MAY 2 8 8W N0R H ANQOVFFR CONSERVATION COMMISSION May 28, 2010 Conservation Commission 1600 Osgood Street North Andover, MA 01845 Re: 14 Lorraine Avenue—Notice of Intent Narrative Dear Commission Members: Our office was contracted by Peter Breen to assist him with the filing of a Notice of Intent to develop his lot at the above referenced property. There is currently an existing dwelling and garage on the property. Portions of the house and almost the entire garage are within the 25 foot no disturb zone to a large bordering vegetated wetland that exists on the property. Mr. Breen is proposing to remove the existing structures on the property and to construct a new single family dwelling on a more suitable portion of the property. In order to access the proposed house location a portion of the resource area will need to be altered. The resource area on the property is a large bordering vegetated wetland. The soils are well drained but because of the high water table the hydrology is such that it supports a predominance of wetland vegetation. We are proposing the wetland crossing in the narrowest point of the wetland to minimize wetland impacts. The wetland does slope towards Andover Street so we are proposing a series of culverts to allow surface water to flow freely under the proposed driveway. We have designed the driveway so that it is 10 feet wide with 3 foot grass shoulders and then a 3:1 slope. The grass shoulders will provide room for the proposed utilities as well as a guard rail. There is no practicable alternative available that will allow access to the upland portion of this property without altering wetlands. We are proposing to replicate wetlands in accordance with the North Andover Conservation Commission Replication Guidelines as well as the Department of Environmental Protection Replication Guidelines. The replication proposed is at a 2:1 ration in accordance with your regulations. In September 5, 2006 an Enforcement Order was issued for the unauthorized tree clearing and illegal filling of a jurisdictional wetland resource area. Our office submitted a report, dated September 22,2006, and a restoration plan, dated September 21, 2006, as required. Following submittal of the report and restoration plan we received an Addendum to the Enforcement Order from Pamela Merrill dated September 28, 2006. The addendum set forth certain dates that specific activities were to be completed by: • All stockpiled logs and debris shall be removed from the site and disposed of properly. All fill within the wetland resource area and its associated buffer zone shall be removed until the original soil surface is evident. A Professional Wetland Scientist shall verify and confirm that this has been successfully completed. This task was completed in the fall of 2006. • Upon completion of the above action items, the disturbed areas shall be immediately stabilized with a fast growing seed mix for winter stabilization. This was never done. The areas received snowfall that covered the ground into the following spring. We consulted with the agent at the time and it was determined that as long as there was no risk for erosion and sedimentation, there was no need for seeding. • Once spring weather conditions are appropriate, the restoration planting scheme shall be immediately implemented in order to take full advantage of the spring, summer and fall growing seasons. Concurrently, the drainage ditch shall be reconstructed to mimic pre- existing site conditions. This was done during the spring of 2007. • Immediately after the mitigation efforts are completed, the wetland scientist shall prepare an initial inventory report detailing the types and number of plant species installed, as well as amount of seed mix that was broadcasted throughout the area. The following list of species was planted in the spring of 2007: 7— Red Maples (Acer rubrum) 2— Gray Birch (Betula populifolia) 31 — Highbush Blueberry (Vaccinium corymbosum) 23 — Winterberry Holly (Ilex verticillata) 11 — Sweet Pepperbush(Clethra alnifolia) 16— Northern Arrowwood (Viburnum dentatum) Conservation Commission Page 3 May 28, 2010 2— Red-osier Dogwood (Cornus sericea) 13 — Cinnamon Fern(Osmunda cinnamomea) 9— Sensitive Fern(Onoclea sensibilis) 5 Pounds of New England WETMIX I Pound of New England Conservation/Wildlife Seed Mix • The Weiland Scientist shall also monitor the wetland and buffer zone restoration areas for two consecutive growing seasons. Monitoring reports shall be submitted to the Conservation Cepartment at the end of each growing season (spring and fall). A total of four monitoring reports for the restoration areas shall be submitted over a 2-year period Monitoring reports shall describe, using narratives, plans and color photographs, the physical characteristics of the wetland and buffer zone restoration areas with respect to stability, survival of vegetation and plant mortality, aerial extent and distribution, species diversity and vertical stratification, and the amount of invasive species in the at-ea. If at the end of the second growing season, or at any time within the 2-year growing season period, it has been determined that a 75%success rate has not been achieved, the NACC shall require additional mitigation measures, such as additional plantings. To date only I of the required reports has been submitted, Spring 2008. Our client has contracted with us to start up the monitoring again until completion. Ideally,replication areas should not depend on precipitation and sheet runoff flow only,but must have a seasonal source of groundwater and should have a surface water source as well. Perched wetlands may be established without these latter inputs,but monitoring wells or piezometers should demonstrate that runoff and precipitation inputs would exceed infiltration rates into the summer. [� Demonstration that groundwater and surface water will have unrestricted hydraulic connections to the replication area; ® Only the flood storage that the existing BVW provides should be designed in the replication areas; j; 3. Soils-the narratives and plans should include the following information: E �}►�► ❑ Test pits of translocated soils including horizons, characteristics such as texture, organic matter, 5 Munsell hue, value and chroma, consistence and evidence of hydrologic influence, e.g.mottles (frequency and color), gleying, and root depth; Replication areas should have a minimum of 6-12" of A-Horizon soil. If used, soil amendments or the A-Horizon consist of equal volumes of organic and mineral materials. No woodchips should be used, and organic material should be well or partially decomposed. LP Enough A and B-Horizon material (or A over a suitable composition of the C horizon) should be provided to create a suitable rooting medium, and to approximate the conditions at the nearest undisturbed existing wetland. Consistency should be loose to friable and texture should be loamy sand to silt loam. N1 Although not required use of Redox and pH Meters in the replication area and adjacent f, wetlands may aid in replication success. Seek guidance of a professional experienced in this testing. op ❑ A detailed schedule for collection, stockpiling and placement of soils, including a discussion of techniques used to prevent the drying out and contamination of hydric soils.
