Kellogg and 2nd by R Rowen to APPROVE the Site Plan Review Special Permit as amended and based upon the following conditions.Vote was 5—0 in favor of the application. /t 'lam half of the Noip Andover Planning Board Jo Simons,Chairman Richard Rowen Michael Colantoni Dave Kellogg Lora McSheny 1 North Andover School Department Site Plan Special Permit—Kittredge School Gymnasium The Planning Board herein APPROVES the construction of a 5,538 sq. ft. modular gymnasium on existing school properly, to be attached to the existing Kittredge School, with associated stormwater drainage and extended driveway in the Residential 4 District. This Special Permit was requested by lames Mealey,North Andover School Department. The application was filed with the Planning Board on September 6,2013. The public hearing on the above referenced application was opened on October 1,2013,and closed by the North Andover Planning Board on October 1, 2013. The applicant submitted a complete application, which was noticed and reviewed in accordance with Section 8.3, 10.3,and 10.31 of the Town of North Andover Zoning Bylaw and MGL C.40A,Sec.9. The Planning Board makes the following findings as required by the North Andover Zoning Bylaws Section 8.3 and 10.3: FINDINGS OF FACT: 1) The specific site is an appropriate location for the project as it consists of the construction of a 5,538 sq. ft. modular gymnasium on existing school property and will be attached to the existing Kittredge School,with associated stormwater drainage improvements and an extended driveway; 2) The use as developed will not adversely affect the neighborhood as the building has been situated in a location that will have the least amount of visual impact on the neighborhood as possible. The gymnasium will be attached to the existing school and will be located in rear portion of the school property; 3) There will be no nuisance or serious hazard to vehicles or pedestrians. The existing driveway will be extended to provide direct access to the gymnasium from the school's existing parking area; 4) Adequate and appropriate facilities will be provided for the proper operation of the proposed use. The building is currently serviced by town water and sewer. The Division of Public Works has reviewed the application, utilities, and drainage and deemed them to be adequate. (See letter from E. Willis dated August 27,2013) 5) Stormwater management improvements include the construction of a drainage swale to be located on the northern side of the building; roof gutter downspouts will be installed, with the two rear downspouts draining onto existing vegetation and the front downspouts to be connected to the town's existing drainage system. The plans were reviewed and deemed adequate by the town's stormwater consultant,Lisa Eggleston.(see memo dated September 17,2013) 6) An erosion control and maintenance plan has been submitted to insure proper erosion control during construction. Finally the Planning Board finds that this project generally complies with the Town of North Andover Zoning Bylaw requirements as listed in Section 8.3.5, but requires conditions in order to be fully in compliance. The Planning Board hereby grants an approval to the applicant provided the following conditions are met: SPECIAL CONDITIONS: 1) Permit Definitions: 2 North Andover School Department Site Plan Special Permit—Kittredge School Gymnasium A) The "Plans" refer to the plans prepared by Peterman Architects, Inc, 10 Concord Crossing, Concord, Ma 01742 entitled "Proposed Addition To The Kittredge Elementary School", dated July 3,2013,consisting of 43 Sheets. B) The"Project" refers to the construction of a 5,538 sq. ft. modular gymnasium on existing school property,to be attached to the existing Kittredge School,with associated stormwater drainage and extended driveway in the Residential 4 District. C) The "Applicard" refers to the North Andover School Department, the applicants for the Special Permit. D) The"Project Owner"refers to the person or entity holding the fee interest to the title to the Locus from time to time,which can include but is not limited to the applicant,developer,and owner. 2) PRIOR TO THE START OF CONSTRUCTION A) A detailed construction schedule shall be submitted to the Planning Staff for the purpose of tracking the construction and informing the public of anticipated activities on the site. B) All applicable erosion control measures must be in place and reviewed and approved by the Planning Department. C) Construction fencing must be placed along the limit of clearing and grading as shown on the pian. The Planning Department must be contacted prior to any cutting and or clearing on site. D) A pre-construction meeting must be held with the developer,their construction employees, Planning Department and other applicable departments to discuss scheduling of inspections to be conducted on the project and the construction schedule. E) The developer shall provide the Planning Board with copies of permits, plans and decisions received from all North Andover Land-Use Boards. 3) PRIOR TO THE ISSUANCE OF A BUILDING PERMIT A) Three (3) copies of the signed, recorded plans and Notice of Decision must be delivered to the Planning Department. 