge of all wetland resource areas, as confirmed by the Conservation Commission(if edge of wetland resource area is within four hundred (400)feet of any proposed activity), (6) The edge of vegetation clearing(edge of work). NotAddressed. The plan submitted uses a scale of F' == 30'. The applicant will need to explain and revise the plans accordingly. The applicant will need written confirmation from the Conservation Department confirming edge of wetland resource areas. Further, according to the submitted plans, clearing will occur on the western portion of property near the proposed pool and fence area and again the plans will need to be revised to show the edge of work for clearing Addressed ➢ 4.136 (4)(c)(iii). Written certification by a Registered Professional Engineer, or other scientist educated in and possessing extensive experience in the science of hydrology and hydrogeology, stating that there will not be any significant degradation of the quality or quantity of water in or entering Lake Cochichewick. Not Addressed. A statement was not submitted by an engineer stating that the proposed project will not degrade the quality or quantity of water in or entering Lake Cochichewick as a result of this project. Addressed. The revised supplemental application materials included a letter stamped and signed by Ben Osgood, Jr., P.E. dated 11126107 certifying that there will not be any significant degradation of the quality or quantity of water in or entering Lake Cochichewick. ➢ 4.136 (4)(c)(iv).Proof that there is no reasonable alternative location outside the Non-Disturbance and/or Non-Discharge Buffer Zones,whichever is applicable, for any discharge, structure, or activity, associated with the proposed use to occur. NotAddressed. Dept. of Environmental Protection(DEP) of any industrial wastewater treatment or disposal system or any wastewater treatment of system fifteen thousand(15,000)gallons per day capacity. Addressed. The project will not result in any industrial waster water treatment or disposal system or any wastewater treatment system of fifteen thousand gallons per day capacity. ➢ 4.136 (4)(c)(vi).Evidence that all on-site operations including,but not limited to, construction, waste water disposal, fertilizer applications and septic systems will not create concentrations of Nitrogen in groundwater, greater than the Federal limit at the down gradient property boundary. Not Addressed. The applicant has not provided written documentation stating proposed activities will not create concentrations of nitrogen,phosphorous and other relevant chemicals on and off-site the property. Addressed The revised supplemental application materials included a letter stamped and signed by Ben Osgood, Jr., P.E. dated 11126107 stating that all on-site operations including, but not limited to, construction, waste water disposal,fertilizer applications and septic systems will not create concentrations of Nitrogen in groundwater, greater than the Federal limit at the down gradient property boundary. ➢ 4.136 (4)(c)(vii).Projections of down gradient concentrations of nitrogen,phosphorus and other relevant chemicals at property boundaries and other locations deemed pertinent by the SPGA. Not Addressed. The applicant has not provided written documentation stating proposed activities will not create concentrations of nitrogen,phosphorous and other relevant chemicals on and off-site the property. Addressed. The revised supplemental application materials included a letter stamped and signed by Ben Osgood, Jr., P.E. dated 11126107 stating providing the projections of down gradient concentrations of nitrogen,phosphorus and other relevant chemicals at property boundaries and other locations deemed pertinent by the SPGA. ➢ 4.136 (4)(g).The Bylaw requires that any runoff from impervious areas within the Non-Disturbance and Non-Discharge Zones to the extent possible shall be recharged on site and diverted toward areas covered with vegetation for surface infiltration. Partially Addressed. The applicant is proposing to construct an underground stormwater management system to recharge the water on site. The independent review consultant is currently reviewing the proposal. Partially Addressed. The Town's independent review consultant, VHB, submitted a review of the project dated 11129107. The review shows three outstanding comments that will need to be addressed by the applicant. Pg.2,#8 Have test pits been taken at the location of the proposed infiltration system? The Applicant should verify that there is a 2-foot separation between annual high groundwater and the bottom of the infiltration system. Partially addressed. Partially addressed. The Invert Out of the proposed catch basin appears to be missing. Pg. 3,417 In the Storm Tech SC-310 Infiltrator detail, it appears the elevation for the bottom of the crushed stone is incorrect(97.67 should read 94.67). The Applicant should revise. Partially addressed. It is unclear what the 202.00 elevation refers to. SECTION 7 DIMENSIONAL REQUIREMENTS Section 7.1-Lot Area: This lot is within the R-1 district with a total area of approximately 36 acres with more than 155 linear feet of frontage on Great Pond Road. Section 7.3- Setbacks: Proposed structure meets the required yard setbacks of the Residential 1 District as shown on the Layout Plan. Section 7:4—Building Heights: The proposed garage structure will be less than the maximum height limit of 35 feet. General Comments: ➢ In accordance with Section 4.136.3.b,Non-Discharge Buffer Zone a project would require a Watershed Special Permit in the Non-Discharge Buffer Zone if the project creates any surface or sub- surface discharge, including but not limited to, storm water