(CMF), and in accordance with the Massachusetts Contingency Plan (MCP) 310 Code of Massachusetts Regulations (CMR) New England Environmental Technologies 40.1403(3)(h) public notification requirements, Corporation (MEET) is notifying the Town of North Andover, MA that an Immediate Response Action (IRA) Closure Report will be filed with the Massachusetts Department of Environmental Protection. This IRA is associated with a release of approximately 30 gallons of neutralized acid rinse water to the environment which occurred at the CMF property located at 80 Flagship Drive in North Andover, MA 01845 on September 15, 2008. The DEP has assigned Release Tracking Number(RTN) 3-27978 to the release. The potential for an Imminent Hazard has been determined to no longer exist at this site. A series of excavations removed approximately 15 cubic yards of contaminated soil which was properly transported and disposed at Northland Environmental in Providence, contaminated soils which remain at the site will be further evaluated and a determination will be made as to how the site will be closed out. NEET expects this determination and the RAO Closure Report to be filed before mid-September, 2009. The results of total metals analysis performed on the soil samples collected on September 16, 2008, November 6, 2008, December 2, 2008, and June 11, 2009, indicated that the applicable clean up standards (S2 & S3) had been attained at the site. However, an Activity and Use Limitation (AUL) may be required in order to maintain a condition of no significant risk at the sight relative to the S-1 which would preclude exposure to the residual contamination.