4) DURING CONSTRUCTION A) Dust mitigation must be performed weekly, or more frequently as directed by the Town Planner, throughout the construction process. B) Any stockpiling of materials (dirt, wood, construction material, etc.) must be shown on a plan and reviewed and approved by the Planning Staff. Any approved piles must remain covered at all times and fenced off to minimize any dust problems that may occur with adjacent properties. 3 North Andover School Department She Plan Special Permit—Kittredge School Gymnasium C) It shall be the responsibility of the developer to assure that no erosion from the construction site shall occur which will cause deposition of soil or sediment upon adjacent properties or public ways, except as normally ancillary to off-site sewer or other off-site construction. Off-site erosion will be a basis for the Planning Board making a finding that the project is not in compliance with the plan; provided, however, that the Planning Board shall give the developer written notice of any such finding and ten days to cure said condition. 6) AT COMPLETION OF CONSTRUCTION A. The applicant must submit a letter from the architect and engineer of the project stating that the building, lighting and site layout substantially comply with the plans referenced at the end of this decision as endorsed by the Planning Board. B) The Planning Staff shall review the site. Any screening as may be reasonably required by the Planning Staff will be added at the Project Owner's expense. C) A final as-built plan showing final topography,the location of all on-site utilities, structures,curb cuts,parking spaces and drainage facilities must be submitted to the Planning Department. 7)GENERAL CONDITIONS A) The contractor shall contact Dig Safe at least 72 hours prior to commencing any excavation. B) Gas, Telephone, Cable and Electric utilities shall be installed underground as specified by the respective utility companies. C) The hours for construction shall be limited to between 7:00 a.m. and 5:00 p.m. Monday through Friday and between 9:00 a.m.and 5:00 p.m.on Saturday. D) No open burning shall be done except as is permitted during burning season under the Fire Department regulations. E) No underground fuel storage shall be installed except as may be allowed by Town Regulations. F) The provisions of this conditional approval shall apply to and be binding upon the applicant, its employees and all successors and assigns in interest or control. G) Any action by a Town Board, Commission, or Department, which requires changes in the plan or design of the building, as presented to the Planning Board, may be subject to modification by the Planning Board. I ) Any revisions shall be submitted to the Town Planner for review. There are two possible locations. Option A would be attached to the west of the original building to replace the existing single modular classroom. If this location is chosen, then both the new space and original building will have a sprinkler system installed. Option B would be a stand-alone structure just south of the existing building on unused lawn on the other side of the existing access road. Description of Premises: The existing site for Option A is a slightly sloped paved area on the west side of the existing building currently occupied by the single modular classroom. The existing site for Option B is a fairly level area of unused lawn just south of the existing building, adjacent to the current parking lot and on the other side of the existing access road. REPORT: SITE PLAN REVIEW Page 1 Kittredge Elementary School Modular Classrooms (3) and Office. Documentation required by Special Permit—Site Plan Review Application The use of the Kittredge Elementary School site for the proposed modular classrooms and community program office is an appropriate use of the school property. Constructed in the selected location on part of a largely unused lawn area south of the existing building (Option B) or adjacent to the west as a replacement of the existing modular classroom (Option A)the proposed modular building does not compromise student use of the play areas. The design of the modular building is as compact as possible. The proposed modular building does not disturb the current flow of traffic nor create an undue concentration of the school population. Each space receives outside light and is heated and air-conditioned. There are code required egresses and the proposed modular building is covered by a fire alar system. If Option A is chosen then sprinklers will be installed in both the new space and the existing building. Listed below is the information required for the Special Permit Application in accordance with the Section 8.3 of the Zoning ByLaw. Name/Description of Project Three classrooms, office and handicapped accessible bathrooms with lobby are proposed to be constructed adjacent to the existing Kittredge Elementary School at 610 Main Street in North Andover. There are two possible locations. The Option A location is the same as the project previously review and approved by the Planning Board. The Option B location is just south of the existing building on unused lawn on the other side of the access road. This project is funded by the Town of North Andover with the Awarding Authority being the North Andover School Building Committee. Easements/Legal Conditions There are no known, current easements or legal encumbrances that are related to the sites physical development. Topography