The North Andover Board of Appeals held a public hewing at the Town Hall,at 120 Main Street,North Andover,
MA on Tuesday,May 12,2015 ar 7:30 PM on the application of Steven and Patricia Derocher for property
located at 56 Beverly Street(Map 9,Parcel 33),North Andover,MA 01845. Petitioner is requesting a Special
Permit from Section 9.1 of the Zoning By-laws for a pre-existing non-conforming structure or uses however may be
extended or altered and also Variances from Table 2(Dimensional Requirements)for one rear yard setback and
two side setbacks(left and right)in the R-4 Zoning District,to raze the old garage and construct a new garage.
Legal notices were sent In all the certified abutters provided by the Town ofNorth Andover,Assessors Office,and
were published in the Eagle-Tribune,a newspaper of general circulation in the Town ofNotth Andover,on April 28,
2015 and May 5,2015.
The following regular voting members were present:Albert P.Manzi 111,Ellen McIntyre,Richard J.Byers,D.Paul
Koch Jr.,and Allan Cuscia and Associate Member Deney Morganthal.
Byers made a motion to Grant the Special Permit from Section 9.1 of the Zoning Bylaw for a pre-existing non-
conforming structure or uses however may be extended or altered at 56 Beverly Street(Map 9,Parcel 33),to
allow construction for a new garage and to mze the old garage.

The Board finds that this use, as developed by the building and site plans, will not adversely affect the
neighborhood. There will be no nuisance or serious hazard in vehicles or pedestrians, since there is provisions for
the required off-street parking. Adequate and appropriate facilities are provided to the existing residential dwelling
and will be provided for the proper continued operation of the newly constructed garage. The Board finds that this
garage will not be substantially more detrimental, and that this use, to allow for the proposed garage is in harmony
with the general purpose and intent of this Bylaw.

Purpose: Letter supporting request for variance &/or special permit due to the property shape (hardship). The lot is
undersized(9,385 sq.ft.)for the R-4 zoning district.(12,500 sq.ft. required)and the 50 foot lot width is restrictive.
Project: Raze existing nonconforming garage and construct new less non-conforming garage
A) When the survey of the property was completed it was found that the existing non-conforming structure is
actually encroaching 1.3 feet onto property at 58 Beverly Street.
B) Due to the location of the proposed garage we are requesting a variance &/or special permit. The new
garage will be less non-conforming to current R4 zoning setback requirements.
.Background:
1) The existing 85 year old structure is encroaching on property at 58 Beverly Street and in need of repair /
replacement
2) The existing rear wall is a concrete block retaining wall that is failing & cracked due to tree roots pushing the
wall forward.
A) Movement of the rear concrete block wall has also caused the front wall to bow
B) The shed type"flat"roof is weakened&leaking
Q The concrete floor is damaged & cracking due to water leakage (freezing & thawing) through the
rear wall and from the roof.
3) We have safety concerns regarding "snow load" and the rear of the existing garage roof is three feet above
ground level where people or animals might climb onto the roof.
Plan:
11 Reconstruct garage.Move foundation off of 58 Beverly Street property.
2) New construction will have poured concrete retaining walls(three sides).The rear wall is to be located forward
three feet from existing. The two side walls will be repositioned so they will be located fully within the property
lines of 56 Beverly Street.
3) The new concrete pad (floor elevation) will be one foot lower than current floor to better match the grade of
the yard.
4) Proposed front wall,gables&roof are to be of steel construction.
Benefits are;
Fire: reduced fire hazard on the structure which is located close to neighboring properties.
Safety: No easy access for people and animals to climb onto the roof
at the rear of the building.

The Board finds that owing to circumstances relating to soil conditions, shape, or topography of the land or
structures and especially affecting such land or structures,but not affecting generally the zoning district in general,a
literal enforcement of the provisions of the Bylaw will involve substantial hardship, financial or otherwise, to the
petitioner or applicant. The Board finds that desirable relief may be granted without substantial detriment to the
public good and without nullifying or substantially derogating from the intent ofthe purpose of this bylaw.
The Board also finds that this use, as developed by the building&site plans, is an appropriate location for such a
use and will not adversely affect the neighborhood. There will be no nuisance or serious hazard to vehicles or
pedestrians,since there are provisions for the required off-street parking. Adequate and appropriate facilities will be
provided for the newly proposed garage. The Board finds that the proposed garage will not be substantially more
