I have reviewed the materials sent to me regarding the proposal by Caren Jacobson and Blair Roberts to
expand their home at 814 Osgood Street in North Andover. Specifically,I reviewed their application for
a Special Permit under the North Andover Zoning Bylaw. This proposal appears to meet the
requirements of the Zoning Bylaw and will not have any adverse effect on the wetlands located opposite
the property or the water quality of Lake Cochichewick.
Proposed Work
The Applicant proposes to expand their existing dwelling by 492 square feet,by adding an addition and
a screened porch onto the northwest side of their house. The proposed work will be approximately 187
feet(slightly less)from the edge of Bordering Vegetated Wetland (BVW)located east of the house.
The applicant has not proposed to mitigate the increase in stormwater runoff from the addition.
However,the Applicant's engineer states that the rooftop runoff,which is considered to be
uncontaminated by the Massachusetts Department of Environmental Protection(DEP),will be recharged
into the ground. VHB agrees with this statement.
North Andover Watershed Protection District
The proposed work would occur within the 325-foot Non-Discharge Zone of the Watershed Protection
District. The 325-foot zone applies because the lot was created prior to October 24,1994. Under Section
4.136.3.B.iv of the Zoning Bylaw,in this zone,construction shall comply with best management practices
for erosion and siltation. VHB recommends the use of haybales and silt fence during the construction of
the proposed addition and screened porch to control sediment.
I reviewed the Special Permit Requirements in Section 4.136.4. Requirement C.iv requires the Applicant
to provide proof that there is no reasonable alternative location outside the Non-Discharge Zone for the
work. No portion of the applicant's lot is outside this zone,therefore there is no practicable alternative
to construct the addition outside this zone.

Special Permit Requirement 4.136.4.e states that no permit should be granted unless the Special Permit
Granting Authority determines that the proposed work will not significantly degrade the water quality
in or entering in the lake. The Applicant's engineer states that the increase in runoff resulting from this
construction will be treated by two BMPs(Best Management Practices);the existing catch basins on
Osgood Street and the existing wetlands. VHB agrees with this statement.
Given the site conditions and the distance to Lake Cochichewick,it does not appear that the proposed
work will harm the water quality of the nearby wetland or Lake Cochichewick.Therefore,from an
environmental/water quality perspective,I see no reason not to allow the proposed work.