The 6.57 acres of land on which the existing school is located slopes down from the southwest to the northeast. Spot elevations of the existing topography are shown on the Site Plan in the area proposed for constructing the modular building. The specifications for those companies proposing to construct the modular building are required to prepare and submit a boundary survey of the school property conforming to the requirements of the Essex County Registry of Deeds Office. The surface water runoff from the driveway and puking in front of the school on the east side flows on the surface to catchbasins in Main Street and the runoff from the paved play area and existing modular class room back of the existing school building on the west side also flows on the surface to a catchbasin in Main Street. There are no catchbasins on the school site. It is proposed that the roof water from the proposed modular and the adjacent paved play area be collected in a subsurface drainage system with drain inlets and drain manholes and piped to an existing catchbasin in Main Street. Building Location The existing brick elementary school building is two stories with a height of approximately 32 feet, the existing one story modular, wood classroom building located in back of the school building is 11 feet high and the proposed modular wood building located west of the existing school building is also 11 feet high. The gross square feet for the three structures are as follow: existing school building 27,000 SF, existing modular classroom 1800 SF and the proposed modular building 3600 SF. Report: Site Plan Review—Kittredge Modular Building Page 3 Building Elevation Shown on the architectural drawings are exterior elevations of the proposed modular building. Location of Parking/Walkways The existing driveway has curb cuts on Main Street for vehicular access which is a one- way, paved drive with parking on the sides. A sidewalk extends from Main Street to the main entrance of the school building. A drive connects to main drive to the paved play area from which a drive connects to Main Street at a third curb cut. Location of Wetlands There are no wetlands on the property or within 100 feet of the proposed construction. Location of Walls/Signs There are no proposed walls or signs included in the project. Location of Roadways/Drives No new additional driveways or curb cuts are proposed. A minor amount of new pavement is proposed for sidewalks to the modular building and resurfacing a section of the existing paved play area. Outdoor Storage/Display Areas. No outdoor storage/display areas are proposed. Landscaping Plan No planting is proposed, only lawns. Refuse Areas. No refuse areas are proposed. Lighting Facilities No exterior lighting is proposed except to illuminate the entrance and exit from the proposed modular building. Drainage Basin Study Approximately 3900 square feet of additional impervious area is added to the site, the runoff of which is connected to the municipal drainage system. Report: Site Plan Review—Kittredge Modular Building Page 4 Traffic Impact Study As there is no increase in the school population, no increase in traffic is anticipated. Currently approximately 5 buses use the main drive on the east side of the school building in the morning and afternoon. Parents between 35 and 45 can dropping off and picking up students drive behind the building on the west side for each session. Parents and buses exit to Main Street using separate drives. There me 37 designated parking spaces including two handicapped parking spaces which meet the Massachusetts Architectural Access Board requirements. Commonwealth Review No permits are required to be submitted to the Commonwealth for this project. Utilities As shown on the site plan the proposed water and sewer for the modular building connect to the existing building system in the crawl space. It is proposed that the low pressure gas to the existing building be extended to the modular building for the roof-top gas fired units. The electric service will be installed underground to the modular building and a fire alarm system will be installed in the proposed modular building. Runoff from the roof leaders of the proposed modular building and adjacent exterior pavement along with a section of lawn area west and north of the proposed modular building will be collected and pipe to a catchbasin in Main Street. Fiscal Impact Relative to the operating budget for the school, there will be an increase in the costs of utilities namely gas and electric for the modular building. The overall layout of the site has been designed to be incorporated into the existing school campus,and will utilize existing parking as well as traffic entrances and exits to the site; 4) Adequate and appropriate facilities will be provided for the proper operation of the proposed use. The building is currently serviced by town water and sewer. The Division of Public Works has reviewed the application, utilities, and drainage and smrmwater management plan and deemed them to be adequate. 