HomeMy WebLinkAbout2002-12-19 Board of Health Minutes NORTH ANDOVER BOARD OF HEALTH MEETING MINUTES Thursday—December 19,2002 7:00 p.m. DPW 384 Osgood Street North Andover,MA 01845 New Business Variance for Merrimack Valley Nutrition Project(Meals on Wheels Program) A variance is requested so that Food Manager does not need to be Food Safe certified. Carolyn Court is the Executive Director at Meals on Wheels. Meals are prepared in bulk at Greater Lawrence Technical School. The food cannot be less than 140 degrees. Training would be two days at$175 -$200 for training. Mr. Markey made a motion to approve the variance,and was seconded by Ms.Barczak. All were in favor of granting the variance. Meeting Minutes approval for November 19,2002 and November 21,2002 On November 19,2002,this Board held an Executive Session with regard to Rocket Entertainment's litigation with the Board of Appeals. On December 5,2002,the Board of Selectmen held a public meeting at which many of the issues discussed in this Board's November 19,2002 Executive Session were discussed. On December 16,2002,the Essex County District Attorney's office determined that this Board's November 19 Executive Session with regard to Rocket Entertainment litigation was held in full compliance with the Open Meeting Law. Nevertheless,as a result of the discussion at the Selectmen's December 5 public meeting and upon advice of Town Counsel that the Board of Appeals'position in the pending litigation would not be harmed by the release of the minutes of the November 19 Executive Session,I move that those minutes be approved and released to the public. Motion made by Ms. Barczak and seconded by Mr.Markey. All were in favor. Solid Waste Hauling Permit Placards—Review all original applications for Solid Waste Hauling to Covanta(Ogden Martin)in Haverhill and Wheelabrator in North Andover The Town of Middleton was determined as not exempt from paying the fee. They must pay. BFI was issued six placards for six trucks on an exempt status. Applications were reviewed individually. Mr.LaGrasse will follow-up with any necessary permitting. Trash Truck Regulation Amendments Under Item 4A,the North Andover Police Department is authorized to issue violation notices with copies to the Board of Health. The first fine is$300,the second fine is$500,and the third and subsequent violations will be$1,000. Mr.Markey made a motion to set forth the new regulations as written. The motion was seconded by Ms.Barczak. Old Business Ongoing Irrigation and Groundwater Well Drilling Moratorium The Advisory Board will meet and take a vote on this. Until that time,a moratorium will remain in affect. Mr. Markey made a motion to continue the moratorium. Ms.Barczak seconded the motion. All were in favor. Residents in attendance at the meeting had the following comments regarding Holt Road: Rick Catino of Barker Street—lives one mile from the Holt Road site. He prefers that a trash transfer station be instituted rather than a strip club. Doug Smith of 195 Barker Street—voices the same opinion of his next door neighbor,Rick Catino. Jim Connolly of 210 Bear Hill Road—he is the father of five small children and does not want the strip club in town. Mike Thomas of 53 French Farm Road—Would like to see other options for use of the Holt Road land. General Discussion Health budget and payment of bills MRI Account is setup so that before January first,the Town receives$25,000,and in June,another$15,000 is received,and an additional$10,000 is applied towards enforcement.This account helps Public Health by keeping in contact,and insuring the safety of the public.
