In accordance with General Condition 14 and 41 of the Superseding Order of Conditions we are requesting that the Department amend the existing Order of Conditions to reference the enclosed revised plan as the record plan for the project. We have placed a legal ad in the local newspaper as required; please find attached proof that the newspaper received the legal ad request. The original project involved the razing of all existing structures on the property and the construction of a new dwelling, deck (with gravel base storage area underneath), driveway, walkway, stone wall and associated grading and site work. The project complied with all aspects of the Wetlands Protection Act. Our client has a potential buyer for the property and the potential buyer would like to modify the proposed site plan by re-designing the dwelling to have a front entrance garage under design. The actual foundation of the proposed dwelling would be slightly smaller than the approved dwelling since the garage doors would be recessed one foot. Adding a front entrance garage to the structure moves the proposed paved driveway approximately 26 feet further away from the wetlands to the north than what was approved (41 feet vs. 15 feet). Re-locating the driveway to the front of the dwelling allows us to now propose a buffer zone enhancement area of approximately 380sf on the northerly side of the proposed dwelling. The proposed driveway will be pitched so that runoff from the driveway will flow towards the wetlands to the north. The additional overland flow length will provide additional treatment to the runoff than what is currently approved. The proposed 12 foot x 14 foot deck will be replaced with a 12 foot x 14 foot screen porch which is located slightly further to the south than the proposed deck. The proposed screen porch would be 17 feet from the wetlands which is still 5 feet further from the wetlands than the existing garage that is proposed to be razed. Approximately 64 linear feet of drip trench is now proposed to promote infiltration of roof runoff. The original paved walkway along the side of the proposed dwelling is now replaced with a proposed flagstone walkway. The new proposed impervious driveway, walkway and flagstone walkway configuration is approximately 20sf less in size than the approved impervious driveway and walkways (1,050sf+/- vs. 1,030sf+/-). A 3 foot high (max.) retaining wall is proposed at the front of the dwelling, and the existing utility pole in front of the dwelling is proposed to be relocated to accommodate the proposed driveway location. Utilities shall be provided underground from the proposed pole location to the proposed dwelling. Based on the information above we believe that the proposed design changes will not have any adverse impacts on the wetland resource areas and that the proposed changes will enhance the protection of the wetland resource areas. We believe that the scope of the changes does not warrant the filing of a new Notice of Intent and request that the Department issue an amendment of the original Superseding Order of Conditions referencing the enclosed revised plan as the record plan.
