NORTH ANDOVER March 21,2012 CONSERVATION COMMISSION Conservation Commission 1600 Osgood Street North Andover, MA 01845 Re: DEP File No. 242-1480 14 Lorraine Avenue Dear Commission Members: Please find enclosed a revised site development plan for the above referenced property which has been modified based on comments your Agent received from the Department of Environmental Protection (DEP). It appears the DEP contacted your agent after the last plan, revision date Feb. 1, 2012, was submitted and stated that the DEP has a policy not to allow filling of wetlands to extend a yard, and if the Commission issues an Order of Conditions allowing the filling of wetland to expand the yard the DEP will appeal the permit. The DEP has all the correspondence, plans and the alternatives analysis and is standing fast to their policy. As you may recall one of the benefits of extending the yard was that it also created the ability to provide a buffer between the usable yard and the wetland where currently the yard extends to the wetland edge. Based on the DEP's comments we have revised the plan to eliminate the filling of any wetland. The proposed site development remains the same as previously shown on the plan revised to Feb. 1, 2012 and we have also retained the proposed 10 foot wide buffer area between the wetland edge and the proposed wall upslope of wetland flags WF96-WF99. The closest point of the proposed structure to the wetland edge is 18 feet which is from the deck; this is the same distance as the setback from the existing dwelling to the wetland. The existing detached garage, which is 12 feet from the wetland, is still proposed to be razed. We have proposed a boulder wall upslope of the wetland edge to prevent any future encroachment into the wetland. We look forward to meeting with the Commission at your next regularly scheduled meeting on March 28,2012 to further discuss this matter.
