NEGATIVE DETERMINATION OF APPLICABILITY
SPECIAL CONDITIONS
Shed Installation—495 Forest Street, North Andover
At the December 16,2015 public heating,the North Andover Conservation Commission(NACC)voted
to issue a Negative Determination of Applicability for the installation of a shed(16'x 20)within the 100-
foot Buffer Zone to Bordering Vegetated Wetland(BV W).The shed will be approximately 65-feet from
the BV W and will be placed on blocks over a bed of stone.The project will conform to the following.-

SPECIAL CONDITIONS:
1. The applicant shall ensure that the site contractor has reviewed the Determination and is aware of the
wetland resource area and the limits of the proposed work
2. No erosion controls are necessary.
3. Excess material and construction debris shall be ptopexly disposed of off-site and stockpiled material
shall be stored more than 100 feet from the BV W.
4. Upon completion of the approved project and site stabilization,please contact the Conservation
Department for a final inspection.

Protection Act and regulations:

Note:No work within the jurisdiction of the Wetlands Protection Act may proceed until a final Order of
conditions(issued following submittal of a Notice of Intent or Abbreviated Notice of Intent) or Order of
Resource Area Delineation(issued following submittal of Simplified Review ANRAD) has been received
from the issuing authority(i.e.,Conservation Commission or the Department of Environmental Protection).
❑ 1. The area described on the referenced plan(s)is an area subject to protection under the Act.
Removing,filling,dredging,or altering of the area requires the fling of a Notice of Intent.
® 2a.The boundary delineations of the fallowing resource areas described on the referenced plan(s)are
confirmed as accurate.Therefore,the resource area boundaries confirmed in this Determination are
binding as to all decisions rendered pursuant to the Wetlands Protection Act and its regulations regarding
such boundaries for as long as this Determination is valid.

regardless of whether such boundaries are contained on the plans attached to this Determination or
to the Request for Determination.

MODIFICATION TO ORDER OF CONDITIONS
495 Forest Street,North Andover
At the September 12,2012 public hearing the North Andover Conservation Commission(NACC)voted to
issue a minor modification to DEP File#242-1401. The Modification involves an approximately 600
square foot increase in pavement at the south east comer of the driveway to allow for sufficient room for
vehicle turn around. The work is located approximately 85 feet from Bordering Vegetated Wetland. The
Modification shall conform to the plans and documents referenced herein.

Conditions:
• Erosion control in the form of a silt sock shall be installed around the limit of work
• The Conservation Department shall be contacted at least 48 hours prior to the start of work for a
preconstmction inspection.
• Disturbed soil shall be stabilized immediately following the completion of work.
• The Conservation Department shall be contacted for a post-construction inspection and will authorize the
removal of erosion controls.
