The North Andover Board of Appeals held a public hearing at The Senior Center, at 120R Main
Street, North Andover, MA 01845 on Tuesday, June 21, 2011 at 7:30 PM on the application of
Ray Von Realty Trust (Raymond Y. Cormier, Trustee) located on Lot#5 of Chatham Circle
(Map 47, Parcel 139)North Andover, MA 01845, Petitioner is requesting a Special Permit from
4.122 and 4.122.14 A.b to construct a new 2 family dwelling in accordance with Section 10.3
and 4.122.14D of the Zoning bylaw within an R-4 District
Legal notices were sent to all the certified abutters provided by the Town of North Andover,
Assessors Office,and were published in the Eagle-Tribune,a newspaper of general circulation in
the Town of North Andover,on November 30,2010&December 7,2010.
The following voting members were present: Albert P. Manzi, Ellen P.McIntyre, and Richard J.
Byers.
The following Associate members were present: Thomas Ippolito and Michael Liporto.
Upon a motion by Byers to Grant the Special Permit to build a 2 family(duplex)with the
following conditions:
1. The landscaping and exterior finish for the development of Lot 45 shall be equivalent
quality and materials to the landscaping and exterior finish originally furnished for the
existing Chatham Crossing units as approved by the subdivision plans as built.
2. All roof runoff from the building to be constructed on Lot#5 shall be infiltrated using the
appropriate methods and construction specified and approved by the North Andover
Building Inspector or his designees at time of building permit issuance.
McIntyre second the motion.
Those voting in favor to approve the Special Permit with the above conditions: Albert Manzi,
Richard Byers,Thomas Ippolito and Michael P. Liporto.
Not in favor to grant the Special Permit: Ellen McIntyre.

The Board finds that this use,as developed by the building& site plans,will not adversely affect
the neighborhood. There will be no nuisance or serious hazard to vehicles or pedestrians since

there are provisions for the required off-street parking.Adequate and appropriate facilities are
provided to the existing residential dwelling and will be provided for the pWIr,pperatiolkof a:

Notes:
1. This decision shall not be in effect until a copy of this decision is recorded at the Essex County Registry of Deeds,
Northern District at the applicant's expense.
2. The granting of the Special Permits)as requested by the applicant does not necessarily ensure the granting of a building
permit as the applicant must abide by all applicable local,state,and federal building codes and regulations,prior to the
issuance of building permit as required by the Inspector of Buildings.
3. If the rights authorized by the special Permit are not exercised within two(2)years of the date of the grant,it shall lapse,
and may be re-established only after notice,and a new hearing.

Special Permit Application for Lot 5,Chatham Circle
This petition seeks a special permit allowing for the construction and use of a two-family
residential dwelling in the Residential 4 Zoning District pursuant to Section 4.122.14.A.b
of the Bylaw, with respect to land located at 5 Chatham Circle ("Property"). The Property
is the final buildable lot of a 13-lot subdivision, whose definitive plan was endorsed in
2000 by the Planning Board. The Chatham Crossing subdivision plan was approved at a
time when two-unit dwellings were allowed as-of-right, and the subdivision was designed
to accommodate a two-unit building on each buildable lot. The Property is an internal
parcel within the subdivision, meaning that it is surrounded on all sides by other similarly
designed and constructed two-family dwellings. Like all of the other homes in the
subdivision, the two proposed units will be added to the existing Chatham Crossing
Condominium.
As shown on the submitted Site Plan and building plans,the applicant seeks approval to
construct a two-family dwelling upon the Property,which is an appropriate location for
such use. This lot was created and previously approved for just this purpose and the homes
that are envisioned will not create a nuisance or hazard to vehicles or pedestrians. The
work envisioned on the Property includes sidewalks for pedestrian enjoyment and two-car
garages (along with additional space for parking in the driveway) for each unit. With
respect to facilities,the proposed dwellings will allow for the proper operation of
residential living. As shown on the building plans,the units' architecture is well-designed
and attractive. The units will be serviced by the existing subdivision's utilities. The use
proposed for the Property will be in harmony with the purpose and intent of the Bylaw. It
is consistent with the North Andover Master Plan and furthers the Town's interest in
providing a range of housing stock. Moreover,these two-unit townhomes will compliment
the existing homes in the neighborhood and are consistent with the use of the site for a
purpose permitted in this district.
