The PLANNING BOARD held a special meeting on Monday evening,
March 17, 1986 in the Senior Center. The meeting was called to order
at 7:50 p.m. with the following members present and voting:
Michael P. Roberts, Chairman; Paul A. Hedstrom,
Vice-Chairman; John J. Burke and John Simons.
Karen Nelson, Planner was also present.
PUBLIC HEARINGS
Smolak (Residential 2 to Business 1)
John Simons read the legal notice.
following facts:
John Smolak stated the
- Parcel involves approximately 2 3/4 acres on South Bradford
~Street.
- He wishes to sell Christmas trees during the holiday season and
he must grow more than 51% of his produce in order to sell it
at his farm stand.
- Mr. Foster, Zoning Inspector advised him to rezone this parcel
to conform to zoning regulations.
- He plans to expand in the future and build up this type of
business.
Might be able to obtain a variance from the Zoning Board of
Appeals to solve his problem in the short run.
Planning Board members John Simons and John Burke did not favor
this type of spot zoning. Abutters from South Bradford Street and
Bridal Path were oppossed to Mr. Smolak's article. They remarked that
if Mr. Smolak sold his farm, a Cumberland or Richdale convenience
store could locate on that rezoned parcel.
A meeting has been scheduled with Town Counsel, Mr. Smolak and
Karen Nelson, Town Planner to review other options available to Mr.
Smolak.

Lundquist (Residential 2 to Business
John Simons read the legal notice. Mr. George Barker, father of
the petitioner, explained his reasons for wanting this parcel rezoned.
The parcel is at 1267 Osgood Street and contains approximately 2
acres. He finds himself in the same dilemma as Mr. Smolak. The
surrounding property is zoned Industrial, General Business and
Residential mix. Mr. Barker also stated that he was rezonlng because
of Mr. Foster's recommendation.
Motion: By John J. Burke to take the matter under advisement.

Barker (Industrial 1 to Residential 2)
John Simons read the legal notice. Mr. George Barker, the
petitioner, stated that he wishes to rezone approximately 2 acres to
Residential 2 at 1341 Osgood Street.

action on this article.

North Andover Realty Trust (Industrial 1 to Residential 2)
John Simons read the legal notice. No one from North Andover
Realty Trust was present at the public hearing.
Motion: By John J. Burke to continue the hearing until Thursday,
March 20, 1986.
Second: Paul A. Hedstrom.
Vote: Unanimous.
Angus Realty (General Business & Residential 2 to Business 4)
John Simons read the legal notice. Attorney Tom Caffrey was
present to make the following statements and answer questions: The
parcel is located on Salem Turnpike and contains 5.4 acres. He stated
that it is in the best interest of the Town to have it rezoned. It
will eliminate a General Business zone. The site is presently a
hodgepodge of zoning districts - B-4, R-2 and GB. There are no plans
at the present time to develop the site.
Motion: By Paul A. Hedstrom that the Planning Board take unfavorable
action with regard to this article.
Second: John Simons.
Vote: Unanimous.
Farlnelli (Residential 2 to Residential 5)
John Simons read the legal notice. Ms. Farinelli made the
following comments about the proposed rezoning:
- Parcel contains 24 acres on Mill Rd.; currently known as Clay
Pit Hill.
- Plans to build 80 Townhouses which will sell for approximately
$300,000.
- The site now has derelicks hanging out there.
- The Townhouses would benefit the rest of Mill Rd.
Motion: By Paul A. Hedstrom that the Planning Board take unfavorable
action with regard to this article.
Second: John Simons.
Vote: Unanimous.
Stack (Industrial 1 to Residential
John Simons read the legal notice. Attorney William Langone '
represented the petitioner. The parcel to be rezoned contains 20,000
square feet on Berry Street and was purchased in 1962. Mr, Stack, he
said, would like to rezone the parcel to conform with the adjoining
house lots. John Burke recommended that the petitioner change the
zoning district to read R-2, since there are no R-1 districts in Town.

Cardello (Industrial 1 to Residential 2)
John Simons read the legal notice. Mr. Cardello explained to the
Board that his parcel on Berry Street was similar to Mr. Stack's and
that he wished to rezone for a residential use.