5) A notice of the public meeting was sent to all abutters within 300 feet of the project. The applicant presented the project at the public meeting and answered all questions and addressed all issues raised by the Planning Board. There were no members of the public who offered objections to the project. Finally the Planning Board finds that this project generally complies with the Town of North Andover Zoning Bylaw requirements as listed in Section 8.3.5, but requires conditions in order to be fully in compliance. The Planning Board hereby grants an approval to the applicant provided the following conditions are met: SPECIAL CONDITIONS: 1) Permit Definitions: A) The "Plans" refer to the plans prepared by Marshal Gary LLC, 687 20 Cabot Road, Concord, MA 01801 entitled "Kittredge School, Modular Clasnoom/Offtce Addition, North Andover, MA", dated October 1,2009,consisting of Sheets SP-1,L-hand L2. B) The"Project"refers to the construction of a modular building containing two classrooms and one 2 North Andover School Department Site Plan Review—Construction of Modular Classroom/Office Addition—Kittredge School office, with two handicapped accessible restrooms to be attached to the existing building with associated drainage. C) The"Applicant"refers to the North Andover School Department, the applicants for the Site Plan Review. D) The"Project Owner"refers to the person or entity holding the fee interest to the title to the Locus _fromtime to time,which can include but is not limited to the applicant,developer,and owner. 2) PRIOR TO THE START OF CONSTRUCTION A)An updated site plan shall be provided to the Planning Office, showing the changes to be made to the stormwater management system as outlined in the email correspondence date October 20, 2009,from town engineer E. Willis and applicant's engineer B.Gary. B) A detailed construction schedule shall be submitted to the Planning Staff for the purpose of tracking the construction and informing the public of anticipated activities on the site. C) All applicable erosion control measures must be in place and reviewed and approved by the Planning Department. D) The chain-link construction fence marking the "Limit of Work", as shown on the plan, must be installed. In addition,Yellow"Caution"tape must be placed along the limit of clearing and grading as shown on the plan. The Planning Department must be contacted prim to any cutting and or clearing on site. E) The developer shall provide the Planning Board with copies of permits, plans and decisions received from all North Andover Land-Use Boards. 3) PRIOR TO THE ISSUANCE OF A BUHAING PERNUT A) Three(3)copies of the signed,recorded plans must be delivered to the Planning Department. 4) DURING CONSTRUCTION A) Dust mitigation must be performed weekly, or more frequently as directed by the Town Planner, throughout the construction process. B) Any stockpiling of materials (dirt, wood, construction material, etc.) must be shown on a plan and reviewed and approved by the Planning Staff. Any approved piles must remain covered at all times and fenced off to minimize any dust problems that may occur with adjacent properties. C) It shall be the responsibility of the Project Owner to assure that no erosion from the construction she shall occur which will cause deposition of soil or sediment upon adjacent properties or public ways, except as normally ancillary to off-site sewer or other off-site construction. Off-site erosion will be a basis for the Planning Board making a finding that the project is not in compliance with the plan; provided, however, that the Planning Board shall give the developer written notice of any such finding and ten days to cure said condition. 3 North Andover School Department She Plan Review—Construction of Modular Classroom/Office Addition—Kittredge School D) In an effort to reduce noise levels, the developer shall keep in optimum working order, through regular maintenance,any and all equipment that shall emanate sounds from the structures or site. 6) AT COMPLETION OF CONSTRUCTION A. The applicant must submit a letter from the architect and engineer of the project stating that the building landscaping, lighting and site layout substantially comply with the plans referenced at the end of this decision as endorsed by the Planning Board. B) A final as-built plan showing final topography,the location of all on- site utilities, structures and drainage facilities must be submitted to the Planning Department. 7)GENERAL CONDITIONS A) The contractor shall contact Dig Safe at least 72 hours prior to commencing any excavation. B) Gas, Telephone, Cable and Electric utilities shall be installed underground as specified by the respective utility companies. C) The hours for construction shall be limited to between 7:00 a.m. and 5:00 p.m. Monday through Friday and between 8:00 a.m,and 5:00 p.m.on Saturday. D) No open burning shall be done except as is permitted during burning season under the Fire Department regulations. E) No underground fuel storage shall be installed except as may be allowed by Town Regulations. F) The provisions of this conditional approval shall apply to and be binding upon the applicant, its employees and all successors and assigns in interest or control. G) Any action by a Town Board, Commission, or Department, which requires changes in the plan or design of the building, as presented to the Planning Board, may be subject to modification by the Planning Board. I-I) Any revisions shall be submitted to the Town Planner for review. If these revisions are dcemed substantial,the developer must submit revised plans to the Planning Board for approval.
