1. The Applicant, Timothy R. Sullivan, seeks a Special Permit from the Zoning
Board of Appeals in order to convert his single family personal residence
into a two family residential dwelling on Belmont Street, in a Residence 4
Zoning District;
2. The specific site is an appropriate location for a two family dwelling since it
is an allowed use in an R-4 Zoning District, by Special Permit from the
Zoning Board of Appeals (Section 4.122, Subsections 14A, B and D) and is
in an neighborhood of multi-family dwellings;
3. The proposal will create a second residential unit which will result in no
nuisance or serious hazard to vehicles or pedestrians and will not change soil
conditions or topography. It will increase the tax base and provide
additional housing without developing vacant land. It will provide off-street
parking for the additional residential unit;
4. The proposed use is allowed in an R-4 Zoning District by Special Permit
from the Zoning Board of Appeals;
5. The use is in harmony with the purpose and intent of the Zoning By-Law
since it is an allowed use in the Zoning By-Law;
6. The existing residence is a pre-existing non-conforming structure and the
requested change to the side line setback must be approved by a Special
Permit from the Zoning Board of Appeals. The proposed residential
structure will be in conformity with the requirements of Section 4.122 of the
Zoning By-Law, and is consistent with the recommendations of the North
Andover Master Plan.
