The North Andover Bound of Appeals held a regular scheduled meeting at Town Hall, 120 Main Street North Andover,MA on
Tuesday,August 12th,2014 at 7:30 PM upon the application of 50 Martin Avenue(Map 45G Parcel 20)North Andover,MA
01845,applicant V.Scott Follansbee is asking for a "Request for a Minor Modification"ofa Prior Decision granted by the
North Andover Zoning Board of Appeals on June 8's 2013 and was recorded at the North Essex Registry of Deeds on September
18,2013,Book 13638 page 232#27364,dated 09-18-2013at 11:06 a
The following voting members were present: Ellen McIntyre,Rick Byers,and Allan Cuscia and Associate member present,
Doug Ludgin.
Albers P.Manzi III Esq.,recused himself from the vote.
Cuscia made a motion to Grant and to allow this as a Minor Modification of a Decision from lune 8"2013,Petition 2012-008
(June 8 2013),ofthe Special Permit for the use of the original two car garage as a traditional garage,in lieu ofconverting the
garage area to living space as part ofthe allowed Special Permit the original garage was to be used for living area(per the
Special Permit from June 8,2013).The proposed modification would obviate the need to construct the additional Moore to the
right of the home.
Referencing the letter from Arty.John Burke dated July 21,2014, and also a plan of"Building Elevations"of Side,Rear and
Front Elevations for 50 Martin Avenue,the Site Plan was prepared by J.D LaGrasse I Elm Square,Andover MA 01810,
(proposed plans),dated I I October 2012(reference plan A-2).
With the following conditions;
1.) That the said living space be converted into a garage
2.) That no detached or free standing garage be built on the property

A Special Permit to construct and attach a new unit to the existing single family dwelling, in accordance
with 10.3 and 4.122.14D
Legal notices were sent to all the certified abutters provided by the Town of North Andover,Assessors
Office,and were published in the Eagle-Tribune,a newspaper of general circulation in the Town of North
Andover,on October 30,2012 and November 6,2012.
The following voting members were present: Ellen P.McIntyre,Richard J. Byers,D.Paul Koch Jr.,and
Allan Cuscia The following Associate members were present: Michael Liporto, Denny Morganthal and
Douglas Ludgin.
Chairman,Albert Manzi recused himself from the vote
Upon a motion by Byers to GRANT a Special Permit to allow from 10.3 and 4.122.141)of the Zoning
Byaws to construct and attach new unit to the existing single family dwelling.
The following members voted in favor to Grant the Special Permit: Richard J. Byers,D. Paul Koch Jr,
Allan Cuscia and Michael Liporto.
Those not in favor to GRANT the Special Permit: Ellen P. McIntyre
4-1 Special Permit Granted approved.
The Board finds that this use, as developed by the building&site plans,will not adversely affect
the neighborhood. There will be no nuisance or serious hazard to vehicles or pedestrians since
there are provisions for the required off-street parking.Appropriate facilities will be provided for
the proper operation of the proposed two- family dwelling. The Board finds that this new two
family dwelling will not be detrimental to the neighborhood and that it will be in harmony with
the general purpose and intent of this Bylaw.
