At the March 13,2013 public hearing the North Andover Conservation Commission (NACC)
voted to issue a minor modification to DEP File #242-1470. The Modification shall conform
to the plans and documents referenced below.

Approved Modifications
• Removal of 1 dead tree within the 25'No-Disturbance Zone
• Removal of 2 trees within the existing yard area (in front of the hemlock hedge)
• Installation of porous pavers (either Techo-Bloc or Uni) in current stone dust parking area
Special Conditions
• The Conservation Department will be contacted prior to tree removal for a preconstruction
meeting with the tree contractor.
• Stumps may be cut flush or ground in place.
• Care will be taken not to damage nearby trees during the cutting process.
• Following tree removal,all disturbed areas shall be properly stabilized.
• Following installation of the porous pavers, the Conservation Department will be contacted
to conduct a post construction inspection.

Approved Modifications
Changes to proposed plan including conversion of impervious bluestone walk to stepping stones;

HISTORY AND BACKGROUND
On January 19, 2010, the Applicant, Robert Ercolini, filed an Application for Watershed Special
Permit with the Planning Board pursuant to Section 4.137 of the Town of North Andover Zoning
Bylaws. On March 2, 2010, the Planning Board unanimously voted to grant the Applicant a
Watershed Special Permit for the Premises Affected, and proceeded to issue a Special Permit
Decision approving the Project.
The applicant has submitted a revised plan, through his engineering company, Merrimack
Engineering Services of Andover, MA, dated March 26, 2010. The new plan was reviewed by
the Planning Board at their meeting on November 9, 2010, at which time,the board voted that
the changes made were did not warrant a modification to the original Special Permit.
The applicant has subsequently made additional changes to the plan, now dated May 9, 2011.
The changes made to the plan are as follows: r'
The following modifications/additions were made within the 100ft. Non-Disturbance Zone:
• A new landscaping wall area consisting of 64 sq. ft.
• New stairs and stepping stone walk with area of 302 sq. ft.
• New bluestone patio on a gravel base with granite steps with area of 275 sq. ft.
The stairs, stepping stone walk and landscaping walls will increase the impervious area by 366
sq. ft., all of which will be infiltrated using the proposed infiltration cisterns.

FINDINGS OF FACT e'
The new stormwater infiltration structure will mitigate the increase in impervious surface, thus
insuring that there will be no further degradation of water quality within the Watershed
Protection Zone.
CONDITIONS
The Town Planner's finding of no substantial change is conditioned on the following:
1
1. The applicant must show all changes on the final as-built plan, which must be provided to
the Planning Department before the bond is released, according to Condition#4, as stated
in the Special Permit Decision.
2. That this Decision is recorded with the Registry of Deeds and evidence of recording is to
be provided to the Planning Department.
Accordingly, Robert Ercolini may proceed with the proposed renovation project in accordance
with the Site Plans referenced in the Special Permit Decision, as modified by the plan and
adjustments referenced above.

• A new wall, comprising 242 sq ft. This wall is to be located in the same area of the
property where a `skateboard' ramp had existed.
• New stairs and a bluestone walk, comprising 258 sq. ft. The bluestone walk and patio
will be set on crushed stone with sand filling the joints.
• Two (2) infiltration cisterns for infiltration of the new patio area.
In addition to the above changes, there will be two (2) additional infiltration cisterns located
outside of the 100 ft. Non-Disturbance buffer area.
The above changes will result in a total of 10,380 sq ft. of impervious surface, as opposed to
9,602 sq. ft. shown on the prior plan.
