Please note we submitted and withdrew an earlier watershed permit application because the cabana did not meet the 30-foot side setback requirement and proposed construction within 100 feet of a wetland area. To avoid the need for a zoning variance, the current plan locates the cabana outside the side setback area and locates all activities outside the 100-foot wetland protection or resource areas. See the current plan and correspondence from Wetland Preservation Inc. dated September 7, 2001, which reviewed and delineated the wetland resource areas. Richard Parquette, the town conservation administrator, together with a representative of Wetland Preservation Inc. verified the absence of a wetland resource area near the rear of the proposed construction location this week. Town of North Andover Planning Department Watershed Special Permit Project involves the construction of an inground swimming pool with surrounding deck, patio, and a cabana. The project will be completed to complement the architecture of the existing dwelling and the surrounding landscape. Neighborhood properties are well spaced so that enjoyment of the pool should not adversely affect abutters. It is intended that the project will add value to the existing property and the neighborhood. The number of occupants will remain constant so no change will occur to traffic congestion or concentration of population. Similarly no additional use of transportation, sewerage, schools, parks, or other public facilities will be needed. Water to fill the pool will be delivered by truck from a source outside North Andover. No increased reserving or use of other town amenities is anticipated. There is no reasonable alternative location outside the non-disturbance or non-discharge buffer zones for any discharge, structure, or activity associated with the proposed use to occur. September 7, 2001 Mr. Sal Vaudo 38 Salle Way North Andover, MA 01845 Re: Wetland Delineation and Site Review Dear Mr. Vaudo: Wetland Preservation,Inc. (WPI)recently reviewed your property to conduct a wetland delineation at your request. This letter is intended to document the results of this effort. As you are aware from our telephone conversation,WPI had completed a wetland delineation of the resource areas at the front of your property. This wetland delineation was completed in August of 2000 for a Notice of Intent filing for Lots 5 and 6 on Saile Way. The wetland areas located on or adjacent to your property include two"unclassified isolated drainage areas", which are jurisdictional resource areas under the North Andover Wetlands Protection Bylaw(NAWPB). They are non jurisdictional wetland areas under the Massachusetts Wetlands Protection Regulations(MWPR). The first of these areas is located just north of the entrance to your driveway and is marked by consecutively alphanumerically numbered pink flags J1 through J6. The second area is located north of this area and is consecutively numbered alphanumerically I1 through 112. A third area located on your property is a State,Federal and local jurisdictional resource area classified as Bordering Vegetated Wetland(BVW). This area is located on the southeast end of your lot and is consecutively numbered alphanumerically Cl through C9. A fourth resource area at the rear of the property was reviewed and was not delineated. No determination was made at the time of the inspection as to what type of resource area this was (BVW,isolated wetland, etc.); however, it was determined that the proposed work at the rear of the property was outside of the 100-foot buffer zone to this resource area.
