HomeMy WebLinkAboutCorrespondence - 41 MARBLERIDGE ROAD 10/18/2001 'I"own of North Andover 'T" Office of the Planning Department Community Development and Semices Division 27 CharlesSt I've L 0, North Andover,Massactiuseh's 0-1845 Heidi Griffin Telephone(978)688-9535 Planning Director Fax(978)688-9542 MEMORANDUM TO: North Andover Planning Board FROM: Heidi Griffin,Town Planner RE: 41 Marbleridge Road-Watershed Special Permit Proposed in-ground swimming pool,retaining wall and landscaping Within the Non-Discharge Zone DATE: September 27,2001 The applicant proposes the construction of an in-ground swimming pool, retaining wall and additional landscaping (landscaping boulders), a concrete apron to match the existing texture of the existing fieldstone patio, coupled with a proposed 4' high wooden picket fence, and a versa- lok retaining wall within the Non-Discharge Zone of the Watershed Protection District. History: This lot was originally permitted for the construction of a single family dwelling and driveway within the Non-Discharge Zone of the Watershed Protection District in August of 1994, and was subsequently approved. As part of this decision, a conservation restriction easement (copies attached for your reference) was placed on the property that encompassed the Non-Disturbance Zone of the property. This easement was recorded. However, the older decision also required that a deed restriction stating that no pesticides, fertilizers, or chemicals shall be used in lawn care and maintenance; also that the area of maintained lawn to that area must remain outside of the Non-Disturbance zone and that the area within the Non-Disturbance zone must remain in its natural state. I did not find any deeds and/or recorded deeds to this effect in the file and this will need to he re-iterated in any future decision on the property. Proposal: The applicant will need to provide more specific water quality analysis as to how the proposed in-ground swimming pool will not affect the degradation of the water quality of quantity entering the lake. (an example of such a water quality analysis is located in the former File,Lot 1,Marbleridge Road). Hay bales, accompanied by silt-fence are proposed along the perimeter and the limit of work for the proposal. The installation of the fence should be hang-dug to ensure the least amount of instrusion within the Non-Discharge Zone. The applicant will need to provide detailed final plans for the design of the pool in addition to the proposed site plan which demonstrates that no backwashing of the pool would occur, and the applicant may also not use any chemicals that are prohibited in Section 4.13 6biii of the North Andover Zoning Bylaw. f30AlZl)Ol,'Ykl'Pl�,,X],S68,i-9541 BUILDING688-9545 CONSERVATION 688-9530 HEALT14688-9540 I'LANNING688-9535 TOWN OF NORTH ANDOVER PLANNING BOARD ENGINEERING REVIEW OF SITE PLAN/SPECIAL PERMIT FOR CONFORMANCE WITH THE TOWN OF NORTH ANDOVER ZONING BYLAW& STANDARD ENGINEERING PRACTICE Site Plan Title: Plan of Land VHB No.: 06716.47 Location: 41 Marbleridge Road Owner&Applicant: Stephen Lannan 41 Marbleridge Road,North Andover,MA 01852 Applicant's Engineer: Merrimack Engineering Services 66 Park Street,Andover,MA 01810 Plan Date: 8-22-01 Review Date: 9-27-01 The Applicant submitted plans and documents to VHB for review on August 30,2001. The Watershed Special Permit plan submission was reviewed for conformance to the appropriate sections of the 1972 Town of North Andover Zoning Bylaw amended on December 11,2000 and standard engineering practice. The Applicant submitted the following information for VHB's review: ➢ Plan of Land(1 sheet)dated 8-22-01 ➢ Watershed Special Permit Report dated 8-22-01 The plan submission includes a swimming pool,retaining wall and related facilities. The following comments note non-conformance with specific sections and questions/comments on the proposed Watershed Special Permit: 4.136.4.c.ii.2. The applicant should verify that the wetland resource areas shown on the plans are defined per the requirements of this section. 4.136.4.c.iii. The applicant should revise the Response to Specific Comments, item 1 to address this section in regard to the proposed work. 4.136.4.c.vi. The applicant should address this section. A written statement may be added. 4.136.4.c.vii. The applicant should submit projections of the relevant chemicals, or request a waiver from this requirement. 4.136.4.g. The applicant should address the requirements of this section(chemicals associated with the operation of the pool)or request a waiver. Standard Engineering Practice: VHB has reviewed the Watershed Special Permit and although the following comments are not specifically related to the Watershed Special Permit their purpose is to document potential issues: a.) The applicant has fieldstone and retaining walls shown within an existing 20' sewer easement on the property. The applicant should investigate the provisions of the sewer easement to determine if the easement allows the proposed walls to occur within the 20' easement limit. b.) The applicant should follow all requirements(State, local,etc.)regarding the design and construction of the retaining wall and applicable components.
