The North Andover Board of Appeals held a public hearing at The Senior Center,at 120R Main Street,
North Andover,MA on Tuesday,June 19, 2012 at 7:30 PM on the application of Donna Taylor for 11
property located at 59 Bonny Lane(Map 62,Parcel 56),North Andover, MA 01845. Petitioner is
requesting a Variance and Special Permit from Section 9,Non-Conforming Uses and Sections 9.1, 9.2,
and 9.2.1 and also Table 2 of the Zoning Bylaws within the R-1 Zoning District to construct a Sunroom i
addition .
Legal notices were sent to all the certified abutters provided by the Town of North Andover,Assessors
Office, and were published in the Eagle-Tribune, a newspaper of general circulation in the Town of North
Andover, on June 5th and June 12th 2012.
The following voting members were present: Ellen P.McIntyre, Richard J.Byers and D. Paul Koch Jr. 1'
The following Associate members were present: Michael Liporto and Tyler Speck k
Upon a motion from Byers to GRANT the Special Permit to allow from Section 9, Non-Conforming
Uses and Sections 9.1, 9.2, and 9.2.1 of the Zoning Bylaws to construct a Sunroom addition, in the R-1
Zoning District.
With the following condition: that the "Notice of Decision-Watershed Special Permit-Waiver", from
the Planning Board to the applicant be submitted into the files, for 59 Bonny Lane(Map 62, Parcel 56).
Koch second the motion to Grant the Special Permit.
The following members voted in favor to GRANT the Special Permit: Ellen P. McIntyre, Richard J.
Byers, D. Paul Koch Jr.,Michael Liporto and Tyler Speck.
All voted in favor 5-0.
The Board finds that that owing to circumstances relating to soil conditions, shape, or topography of the ''`
land or structures and especially affecting such land or structures but not affecting generally the zoning
district in general, a literal enforcement of the provisions of the Bylaw will involve substantial hardship,
financial or otherwise, to the petitioner or applicant. The Board finds that desirable relief may be granted t
without substantial detriment to the public good and without nullifying or substantially derogating from t.
the intent of the purpose of this bylaw
The Board also finds that this use, as developed by the building and site plans, will not adversely affect 1'

the neighborhood. There will be no nuisance or serious hazard to vehicles or pedestrians since there are

provisions for the required off-street parking. Adequate and appropriate facilities are provided to the i
existing residential dwelling for the proposed addition of the Sunroom to be constructed. The Board finds
that the sunroom will not be substantially detrimental to the existing single-family dwelling and to the
neighborhood and that this use, of a sunroom will be in harmony with the neighborhood and general
purpose and intent of this Bylaw.

Notes:
1. This decision shall not be in effect until a copy of this decision is recorded at the Essex County Registry of Deeds,
Northern District at the applicant's expense.
2. The granting of the Special Permit(s)as requested by the applicant does not necessarily ensure the granting of a building (
permit as the applicant must abide by all applicable local,state,and federal building codes and regulations,prior to the i
issuance of a building permit as required by the Inspector of Buildings. 1
3. If the rights authorized by the Special Permit are not exercised within one(2)years of the date of the grant,it shall lapse,
and may be re-established only after notice,and a new hearing.

Byers made a motion to Grant the Variance under Table 2 of the Zoning Bylaws, for the left side set
back of 10.5 feet to construct the addition of the sunroom in the R-1 Zoning District.
