Petitioner is requesting a Finding from the Zoning Board of Appeals in order to appeal the Inspector of Building's alleged failure to act upon the Petitioner's request for an enforcement action of alleged Zoning By-law violations by Sutton Pond Condominium(s) to fix a sewer pump station that is allegedly in failure and the applicant alleges that the station is out of compliance with all laws, regulations and permits. Legal notices were sent to all the certified abutters provided by the Town of North Andover, Assessors Office, and were published in the Eagle-Tribune,a newspaper of general circulation in the Town of North Andover,on September 29, 2015 and October 06,2015. The Building Inspector's October 2,2015 letter to the Petitioner's attorney stated: "The issue of the pumping station which is the subject matter of your Enforcement Request has been litigated,resulting in a Settlement Agreement,an Essex Superior Court Order and an Award of an Arbitrator. I do not have the authority to interfere with or over rule,that process so 1 respectfully decline to issue the Enforcement Order which you requested." Finally,you advised me that you were going to meet with members of your staff this week,preferably today,including the Health Department,to discuss the present code violations that exist with the sewer pump station as well as which department was ultimately going to enforce these code violations. Once these meetings were concluded with your staff, You were going to approach Sutton pond Condominium Trust and cite the violations as well as discuss with their engineer the necessary and immediate resolution to these violations. Please note that under the terms of the original Settlement Agreement with Sutton Pond,Mr.Smith was to review and approve the design of the retrofitted/replacement pump system. We also discussed the code violations as well as the history of this pump station where upon I agreed to send you a copy of TR-16. I am attaching a copy of TR-16 to this letter that is being sent to you via email. As a brief summary,when the developer was granted a special permit to develop the mill buildings into what is now Sutton Pond condominiums,he was also given a subdivision on the building and land that is now 146 Main Street. Pursuant to that special permit,the present pump station serving 146 Main Street was to be raised and a new pump station was to be constructed. The newly constructed pump station was to have the effluent from 146 Main Street pumped across the stream to the newly constructed pump station serving Sutton Pond Condominiums. As you are aware,that never happened. The original pump station was raised,but the Present pump station was constructed without permits,design or engineering,and its connection was not as stated on the special permit,but to the 100+year old main that flows uphill from 146 Main Street and connects to the main on 2°s and Main Street. Naminye D55crict 03r182015 10:42Patrol Officer Robed OSt ua Reviewed by Last Edit Date Hillner(141) oen 03/182015 On 3117115 at approximately 12:12pm this officer along with Officer Lawlor were dispatched to 1600 Osgood Street(or a disturbance call at the Board of Heaith called in by Michelle Grant of the Health Department on behalf of Susan Sawyer.The party involved was reported as a Mr.Gregory Smith who was accompanied by two females.The disturbance occurred initially at the Board of Health reception area,but was reportedly moved to the Building Inspectors area located within the same wnfines. Myself along with Officer Lawlor entered the building and met Mr.Smith in the doorway of the Building Inspectors office.We asked him along with his two female companions to come back Inside with us so that we may find out what the disturbance was all about.This officer engaged in conversation with Mr.Smith who at the time we met him was calm but stated he was quite frustrated with Susan Sawyer and the Board of Health in regards to a raw sewerage problem involving his place of business located at 146 Main Street. Mr. Smith indicated he was not getting any help from the Board of Health in relation to his sewerage problem.He has a 100 year lease of his property located at 146 Main Street which shares a sewerage ejection station with the condominiums located at 148 Main Street. The condo association is apparently responsible for the ejection system which has recently failed causing the intolerable odor of raw sewerage wilt the recent warm weather.Mr.Smith stated the ejection pump recently froze and now subsequently buret causing the current situation. Susan Sawyer interjected at this point and stated that his situation was not mine to solve as it has been an ongoing issue with lawyers involved for over a decade now on and off.She further stated that she only called the police to have him removed as he was causing a scene yelling and screaming.Mr.Smith was quite calm in the presence of both officers and I indicated to Susan Sawyer that I was simply hying to get a grasp of his situation and possibly assist him in what avenue to take or maybe she could assist in giving Mr. Smith the right avenue to pursue or agency to help him with the currant problem. It was evident to this oficar that in no way did Susan Sawyer wish tMr.Smith's o assist Mr.Smith in any way as she kept reiterating to this officer that this was an ongoing litigation and that I was not effort to reach came sort Of Possible in a day.I informed Susan Sawyer that I was gathering information from both parties involved in an possible resolution for Mr.Smith to pursue,but Susan Sawyer stated that the police were called only to keep the peace.In an effort to assist Mr.Smith Susan Sawyer was asked If there was anything she could do today to address Mr. Smith's current health complaint relating to the compromised ejection pump and subsequent raw sewerage odors,etcemm.Susan Sawyer stated that Mr.Smith could file a Complaint for Investigation and that only then would she go down to 14 completing same form,Mr.Smith was advised by Susan Sawyer that she had a meet .After ing from 1 pm- do but 14 she mould6 Main Street. down after that at 3pm.Mr.Smith stated he had an appointment at 2pm In Billerica,but that he would cancel same to meet Susan Sawyer at 3pm.Susan Sawyer was informed that the polka would accompany her when she went. Mr.Smith commented that he has supporting papervrork ofjudgment(s)against the Sutton Pond Condominium Association mandating the entity to repair or replace the system,but that the Association tlid not per" Ne no repairs or replacement of the ejection system as ordered by the court per the Board of Health speaflcatbns apparently involving the DEP also.Mr.Smith stated that an electrical permit was pulled to perform some of the work 2-3 years ago,but was not signed ori on by him as would be necessary. requested this permit from Gerald Brown o(Ihe Building Department who signaled Nis offkar to talk to him in private. It was at this point that Officer lawlar was released from the scene as we were down to minimum manning on our shift and that the situation was under control.I went back to speak with an Sawyer in her office followed by Michelle Granit of Me r shift of Health. Susan Sawyer immediately staled that I was only cellatl into protect her and Mat she only wantetl for us to remove Mr.Smith from the building.When asked ff she would call the station first prior to going doom to 146 Main Street al 3pm Susan Sawyer informedSmith this officer that she did not want to go.She further stated Mat she did not want to go tlown Mere with MIs oficar 9s she tett was siding with Mr.Smith.1 ay and t Susan Sawyer that I was only hying to assist Mr. Smith anti Mat I was certainly not taking sides as this was a civil mater anyway and that it was not uncommon for the police to do so in matters such as this.Susan Sawyer further stated that she wasn'trefusing to go down and meet at 3pm, which sheresponded,"No,h only that she did not want to. Susan Sawyer went on to say that she was threatened by Mr.Smith. I asked her if the threats involved anything physical in nature to lthey did nootf wantt MMr.Smits ttjust threatened to sue me and the Town."I informed Susan Sawyer and subsequently Gerald Brown that want coma to their offices anymore that they could consult the Town counsel in reference to a letter of trespass.Mr.Brown stated he just wanted Mr.Smith out of his office at this time. I also informed both parties that I would instruct Mr. Smith to correspond with Mr.Eric Kfoury,Director of Community Development,per the request of Susan Sawyer.Any in person visits it would be suggested that he call the police department first to have an officer meet him their to keep the peace.I was informed that Mr. Khoury was out sick from work today and therefore unable to be advised of this situation until Wednesday. This officer escorted Mr.Smith from the Town odloes along withthetwo females that were with him and work in his office. I informed Mr.Smith that I would be by with another officer for the 3pm meeting.