runoff; drainage or any roadway that is maintained by the Division of Public Works or any private association; outlets of all drainage swales; outlets of all detention ponds. All storm water management systems shall employ Best Management Practices. Addressed ➢ Please explain how roof runoff is being handled from the proposed two-story garage. Will the project increase the rate and flow of runoff onto abutting properties or Marble Ridge Road? Given the location and proximity of the proposed garage, is it intent of the applicant to include roof drains and infiltrators? Addressed Roof runoff is being channeled to the infiltrator using gutters, downspouts, and PVC pipes. Driveway runoff is being infiltrated using pervious pavement. If the pervious pavement stops infiltrating in a large, the design includes a deep sump catch basin which is connected to the infiltrator system. The applicant will need to submit a maintenance schedule of the pervious surface. ➢ Please explain the visual impact of the proposed additions,pool, and garage on abutters. Have any abutters expressed concern regarding the visual impacts of the project? Addressed. ➢ The Plans should show the extent of clearing to allow construction of the pool, garage and driveway. If applicable, please revise the plans identifying the extent of clearing. Partially Addressed. The plans show the 4 foot fence in the proposed tree line. Further, it is recommended that the Locus Map should be revised to show a scale of 1"= 1500'. Addressed Recommendations: The revised plans and supplemental information submitted incorporates the majority of comments and recommendations made by Planning Staff and the Planning Board. The applicant will need to address the comments from VHB and incorporate the 3 plan changes. The Applicant has submitted the following information for VHB's 2nd review: • Response to comments letter dated November 15,2007, • Watershed Special Permit Plan, 5 Village Way— 1 Sheet,dated July 2,2007. The following comments note non-conformance with specific sections of the Zoning Bylaw or questions/comments on the proposed design and VHB's recommendations/suggestions. VHB offers the following additional comment, due to modifications to the plans: 1. The Applicant should provide a detail of the proposed pervious pavement,including materials,dimensions/thicknesses and specifications for the porous asphalt mix. This information will help the Contractor construct the driveway as designed. The following are VHB's follow-up comments(in bold)to the Applicant's response letter. Town of North Andover Zoning Bylaw 1. (4.121.7) The Applicant should specify on the plans that the proposed fence is at least 4 feet high, as required by this section. Addressed. 2. (4.136.3.b.iii.2 and 3)VHB suggests adding notes on the plans prohibiting the use of lawn care products that may contribute to the degradation of the public water supply or the use of garden products that are not organic or slow-release nitrogen,as required by this section. Addressed. 3. (4.136.4.c.ii.1)VHB suggests adding a note specifying that the annual mean high water mark of Lake Cochichewick is over 400 feet from the site. Addressed. 4. (4.136.4.c.ii.6) The Applicant should show the limits of vegetation clearing/limit of work around the fence on the west side of the house and around the driveway and infiltration system area. (4.136.4.c.iii) A written certification from a registered professional engineer,or other scientist educated in and possessing extensive experience in the science of hydrology and hydrogeology,has not been provided with this submission,as required by this section. Addressed. General Site Plan/Drainage Comments 6. VHB suggests adding a north arrow to the plan. Addressed. 7. The Applicant should provide sizing calculations for the proposed infiltration system,it is unclear how the size of the system(as shown on the plan)was determined. Addressed. 8. Have test pits been taken at the location of the proposed infiltration system? The Applicant should verify that there is a 2-foot separation between annual high groundwater and the bottom of the infiltration system. Partially addressed. The test pit location is shown on the plans, however it does not appear that the resulting information has been added to the plans. 9. The Deep Sump Catch Basin detail specifies a frame and cover,a frame and grate should be specified. Addressed. 10. The Applicant should specify the material thicknesses of the driveway pavement and gravel on the Bituminous Curb—Type"A"(BC)detail. Addressed. 11. The Stone Retaining Wall detail specifies 2-inch PVC pipes every 15 feet,on center,however it appears the proposed walls on the west side of the house are only 10 feet long. Addressed. 12. The Applicant should clarify the use of the proposed retaining walls on the west side of the house. It does not appear that any grade changes are required at this location. Addressed. 13. The Applicant should specify the inverts,materials and length of the pipe connecting the proposed catch basin and the proposed infiltration system. Partially addressed. The Invert Out of the proposed catch basin appears to be missing. 14. Is the infiltration system designed to completely capture/infiltrate the first inch of runoff from the new impervious areas, or to detain it to mitigate peak runoff rates? Addressed. 15. Is an outlet/overflow pipe proposed for the infiltration system, or is it the intent to allow runoff to backup through the catch basin and flow overland to the adjacent wetland? Addressed. 16. The plan graphically shows the infiltration system to have 24 units(4 x 6),however the Storm Tech SC-310 Infiltrator detail specifies"10 units wide x2 units deep".
