HomeMy WebLinkAbout1994-12-01 Board of Health Minutes BOARD OF HEALTH MINUTES DECEMBER 1, 1994 MEMBERS PRESENT: Gayton Osgood, Chairman, John S. Rizza, D.M.D. , Member, Sandra Starr, Health Administrator. Mr. Osgood called the meeting to order at 7: 15 P.M. APPROVAL OF MINUTES - 10127194: On a motion by Dr. Rizza, seconded by Gayton Osgood, the Board voted unanimously to approve the minutes of 10/17/94 as written. 7:15 P.M. - MASSAGE LICENSE - HEIDI RUTH BENNETT: On a motion by Dr. Rizza, seconded by Gayton Osgood, the Board voted to approve a massage license for Heidi Ruth Bennett. It was agreed to extend her license through December of 1995. 7.30 - RE UEST FOR VARIANCE FOR LOT 1 JOHNSON STREET: Scott Giles appeared for John Berube to request a variance to North Andover' s regulation requiring 100 feet to wetlands. The variance would be for a maximum of 75 feet from wetlands. It was also pointed out by Mrs. Starr that there would have to be a variance for the 4 feet between the active and reserve trenches in the leaching area. On a motion by Dr. Rizza, seconded by Gayton Osgood both these variances were approved unanimously for Lot 1 Johnson Street. REQUEST FOR SEPTIC SYSTEM DESIGN EXTENTIONS_ The Board voted unanimously to grant one year extentions on the septic plan approvals for Lots 1, 2 , 4 , 5, 6, 7 , 8, 9, 10, 11, 12 , 14, 16, 20 and 21 to December 1, 1995. WAIVED FEES DISCUSSION: It was agreed to waive the fee for the Festival Committee, and to extend the licenses for Rising Sun, septic installer, Charles Zaher, and The Upper Crust through December 31, 1995. As an aside Mrs. Starr stated that for 1995 she would like to offer septic installer tests on a quarterly basis. The Board felt this was acceptable. DISCUSSION FAILED SEPTIC SYSTEMS AT 86 WILLOW RIDGE_ ROAD, 200 BRADFORD STREET 19 BOXFORD STREET: 200 Bradford - Mrs. Starr updated the Board on the status of this failure. New plans have been received with requirements for variances to: North Andover regulations for minimum design rate of 660 gallons per day and minimum septic tank size. and Title V regulations for distance to groundwater (3 feet instead of 4 feet) , percolation rate greater than 20 minutes per inch for leach fields; percolation rate greater than 30 minutes per inch; no reserve area; breakout slope requirements not met. The Board voted unanimously to grant these variances conditional upon the State's review. 19 Boxford Street - Mrs. Starr stated that the leach area is in failure and that a slab foundation has been poured on top of the septic tank. The tank must be disconnected from the house plumbing, filled with sand and abandoned. New plumbing from the house must be installed and a new septic tank of 1500 gallons installed. It was agreed that repairing the failed leach area and the installation of the tank could be done in phases. 86 Willow Ridge Road - Mrs. Starr updated the Board on the status of this repair and read the letter from DEP denying the previous plans. New plans have been submitted today and will be discussed at the next meeting. DISCUSSION - HOUSING COMPLATINTS: Two complaints at Heritage Green on Fernview Avenue at #6 and #40 for various housing complaints. One appears close to closure. Mrs. Starr updated the Board. UPDATE ON THE NEW BETTERMENT BILL: Mrs. Starr reported on the meeting she attended concerning the new betterment bill which allows Board of Health to effect repairs for failed septic systems, lead removal, etc. and to pay for same. This new bill allows home owners to repay these costs over a period of up to twenty years. There must be a specific line item for the funds. It is possible to float a bond as well. Town Meeting would have to approve this. A decision must be made whether to place this on the warrant article. ADJOURNMENT: The meeting was adjourned at 8: 00 P.M. Rizza, D.M.D. , Member, Sandra Starr, Health Administrator, Susan Ford, Environmental/Health Inspector. Mr. Osgood called the meeting to order at 7 : 12 P.M. 7: 15 P.M. - MASSAGE THERAPY LICENSE - KIMBERLY ADAMI Ms. Adami stated that she would be filling in at New Bodies for 3 months while another employee is on leave and that she would also be working at North Andover Chiropractic at 1060 Osgood Street. On a motion by Dr. MacMillan and seconded by Dr. Rizza the Board unanimously voted to approve her license. OTHER BUSINESS• Extension for Lot 3A Summer Street The Board voted to grant an extension on the septic plan approval for Lot 3A Summer Street to January 4 , 1996. This is to be the final extension for these plans. Variances for septic repair at 86 Willow Ridge Road On a motion by Dr. Rizza, seconded by Dr. MacMillan, the Board unanimously voted to grant the following variances for the repair of the septic system at 86 Willow Ridge Road: 1 - Depth to groundwater less than 4 feet - North Andover regulation 17 . 02 , Title V, 310 CMR 15 . 14 (2) 2 - Only 3 feet of parent material - 310 CMR 15 . 03 (6) 3 - Distance to subsurface drain 44 feet - North Andover 4 . 18 4 - Distance to wetlands 60 feet - North Andover 4 . 18 5 - No reserve area - North Andover 17 . 08 , 310 CMR 15 . 14 (8) 6 - Distance of septic tank to cellar only 15 feet - North Andover 4 . 18 7 - 1000 gallon tank less than 150% of capacity - North Andover 9 . 01, 310 CMR 15. 06 (1) DISCUSSION OF TOBACCO CONTROL REGULATIONS: The Board discussed the proposed tobacco regulations and made the following recommendations for changes: Under Section 3A, line 8 Prohibition on Smoking in Public Places Beginning "One year after the adoption of these regulations . . . and ending "will be in force. " shall be deleted. The sentence beginning "Seating shall be so situated. . . and ending "in nonsmoking areas. " shall be replaced with "Physical barriers, separate rooms or powerful ventilation systems shall be used so as to eliminate smoke in nonsmoking areas. " A line shall be added stating that food establishments under 35 seats shall be exempt from these regulations with the exception that they will be expected to comply with the 100% ban on smoking by the year 2000.
