MINUTES
OCTOBER 26, 1995
Mr. Osgood called the meeting to order at 7 : 30 p.m.
MEMBERS PRESENT:
Gayton Osgood, Chairman, John S. Rizza, D.M.D. , Member, Susan Ford,
Environmental Inspector, and Sandra Starr, Health Administrator.
VARIANCE REQUEST TO TITLE V SEPTIC SYSTEM INSPECTION - 112 ABBOTT
STREET:
Mr. Christopher Kaddaras, owner of property was present and
requested to come before the Board for a variance to Title V septic
system inspection. The Board Members received a letter from
Timothy J. Wilett, Staff Engineer from Department of Public Works
stated that construction of Abbott Village Estates should start
within a couple of weeks. As a result, several residences will
have access to sewer main, which includes 112 Abbott Street.

On a motion by Dr. Rizza, seconded by Mr. Osgood, the Board voted
unanimously to grant a variance to Title V Septic System Inspection
at 112 Abbott Street.
REQUEST FOR A MASSAGE ESTABLISHMENT LICENSE - NORMA GALLANT, 249
MARBLERIDGE ROAD, NORTH ANDOVER, MA:
Ms. Gallant is a Licensed Practical Nurse and practices massage
therapy from her home at 249 Marbleridge Road, North Andover, MA.
Mrs. Starr stated that she had inspected the facility and found it
to be entirely appropriate and professionally run.
On a motion by Dr. Rizza, seconded by Mr. Osgood, the Board voted
unanimously to grant Norma Gallant, 249 Marbleridge Road, North
Andover, a Massage Establishment License
DAVE KINDRED - VARIANCE REQUEST TO NORTH ANDOVER'S MINIMUM
REQUIREMENTS FOR THE SUBSURFACE DISPOSAL FOR SANITARY SEWAGE -
DESIGN FLOW - LOT #2 LOST POND LANE:
Dave Kindred, Owner was present and requested to come before the
Board for a variance to North Andover Minimum Requirements for the
Subsurface Disposal for Sanitary Sewage, Design Flow from 660 gpd
to Title V' s requirement, 110 gpd for Lot #2 Lost Pond Lane.
On a motion by Dr. Rizza, seconded by Mr. Osgood, the Board voted
unanimously to grant a variance to North Andover' s Minimum
Requirements for the Subsurface Disposal for Sanitary Sewage,
Design Flow from 660 gpd to 110 gpd.

CHRISTIANSEN & SERGI - VARIANCE REQUEST - LOT #5 SEVEN OAKS:
Mr. Phil Christiansen was present and requested to come before the
Board for a variance to the North Andover Minimum Requirements for
the Subsurface Disposal for Sanitary Sewage Design Flow from 660
gpd to 110 gpd for Lot #5 Seven Oaks.
On a motion by Dr. Rizza, seconded by Mr. Osgood, the Board voted
unanimously to grant a variance to north Andover' s Minimum
Requirements for the subsurface Disposal for Sanitary Sewage,
Design Flow from 660 gpd to 110 gpd.
HIRING A PUBLIC HEALTH NURSE:
The Board Members reviewed the job description and all agreed to
have Mrs. Starr bring it before Mr. Kevin Mahoney for his approval.
NORTHWOODS COUNTRY GRILL:
Mrs. Starr stated that she received a notice from DEP stating a
Notice of Noncompliance was issued to Northwoods Country
Grill/Willows Racquet & Fitness Centre citing unauthorized use of
an unapproved well as a source of Public water supply in violation
of 310 CME 22 . 00, "the Drinking Water Regulations of
Massachusetts. "
The Board Members directed the Health Administrator to send a
letter to Northwoods and hand-deliver the letter.
APPROVAL OF MINUTES - 9/28195:
On a motion by Dr. Rizza, seconded by Mr. Osgood, the Board voted
unanimously to approve the minutes of 9/28/95 as written.
SICK BUILDING - TOWN HALL ANNEX:
A brief discussion ensued in reference to the recent problems in
the office building, i.e. mold, mildew and no fresh air exchange.
Ms. Starr mentioned that an environmental study is being conducted
at the present time.
HEALTHY COMMUNITIES:
Ms. Starr mentioned that Healthy communities will be conducting
another compliance check.
1160 SALEM STREET:
Mr. Osgood inquired as to what was happening with the Voris
property. Ms. Starr stated that no word had yet come from Town
Counsel.

DEP TRAINING FOR BOARD MEMBERS:
Ms. Starr mentioned that a DEP training course will be offered on
Thursday, November 16 in Haverhill from 7 p.m. - 9 : 00 p.m. if any
of the Board members are interested.
NEXT MEETING DATE:
The next Board of Health meeting will be held Thursday, November
30, 1995. This will be a week later then scheduled because of
Thanksgiving.
874 SALEM STREET - REQUEST FOR WAIVER TO SEWER TIE-IN - FINANCIAL
HARDSHIP:
Ms. Starr stated that she received a letter from the owners of 874
Salem Street requesting a waiver to sewer tie-in because of
financial hardship. Mr. Osgood mentioned that the system at 874
Salem Street is an old system, approximately 15 years old. Mr.
Osgood pointed out that the Board could only grant a waiver on the
time limit to tie-in to sewer. The Board could not just say
someone did not have to tie-in at all.
The Board Members suggested that Ms. Starr do some follow-up on
this and come back before the Board. No action taken.
ADJOURNMENT:
On a motion by Dr. Rizza, seconded by Mr. Osgood, the Board voted
unanimously to adjourn at 8:30 p.m.
