(CMF), and in accordance with the Massachusetts Contingency Plan (MCP) 310 Code of Massachusetts Regulations (CMR) 40.1403(3)(h) public notification requirements, New England Environmental Technologies Corporation (NEET) is notifying the Town of North Andover, MA that a written Release Notification Form (RNF) Bureau of Waste Site Cleanup (BWSC)-103 Form was submitted to the Massachusetts Department of Environmental Protection (DEP) on November 6, 2008. The RNF Form is associated with a release of approximately 30 gallons of neutralized acid rinse water to the environment which occurred at the CMF property located at 80 Flagship Drive in North Andover, MA 01845 on September 15, 2008. The DEP has assigned Release Tracking Number (RTN) 3-27978 to the release. Sometime during the late evening of September 14, 2008, a float switch within an industrial waste water evaporation treatment system became stuck and resulted in a spill of neutralized acid rinse water within the facilities building. As an apparent result of the malfunction associated with the industrial waste water evaporation treatment system, a sufficient volume of steam was generated to trigger a fire alarm. Upon responding to the fire alarm, the North Andover Fire Department (NAFD) observed neutralized acid rinse water to be exiting the facilities building. The release of neutralized acid rinse water to the environment resulted in a small area of blue surface staining directly adjacent to the southwestern portion of the facilities building. The NAFD notified CMF management personnel of the release by telephone at approximately 1:30 AM. CMF management personnel reportedly performed the necessary actions to halt the additional release of neutralized acid rinse water to the environment as well as the generation of excessive steam. The NAFD subsequently notified DEP by telephone at 1:58 PM of the apparent reportable release of a hazardous material to the environment. After coordinating with CMF management personnel and Mr. Andrew Clark of DEP by telephone, NEET's Massachusetts Licensed Site Professional (LSP) conducted a site visit during the late morning of September 15, 2008 to observe disposal site conditions. Mr. Clark provided NEET's LSP with verbal authorization to perform limited soil excavation activities. M 01334 r n _ Facsimile(973) 521-176µ LA (TO November 10,2008 NEET Project#0809742 NEET Page 2 of 3 The release of approximately 30 gallons of the neutralized acid rinse water to the environment appears to have occurred within a 24 hour period triggering a 2 hour reporting condition in accordance with the MCP at 310 CMR 40.0311(2)(a)(b)(c). The small area of blue surface staining was entirely located within the unpaved area located east of the employee entrance stairway between the facilities building and the paved surface of the employee parking area located south of the on-site facilities building. The blue surface staining did not reach the paved surface of the entrance driveway or the employee parking area. On September 16, 2008 NEET's LSP conducted a second site visit and collected a representative sample of the residual material responsible for the blue surface staining. The entire area of blue surface staining along with approximately 4-inches of underlying topsoil was excavated under the observation of NEET's LSP. The removed heavy metals contaminated soil was temporarily containerized within three (3) 55-gallon plastic drums. NEET's LSP also collected five (5) confirmatory soil samples from the bottom of the excavation area. After the completion of removal activities the excavation area was covered with a polyethylene tarpaulin. The sample of residual released material and all five (5) confirmatory soil samples were submitted for laboratory analysis of the total Priority Pollutant Metals (13 separate metals), total cyanide and pH. Laboratory analysis of the sample of residual released material collected from the ground surface identified the metals Cadmium, Chromium and Nickel at measured concentrations above the applicable MCP S-2 Reportable Concentrations (RCs). Measured concentrations of other metals and total cyanide were also identified within the released material which were below the applicable MCP S-2 RCs. The pH measurement of the residual released material at 8.9 was not below 2 or above 12.5 which would have been representative of a characteristic hazardous waste. Laboratory analysis performed on the soil samples collected after completion of the initial soil excavation activities reported measured concentrations of the metals Cadmium and Chromium above the applicable MCP S-2 RCs. The results of total metals analysis also reported measured concentrations of Cadmium, Chromium and Nickel above the applicable MCP Method 1 S-1 GW-2/GW-3 Soil Standards. A measured concentration of total cyanide was only reported within one soil sample which was below the applicable MCP Method 1 S-1 GW-2/GW-3 Soil Standard. All of the pH measurements reported for the five soil samples were between 7.2 and 8.9. None of these pH measurements are below 2 or above 12.5 which is representative of a characteristic hazardous waste. No stressed vegetation was observed to be present within the disposal site outside of the area of initial soil excavation conducted on September 16, 2008. Additionally, none of the visual observations or the results of laboratory analysis completed to date leads NEET to conclude that either a Critical Exposure Pathway (CEP) or Imminent Hazard (IH) condition is associated with the reported release of approximately 30 gallons of the neutralized acid rinse water to the environment. gA 7 November 10,2008 NEET Project#0809742 NEET Page 3 of 3 Because the preliminary results of total metals analysis performed on the confirmatory soil samples collected on September 16, 2008 indicated that soil was effected to a depth of greater than 4 inches below surface grade, NEET also prepared a written Immediate Response-Action (IRA) Plan and a BWSC-105 IRA Transmittal Form on behalf of CMF which were also submitted to DEP on November 6, 2008. The IRA activities verbally approved by DEP as of October 23, 2008 included the excavation and proper treatment/disposal of up to 10 cubic yards of contaminated soil and the collection of confirmatory soil samples from the excavation bottom and/or side walls. In accordance with the IRA Plan, on November 6, 2008 NEET observed the excavation of approximately nine (9) additional cubic yards of soil from the vicinity of the surface release. The excavated soil was containerized within a 20 cubic yard roll-off container. It is NEET's understanding that the three (3) drums of previously containerized heavy metals contaminated soil excavated on September 16, 2008 and the additional site soil excavated on November 6, 2008 will be transported off-site under a Uniform Hazardous Waste Manifest (UHWM)] for proper disposal or treatment. The remaining field activities associated with the performance of the IRA include the collection of groundwater samples from two (2) existing groundwater monitoring wells for dissolved metals analysis. Pending the results of laboratory analysis to be performed on the confirmatory soil samples collected on November 6, 2008 and the groundwater samples to be collected, NEET currently anticipates that a Class A-I Response Action Outcome (RAO) Statement will be prepared and submitted to DEP on or before January 13, 2009.
