The North Andover Board of Appeals held a public hearing at The Town Hall, at 120 Main Street,North
Andover,MA on Tuesday,November 12, 2013 at 7:00 PM on the application of Priscilla Wilson for
property located at 100 Colgate Drive(Map 74, Parcel 21),North Andover, MA. 01845. Petitioner is v
requesting a Special Permit from 4.122.22 of the Zoning Bylaw to allow for a Family Suite in the R-4
Zoning District. `'
Legal notices for the Special Permit were sent to all the certified abutters provided by the Town of North
Andover Assessors Office, and were published in the Eagle-Tribune, a newspaper of general circulation
in the Town of North Andover, on October 29 and November 5, 2013.
The following voting members were present: Richard J. Byers, D. Paul Koch Jr., and Allan Cuscia. The
following Associate members were present Michael Liporto,Doug Ludgin and Deney Morganthal.
Upon a motion by Cuscia to Grant the Special Permit from 4.121.22 of the Zoning bylaw to allow for a
Family Suite in the R-4 Zoning District at 100 Colgate Drive.
Koch second the motion to Grant the Special Permit.
Voting in favor to Grant the Special Permit: Richard J. Byers, D. Paul Koch Jr.,Allan Cuscia, Michael 1
Liporto, and Doug Ludgin.

The Board finds that this use, as developed by the building and site plans, will not adversely affect the
neighborhood. There will be no nuisance or serious hazard to vehicles or pedestrians since there is
provision for the required off-street parking. Adequate and appropriate facilities are provided to the
existing residential dwelling and will be provided for the proper operation of a Family Suite. The Board 1
finds that the Family Suite will not be substantially more detrimental than the existing single-family
dwelling to the neighborhood and that this use,to allow a Family Suite to the single family dwelling, is in
harmony with the general purpose and intent of this Bylaw.

The Board finds that the applicant has satisfied the provisions of Section 4.121.22 of the Zoning Bylaw in
order to allow for a Family Suite at 100 Colgate Drive(Map 74,Parcel 21),North Andover,MA,01845 in an I

1. This decision shall not be in effect until a copy of this decision is recorded at the Essex County Registry of Deeds,
Northern District at the applicant's expense.

2. The granting of the Special Permit(s)as requested by the applicant does not necessarily ensure the granting of a building
permit as the applicant must abide by all applicable local,state,and federal building codes and regulations,prior to the
issuance of a building permit as required by the Inspector of Buildings.
3. If the rights authorized by the Special Permit are not exercised within two(2)years of the date of the grant,it shall lapse, I-
and may be re-established only after notice,and a new hearing.
