The North Andover Board of Appeals held a public hearing at its regular meeting on Tuesday,April 9,
2002 at 7:30 PM upon the application of Executive Quarters,LLC(Mesiti Development Corporation),
100 Andover By-Pass,North Andover,MA requesting a dimensional Variance from Section 7,Paragraph
7.3 within Table 2 for relief of a front setback in order to construct a proposed accessory use garage,
deleting four parking spaces presently in existence;within the B-4 zoning district.
The following members were present: Robert P.Ford,Walter F. Soule,Ellen P.McIntyre,George M.
Earley and Joseph D.LaGrasse.
Upon a motion made by George M.Earley and 2°d by Ellen P.McIntyre,the Board voted to GRANT a
dimensional Variance for relief of a front setback(Hillside Road)of 14',as per Variance Plan prepared for
Executive Quarters,by Stephen M.Melesciuc,P.L.S.#39049,dated 1/8/02,Marchionda&Associates,
L.P.,62 Montvale Ave.,Suite 1,Stoneham,MA 02180 and drawing A-1 by David H:O'Sullivan,
Registered Architect#6010,O'Sullivan Architects LLC,40 Salem Street,Building 2 Suite 2,Lynnfield,
MA 01940 revised 1/24/02. Voting in favor: Robert P.Ford,Ellen P.McIntyre,George M.Earley and
Joseph D.LaGrasse. Walter F.Soule abstained because of March 12,2002 absence.
The Board finds that the applicant has satisfied the provisions of Section 10,Paragraph 10.4 of the zoning
bylaw and that such change,extension or alteration shall not be substantially more detrimental than the
existing structure to the neighborhood.
Furthermore,if the rights authorized by the Variance are not exercised within one(1)year of the date of the
grant,it shall lapse,and may be re-established only after notice,and a new hearing. Furthermore,a Special
Permit granted under the provisions.contained herein shall be deemed to have lapsed after a two(2)year
period from the date on which the Special Permit was granted unless substantial use or construction has
commenced, and may be re-established only after notice, and a new hearing.
